The Current Situation,Problems,and Improvement Path of Rule of Law Education in Primary and Secondary Schools in Chaoshan Area

Rule of law education in primary and secondary schools is an educational process to popularize legal knowledge,establish legal awareness,and cultivate the ability to respect,abide by,and use the law for the special group of primary and secondary school students.The research found that rule of law education in primary and secondary schools in Chaoshan has yielded positive outcomes.However,there exist problems such as uneven synergy,incomplete inclusion of teachers and students,shortage of adequately trained professional teachers,and the need for enhanced organizational support.The relevance and effectiveness of rule of law education in primary and secondary schools will be enhanced by clarifying the target tasks,enhancing the effectiveness of the classroom,creating an atmosphere of the rule of law,and strengthening organizational support.

Human rights education for primary and secondary school students is of great significance to their holistic development.At present,human rights education is actively carried out in China’s primary and secondary schools.Such human rights education includes classroom teaching based on the Ethics and the Rule of Law series of textbooks as well as developing hu man rights culture in campuses and educating students in human rights practices.Human rights education in primary and secondary schools has achieved certain results,but is as yet inade quate.In order to further improve human rights education for children,we should integrate hu man rights education with traditional Chinese culture,make better use of information technology and modem concepts of education and build a comprehensive and deep-seated human rights educa tion system.

“三治融合”视域下乡村“积分制”治理运行机制研究——基于四川省Y村的个案研究

“三治融合”是宏观层面对乡村治理的政策指引,乡村“积分制”治理正是“三治融合”理念的应用。文章以“三治融合”理念为视角,基于治理组织、治理工具、治理目标三个维度构成的治理逻辑,分析论证“三治融合”理念和乡村“积分制”治理运作机理的同一性;依据治理逻辑和运作机理,构建由起始动力机制、协调助力机制和激励保障机制形成的乡村“积分制”治理实践运行机制;通过把握乡村“积分制”治理实践运行机制,提出从构建多元治理主体协同参与的共建共治格局、运用制度和技术工具、建立因地制宜的积分评价考核机制和激励政策等方面优化完善乡村“积分制”治理,以期推动乡村治理方式的创新化发展。

新时代涉外法治人才全球胜任力教育的研究生课程体系改进

当前我国涉外法治人才培养功效不显、作用不彰的问题表明现行涉外法治人才的教育以及课程体系存在不足,未能把符合多元国际社会需要的全球胜任力涵盖其中。作为既能胜任竞争也可胜任合作的多维度能力,全球胜任力具有重要的时代价值,是我国涉外法治人才必须具备的能力,因而是我国新时代法学教育需要增强的领域。目前涉外法治人才培养的研究生课程体系普遍注重的是国际规则的知识与技能传授,却不够重视国际视野的提升,未能把全球胜任力有效地涵盖进去。在研究生课程体系的改进上,应当对“强化模块课程”加以调整,增加蕴含全球胜任力内涵的世界法律文化、比较法、可持续发展、人类命运共同体等专题课程,并将“素质提升课程模块”的讲座模式调整为相对固定的“讲座教授+”模式,注重涉外法治人才视野与价值观的提升。

近20年来教师情绪劳动研究:核心议题与研究启示

教师情绪劳动是教育学、社会学和心理学交叉领域的重要研究议题。通过对315篇教师情绪劳动文献进行梳理,发现近20年来相关研究主要集中在教师情绪劳动规则、教师情绪劳动策略、教师情绪劳动影响因素以及教师情绪劳动后果。其中,教师情绪劳动的基本规则是热爱学生,展现积极情绪,隐藏负面情绪;教师情绪劳动最常使用的策略首先是真实表达,其次是深层扮演,最后是表层扮演;教师情绪劳动的主要影响因素包括个体因素和工作情境因素;教师情绪劳动会影响教师的工作满意度、工作投入、教学效果、自我效能感、职业倦怠、组织承诺、忠诚感和离职意向。教师情绪劳动研究对教育教学实践具有重要指导意义,在组织层面,要认识教师情绪劳动的两面性,优化教育教学管理;在教师个体层面,要充分理解教师情绪劳动的特殊性,促进自身身心健康。未来的教师情绪劳动研究需要在研究设计、理论模型、研究主题和实践指导意义等方面做进一步拓展。

教育法典中数字教育规范图景及其实现

新时代,教育立法的核心任务是提升立法品质、实现良法善治,随着教育法典编纂工作被列入立法计划,教育法法典化研究受到广泛关注。面临数字社会快速发展新形态,数字教育新问题日益凸显,数字技术的应用为传统的教育模式带来一系列新挑战,现阶段的数字教育法律体系难以满足数字教育治理的迫切需求,数字背景下的高质量教育立法显得至关重要。将数字教育规范深度融入教育法典之中,应当成为法典编纂设想的题中应有之义。在编纂教育法典的系统性工程中,遵循数字教育规范进路,以数字教育法律原则、数字教育主体规范、数字教育行为规范和数字教育技术规范为基础,充分补充、调整和升级相关数字教育法律规范,形成以数字教育法律原则为统领的数字教育法律规范图景,为教育的高质量、可持续发展奠定坚实的制度基础。

中国式法治现代化视域下司法警校法学教学改革探析

中国式法治现代化对司法警校的人才培养工作提出了新的更高要求。本文以12所司法警校法学教学课程开设情况为研究样本,发现部分院校对法学教学不够重视,法学理论课程与实践课程体系不健全。对此,应当以习近平法治思想为指导,对司法警校法学教学进行系统改革优化。要正确认识和处理法学教学与警务技能教学的关系,从法学理论和实践教学两个层面同时进行改革优化,构建包含基础、核心和拓展课程的多层次理论课程体系,培养学生的法学素养和法治思维,大力开展法律职业道德教育,促进学生德法兼修、公正执法;通过系统的法学实践训练培养学生的执法实践能力,促进学校教学与行政执法的有效衔接。

虽然儿童中心论对于儿童立场的确立具有重要意义,但二者不能等同。儿童立场承认儿童拥有“人”的权利,尊重儿童的特殊性,并强调儿童是发展中的人。儿童立场与学科立场、儿童立场与国家立场、儿童的全面发展和个性发展之间不是对立的,而是辩证统一的。坚守儿童立场,有利于教材激发儿童学习的真正兴趣,建立与儿童生活的联系,并实现学科的融合互动。前人的初步探索表明,中小学德育教材坚守儿童立场是可行的。基于儿童立场,中小学德育教材的编写目的要基于儿童又超越儿童中心;教材要成为激活儿童发展的“活性因子”;教材内容既要重视儿童经验,也要重视人类知识,并对后者进行心理学化处理;教材要重视学习活动的设计,实现“利学易教”;教材语言要溢满童趣且符合儿童年龄。
