It concludes that changes of property rights will affect farmland performance in China. In the end, some policy implications are explored for fur- ther reforms.展开更多

To ensure the ecological safety of Minqin Oasis and to provide management basis for the abandoned land, soil physical properties were observed and studied. The authors analyzed land with abandonment time of 1 year, 2 years, 3 years, 4 years, 5 years, 8 years, 15 years, 24 years and 31 years. Samples were took at the 0-40 cm layer of soil to measure the bulk density, porosity and grain composition of soil in the different abandoned lands. Results showed that the tendency of clay content was decreasing, conversely, the fine sand increased at the layer of 0-10 cm of different abandoned lands.The changes of grain content reached a peak at the fourth year after the land was abandoned, then varied slightly. The variation of grain content of abandoned land was obvious with the extension of the abandonment year. The soil bulk density decreased and porosity increased with the extension of the abandonment year. The difference of porosity and soil bulk density at the range of 0-40 cm of different abandoned land decreased after the land abandoned for 3 years. The quality of soil was decreased, while the soil permeability was improved. The soil physical properties changed obviously in 3 to 4 years after abandonment, so it is the key time for land management.展开更多

The innovative models cover buying shares of contract management rights,transforming from farmers to townspeople and mortgaging contract management rights. The plights exist in the reform are analyzed,among which the plights of buying shares of contract management rights are introduced from the following five aspects:the conflict with the present land contract laws,the possible new round of massive scale land loses,the confounded functions of government and enterprise caused by risk transference and the difficulties of handling assets when the contract management rights expired. Besides,the plights of the transforming from rural residents to urban residents are analyzed from four aspects,which include the particularity of reform,high financial pressure,emergence of interbedded people and difficulties of payoff of village-based companies. From the facets of limited mortgage area,risks of reimbursing the loan,legal risks of mortgage. The results show that the stock purchasing model of contractual management rights reveals the capital value of land and the model is of theoretical and practical significance in law and economics. However,the social security system is not perfect,so the stock purchasing model of contractual management rights can not be expanded. In addition,the participation of more famers and the expansion of enterprises are limited as well. The land comprehensive reform model of transforming from rural residents to urban residents is of positive significance to the comprehensive exploration of farmland property system reform,but this kind of model should be supported by strong economy. After landing in the Utopia Planitia,Tianwen-1 formed the deepest landing crater on Mars,approximately 40 cm deep,exposing precious information about the mechanical properties of Martian soil.We established numerical ...After landing in the Utopia Planitia,Tianwen-1 formed the deepest landing crater on Mars,approximately 40 cm deep,exposing precious information about the mechanical properties of Martian soil.We established numerical models for the plume-surface interaction(PSI)and the crater formation based on Computational Fluid Dynamics(CFD)methods and the erosion model modified from Roberts’Theory.Comparative studies of cases were conducted with different nozzle heights and soil mechanical properties.The increase in cohesion and internal friction angle leads to a decrease in erosion rate and maximum crater depth,with the cohesion having a greater impact.The influence of the nozzle height is not clear,as it interacts with the position of the Shock Diamond to jointly control the erosion process.Furthermore,we categorized the evolution of landing craters into the dispersive and the concentrated erosion modes based on the morphological characteristics.Finally,we estimated the upper limits of the Martian soil’s mechanical properties near Tianwen-1 landing site,with the cohesion ranging from 2612 to 2042 Pa and internal friction angle from 25°to 41°.展开更多

In the Loess Plateau of China,land-use pattern is a major factor in controlling underlying biological processes.Additionally,the process of land-use pattern was accompanied by abandoned lands,potentially impacting soi...In the Loess Plateau of China,land-use pattern is a major factor in controlling underlying biological processes.Additionally,the process of land-use pattern was accompanied by abandoned lands,potentially impacting soil microbe.However,limited researches were conducted to study the impacts of land-use patterns on the diversity and community of soil microorganisms in this area.The study aimed to investigate soil microbial community diversity and composition using high-throughput deoxyribonucleic acid(DNA)sequencing under different land-use patterns(apricot tree land,apple tree land,peach tree land,corn land,and abandoned land).The results showed a substantial difference(P<0.050)in bacterial alpha-diversity and beta-diversity between abandoned land and other land-use patterns,with the exception of Shannon index.While fungal beta-diversity was not considerably impacted by land-use patterns,fungal alpha-diversity indices varied significantly.The relative abundance of Actinobacteriota(34.90%),Proteobacteria(20.65%),and Ascomycota(77.42%)varied in soils with different land-use patterns.Soil pH exerted a dominant impact on the soil bacterial communities'composition,whereas soil available phosphorus was the main factor shaping the soil fungal communities'composition.These findings suggest that variations in land-use pattern had resulted in changes to soil properties,subsequently impacting diversity and structure of microbial community in the Loess Plateau.Given the strong interdependence between soil and its microbiota,it is imperative to reclaim abandoned lands to maintain soil fertility and sustain its function,which will have significant ecological service implications,particularly with regards to soil conservation in ecologically vulnerable areas.展开更多
Soil infiltration properties(SIPs)of infiltration rate and saturated hydraulic conductivity significantly affect hydrological and erosion processes,thus,knowledge of SIPs under different land use/cover are vital for l...Soil infiltration properties(SIPs)of infiltration rate and saturated hydraulic conductivity significantly affect hydrological and erosion processes,thus,knowledge of SIPs under different land use/cover are vital for land use management to control soil erosion for realizing the sustainable development of the small agricultural watershed.Nevertheless,few studies have been carried out to investigate the differences in SIPs and their dominant influencing factors between different land use/cover in the black soil region of Northeast China.Therefore,eight typical land use/cover were selected to clarify the variations in SIPs between different land use/cover and further identify their dominant influencing factors.SIPs of initial infiltration rate(IIR),steady infiltration rate(SIR),and saturated hydraulic conductivity(Ks)were determined under eight typical land use/cover(forestland,shrub land,grassland,longitudinal shelterbelt,transverse shelterbelt,agricultural road,and cropland of Zea mays L.and Glycine max(Linn.)Merr)using a tension disc infiltrometer with three pressure heads of−3,−1.5,and 0 cm.The results of one-way ANOVA analysis showed that SIPs varied greatly between different land use/cover.Shelterbelt plant with Populus L.had the maximum IIR,SIR,and Ks,and then followed by shrub land,agricultural road,cropland,grassland,and forestland.Spearman correlation analysis indicated that SIPs were significantly correlated with soil and vegetation properties.Redundancy analysis revealed that differences in SIPs between different land use/cover were dominantly attributed to the differences in soil texture,field capacity,and plant root mass density,which explained 79.36%of the total variation in SIPs.Among these dominant influencing factors,the results of structural equation model indicated that the indirect effects of plant root and soil texture played the most important role in variations of SIPs via affecting soil texture and pore characteristics.These results have significant implications for the precise prediction of watershed hydrological and erosion processes,also provide a scientific basis for guiding the distribution pattern of land use in the cultivated watershed.展开更多
Vegetation restoration through artificial plantation is an effective method to combat desertification,especially in arid and semi-arid areas.This study aimed to explore the ecological effect of the plantation of Sabin...Vegetation restoration through artificial plantation is an effective method to combat desertification,especially in arid and semi-arid areas.This study aimed to explore the ecological effect of the plantation of Sabina vulgaris on soil physical and chemical properties on the southeastern fringe of the Mu Us Sandy Land,China.We collected soil samples from five depth layers(0-20,20-40,40-60,60-80,and 80-100 cm)in the S.vulgaris plantation plots across four plantation ages(4,7,10,and 16 years)in November 2019,and assessed soil physical(soil bulk density,soil porosity,and soil particle size)and chemical(soil organic carbon(SOC),total nitrogen(TN),available nitrogen(AN),available phosphorus(AP),available potassium(AK),cation-exchange capacity(CEC),salinity,p H,and C/N ratio)properties.The results indicated that the soil predominantly consisted of sand particles(94.27%-99.67%),with the remainder being silt and clay.As plantation age increased,silt and very fine sand contents progressively rose.After 16 years of planting,there was a marked reduction in the mean soil particle size.The initial soil fertility was low and declined from 4 to 10 years of planting before witnessing an improvement.Significant positive correlations were observed for the clay,silt,and very fine sand(mean diameter of 0.000-0.100 mm)with SOC,AK,and p H.In contrast,fine sand and medium sand(mean diameter of 0.100-0.500 mm)showed significant negative correlations with these indicators.Our findings ascertain that the plantation of S.vulgaris requires 10 years to effectively act as a windbreak and contribute to sand fixation,and needs 16 years to improve soil physical and chemical properties.Importantly,these improvements were found to be highly beneficial for vegetation restoration in arid and semi-arid areas.This research can offer valuable insights for the protection and restoration of the vegetation ecosystem in the sandy lands in China.展开更多

Results indicate that at the level of legislative techniques,the land development rights rooted from property right paradigm do not contain possess the elements of object of real rights and conflict with the principle of statutory real rights and single ownership. At the level of legal logic,individual case of TDR conflicts with real right in rem. In conclusion,it is infeasible to introduce land development rights based on the path of real rights. China, the attribute of virtual property rights has changed from real rights to non-real rights. Article No. 127 thereof does not clarify the nature of virtual property rights after all, and the place where virtual property is put in the "Civil Rights" chapter of General Provisions of the Civil Law makes the concept even more complex and confusing. The "relationships paradigm" protection of virtual property does not have a definite classification criterion, nor stands opposite to the "rights paradigm." There are two different ways to justify the "theory of virtual property as a real right" under the "rights paradigm" protection, namely, essentialism and consequentialism. The former resulted from utilizing features in a demonstration and identifying disposal rights with real rights, while the latter resulted from adherence to the dichotomy system of property rights comprising real rights and creditor's rights. From the perspective of larceny in Criminal Law and virtual property insurance in The Social Insurance Law, the attribute of virtual property rights is irrelevant to creditor's rights. The attribute of virtual property rights shall be defined as virtual property rights so that it can be included in the system of civil rights. The uniqueness of virtual property is enough to become an object of emerging civil rights; intangible property rights as a superordinate theoretical concept cannot reflect the essence of virtual property rights. [Method] The soil physicochemical proper- ties in five representative lands respectively covered by Artemisia ordosica, Salix cheilophila, Hedysarum scoparium, Populus simonii and Amorpha fruticosa, all of which were planted artificially at the same year were measured in the present study, using a bare soil as the control. [Result] Artificial vegetation improved the soil physicochemical properties by different extents in the lands covered by different plants. The soil physicochemical properties such as bulk density under A. Fruticosa and H. Scoparium were improved greatly. The frequency distribution of soil particle size under artificial vegetations exhibited a bimodal curve. The average soil particle size under A. fruticosa was the smallest, and the soil was very poorly sorted. The soil nutrients in the sandy land were not significantly improved by artificial vegeta- tion. [Conclusion] Artificial vegetation has a certain impact on soil properties in sandy land, as it greatly improves the soil physical properties but not the chemical properties.展开更多

文摘After landing in the Utopia Planitia,Tianwen-1 formed the deepest landing crater on Mars,approximately 40 cm deep,exposing precious information about the mechanical properties of Martian soil.We established numerical models for the plume-surface interaction(PSI)and the crater formation based on Computational Fluid Dynamics(CFD)methods and the erosion model modified from Roberts’Theory.Comparative studies of cases were conducted with different nozzle heights and soil mechanical properties.The increase in cohesion and internal friction angle leads to a decrease in erosion rate and maximum crater depth,with the cohesion having a greater impact.The influence of the nozzle height is not clear,as it interacts with the position of the Shock Diamond to jointly control the erosion process.Furthermore,we categorized the evolution of landing craters into the dispersive and the concentrated erosion modes based on the morphological characteristics.Finally,we estimated the upper limits of the Martian soil’s mechanical properties near Tianwen-1 landing site,with the cohesion ranging from 2612 to 2042 Pa and internal friction angle from 25°to 41°.

文摘In the Loess Plateau of China,land-use pattern is a major factor in controlling underlying biological processes.Additionally,the process of land-use pattern was accompanied by abandoned lands,potentially impacting soil microbe.However,limited researches were conducted to study the impacts of land-use patterns on the diversity and community of soil microorganisms in this area.The study aimed to investigate soil microbial community diversity and composition using high-throughput deoxyribonucleic acid(DNA)sequencing under different land-use patterns(apricot tree land,apple tree land,peach tree land,corn land,and abandoned land).The results showed a substantial difference(P<0.050)in bacterial alpha-diversity and beta-diversity between abandoned land and other land-use patterns,with the exception of Shannon index.While fungal beta-diversity was not considerably impacted by land-use patterns,fungal alpha-diversity indices varied significantly.The relative abundance of Actinobacteriota(34.90%),Proteobacteria(20.65%),and Ascomycota(77.42%)varied in soils with different land-use patterns.Soil pH exerted a dominant impact on the soil bacterial communities'composition,whereas soil available phosphorus was the main factor shaping the soil fungal communities'composition.These findings suggest that variations in land-use pattern had resulted in changes to soil properties,subsequently impacting diversity and structure of microbial community in the Loess Plateau.Given the strong interdependence between soil and its microbiota,it is imperative to reclaim abandoned lands to maintain soil fertility and sustain its function,which will have significant ecological service implications,particularly with regards to soil conservation in ecologically vulnerable areas.

文摘Soil infiltration properties(SIPs)of infiltration rate and saturated hydraulic conductivity significantly affect hydrological and erosion processes,thus,knowledge of SIPs under different land use/cover are vital for land use management to control soil erosion for realizing the sustainable development of the small agricultural watershed.Nevertheless,few studies have been carried out to investigate the differences in SIPs and their dominant influencing factors between different land use/cover in the black soil region of Northeast China.Therefore,eight typical land use/cover were selected to clarify the variations in SIPs between different land use/cover and further identify their dominant influencing factors.SIPs of initial infiltration rate(IIR),steady infiltration rate(SIR),and saturated hydraulic conductivity(Ks)were determined under eight typical land use/cover(forestland,shrub land,grassland,longitudinal shelterbelt,transverse shelterbelt,agricultural road,and cropland of Zea mays L.and Glycine max(Linn.)Merr)using a tension disc infiltrometer with three pressure heads of−3,−1.5,and 0 cm.The results of one-way ANOVA analysis showed that SIPs varied greatly between different land use/cover.Shelterbelt plant with Populus L.had the maximum IIR,SIR,and Ks,and then followed by shrub land,agricultural road,cropland,grassland,and forestland.Spearman correlation analysis indicated that SIPs were significantly correlated with soil and vegetation properties.Redundancy analysis revealed that differences in SIPs between different land use/cover were dominantly attributed to the differences in soil texture,field capacity,and plant root mass density,which explained 79.36%of the total variation in SIPs.Among these dominant influencing factors,the results of structural equation model indicated that the indirect effects of plant root and soil texture played the most important role in variations of SIPs via affecting soil texture and pore characteristics.These results have significant implications for the precise prediction of watershed hydrological and erosion processes,also provide a scientific basis for guiding the distribution pattern of land use in the cultivated watershed.

文摘Vegetation restoration through artificial plantation is an effective method to combat desertification,especially in arid and semi-arid areas.This study aimed to explore the ecological effect of the plantation of Sabina vulgaris on soil physical and chemical properties on the southeastern fringe of the Mu Us Sandy Land,China.We collected soil samples from five depth layers(0-20,20-40,40-60,60-80,and 80-100 cm)in the S.vulgaris plantation plots across four plantation ages(4,7,10,and 16 years)in November 2019,and assessed soil physical(soil bulk density,soil porosity,and soil particle size)and chemical(soil organic carbon(SOC),total nitrogen(TN),available nitrogen(AN),available phosphorus(AP),available potassium(AK),cation-exchange capacity(CEC),salinity,p H,and C/N ratio)properties.The results indicated that the soil predominantly consisted of sand particles(94.27%-99.67%),with the remainder being silt and clay.As plantation age increased,silt and very fine sand contents progressively rose.After 16 years of planting,there was a marked reduction in the mean soil particle size.The initial soil fertility was low and declined from 4 to 10 years of planting before witnessing an improvement.Significant positive correlations were observed for the clay,silt,and very fine sand(mean diameter of 0.000-0.100 mm)with SOC,AK,and p H.In contrast,fine sand and medium sand(mean diameter of 0.100-0.500 mm)showed significant negative correlations with these indicators.Our findings ascertain that the plantation of S.vulgaris requires 10 years to effectively act as a windbreak and contribute to sand fixation,and needs 16 years to improve soil physical and chemical properties.Importantly,these improvements were found to be highly beneficial for vegetation restoration in arid and semi-arid areas.This research can offer valuable insights for the protection and restoration of the vegetation ecosystem in the sandy lands in China.
文摘The current plights of farmers' land rights in China are analyzed.They cover the vain installation of the security of farmers' land rights,vain position of the dominant role played by rural collective land,incomplete functions of rural collective land and the inadequate material assistance of farmers.The solutions for ensuring the security of farmers' land rights are put forward,in the first place,perfecting the legislation of guaranteeing farmers' land rights.In the second place,scientifically installing the rural land rights,which covers the following aspects,such as,clearly defining that the collective ownership of rural land belongs to farmers in law;clearly defining the main body of rural land property and eliminating the shortage of property rights;demarcating the range of public interests and clearly stipulating the reasonable compensation of main body of land expropriation.In the third place,villagers' autonomy should be perfected.In the forth place,standardizing the system of land expropriation,which includes the two aspects of normalizing the land transference procedure and the control of collecting land tax,and establishing fair compensation standard and normalizing land compensation procedure.In the fifth place,strengthening land transference and judiciary,and enforcing supervision;in the sixth place,accelerating the development of peasants' cooperative economic organizations and cultivating peasants' rights keeping organization.Through the discussion on the plights and solutions of farmers' land rights protection,the coordination of rural and urban development will be realized and a harmonious society will be built.

文摘Using comparative analysis and documentation method,this paper reveals infeasibility of establishing land development rights in China based on the path of real rights,in the hope of providing recommendations for improving the research route on localization of land development rights. Results indicate that at the level of legislative techniques,the land development rights rooted from property right paradigm do not contain possess the elements of object of real rights and conflict with the principle of statutory real rights and single ownership. At the level of legal logic,individual case of TDR conflicts with real right in rem. In conclusion,it is infeasible to introduce land development rights based on the path of real rights. In future,it is required to discard the concept of mechanical transplantation and explore feasible path and seek feasible way for establishing land development rights along with the direction of quasi-property and improving regulation efficiency.

文摘Investments in rural land for agriculture, timber, and other natural resource purposes occur frequently and globally. Fundamental principles of liberty and property found in the United States of America’s (“US”) legal system, from its origins to recent US Supreme Court decisions, continue to positively benefit holders of real estate in the Southern US, through a deep-rooted public policy of supporting private property rights and rural economic development. This stable rule of law enhances the long-term adaptability and sustainability of timberland as an asset class. This article is a commentary. It combines legal research methodology with the observations and conclusions of the authors. Its purpose is to demonstrate that the existence of alienable, documentable ownership, and related property rights create inherent stability and security. These principles form the basis of a culture that is defined by the rule of law and is “open for business.” This business mindset is particularly prevalent in the Southern US.

文摘In the process of formulating the General Provisions of the Civil Law of P. R. China, the attribute of virtual property rights has changed from real rights to non-real rights. Article No. 127 thereof does not clarify the nature of virtual property rights after all, and the place where virtual property is put in the "Civil Rights" chapter of General Provisions of the Civil Law makes the concept even more complex and confusing. The "relationships paradigm" protection of virtual property does not have a definite classification criterion, nor stands opposite to the "rights paradigm." There are two different ways to justify the "theory of virtual property as a real right" under the "rights paradigm" protection, namely, essentialism and consequentialism. The former resulted from utilizing features in a demonstration and identifying disposal rights with real rights, while the latter resulted from adherence to the dichotomy system of property rights comprising real rights and creditor's rights. From the perspective of larceny in Criminal Law and virtual property insurance in The Social Insurance Law, the attribute of virtual property rights is irrelevant to creditor's rights. The attribute of virtual property rights shall be defined as virtual property rights so that it can be included in the system of civil rights. The uniqueness of virtual property is enough to become an object of emerging civil rights; intangible property rights as a superordinate theoretical concept cannot reflect the essence of virtual property rights. The legislative frame of virtual property rights shall be comprised of the subject, object, exercise, publication and change of the rights.
文摘The viability of exponentially growing non-fungible token(NFT)market is evaluated by identifying potential value-generating mechanisms that can be rationalized.After identifying the value-generating mechanisms underlying the positive values of NFTs,this study establishes a pricing model for NFTs that follows a continuous-time financial framework.As NFTs are claimed to securitize“ownership rights short of use”,and as such they may potentially serve as a substitute for the need to rely replace the reliance on the legal protection provided by intellectual property rights(IPRs).Considering this issue,this study evaluates the likelihood that NFTs will replace existing mechanisms that protect producers’rightful claim to use their assets or the need to apply the legal code that governs IPRs.The financial condition for this potential shift is derived for a category of assets whose use or consumption does not reduce supply as the notion of scarcity does not apply.

文摘[Objective] This study aimed to investigate the artificial vegetations on soil physicochemical properties of sandy land. [Method] The soil physicochemical proper- ties in five representative lands respectively covered by Artemisia ordosica, Salix cheilophila, Hedysarum scoparium, Populus simonii and Amorpha fruticosa, all of which were planted artificially at the same year were measured in the present study, using a bare soil as the control. [Result] Artificial vegetation improved the soil physicochemical properties by different extents in the lands covered by different plants. The soil physicochemical properties such as bulk density under A. Fruticosa and H. Scoparium were improved greatly. The frequency distribution of soil particle size under artificial vegetations exhibited a bimodal curve. The average soil particle size under A. fruticosa was the smallest, and the soil was very poorly sorted. The soil nutrients in the sandy land were not significantly improved by artificial vegeta- tion. [Conclusion] Artificial vegetation has a certain impact on soil properties in sandy land, as it greatly improves the soil physical properties but not the chemical properties.
