In the current stage of Chinese forest ownership reform,the central and local governments as well as the forest farmers play different roles with variations in their expected returns.Managing these respective relation...In the current stage of Chinese forest ownership reform,the central and local governments as well as the forest farmers play different roles with variations in their expected returns.Managing these respective relationships between the forestry stakeholders to maximize their benefits while actively engaging each stakeholder in the collective forest ownership reform process has become an important issue.This study uses the game theory methodology to analyze the relationship between the different reform stakeholders and then builds on the forest farmers' participation in the reform model process at the reform movement micro-level.This model calculates the forest products equilibrium marketing sales and the government subsidies provided to the forest farmers,when the forest farmers willingly participate in the reform process.It will provide a reliable basis for formulation of government policies which positively impacts Chinese forestry reform.展开更多

Through analysis, the reasons of influent transfer of forest land include peasant's subjective will, less type of transfer objects, dull information communication, big difference of expected price and imperfect development of intermediary organization. In order to promote a healthy development of forest land transfer, the paper puts forward proposals of strengthening policy publicity, improving system, identifying property right, pushing variety of transfer types, developing forest land market, cultivating subject of market and so on.展开更多

The changes of contemporary Chinese human rights conceptions have gone through the stages from the views of human rights to the theories of human rights, to the norms and practices of human rights, and human rights conceptions developed from avoidance to controversy, from passiveness to initiative, and from learning to construction, which reflects the continuous development of China’s human rights cause. By analyzing the journal records through a search of the human rights and its related keywords, it is possible to chart the evolution and historical context of contemporary Chinese human rights theory.展开更多

During the past 40 years since the reform and opening-up, the relevant research has changed from the ideological contention deeply influenced by class discourse to the abstract theoretical research where class discourse has been fading away, and then turn to the technical and concrete practical research. This "change" is clearly visible and, to a certain extent, reveals the track of the development of human rights theory. However, there is "constancy" in "change". Therefore, it is necessary to further change our notion of the criminal law system by defining the boundary between public power and civil rights and developing the view of human rights protection. In terms of the specific system, it is necessary to further reduce the number of crimes punishable by the death penalty and limit the application of the death sentence, improve China’s Criminal Procedural Law to protect the fundamental rights of suspects and defendants in terms of compulsory measures, investigation means and judicial form, and add some charges like enslavement and illegal human experimentation, which are criminalized around the world, so as to be in line with the requirements of international human rights protection.展开更多
