Analysis of Hidden Danger in Farmer's Rights and Interests during Farmland Transfer——An Evaluation of Rights Safeguarding Effect of Farmland Transfer Contract

Taking Shuangliu County,Chengdu City,China as an example,evaluation index system for the rights protection effects of farmland transfer is established contract from three aspects of basic information,transfer agreement and legal safeguards in the contracts.According to the investigation data,weight of evaluation index is determined by both entropy weight and Analytic Hierarchy Process.Comprehensive index method is used to evaluate the rights protection effects of farmland transfer contract in the flat dam,high hill and low hill in Shuangliu County,Chengdu,China.Result shows that the transfer agreement of farmland and the basic information of contract greatly affect the rights protection effects of farmland transfer contract.There are differences in the five indices of the information of the signature of contract,pricing for payment,time limit for farmland transfer,transfer mode of farmland,and use range of farmland transfer.During the farmland transfer in reality,there are three hidden dangers in farmer's land rights and interests,which are the ill-formed transfer behavior,the relatively low income of farmers from farmland transfer,and the quality decline of farmland and difficult full reclamation in transfer period.Based on the evaluation result and investigation data,countermeasures are put forward to improve the rights protection effects of farmland transfer contract.

Migrant Workers' Lack of Cultural Rights and Interests and Government Safeguard Measures

This paper analyses the status quo of migrant workers' lack of cultural rights and interests as follows:the holistic cultural life of migrant workers is scant and monotonous;the cultural facilities provided by the majority of enterprises are critically short;the cultural life of migrant workers has the characteristic of closeness to some extent;the holistic cultural consuming capacity of migrant workers is very low,and they are not satisfied with their own cultural life.This paper puts forward the measures that the government should adopt to make up for the lack of migrant workers' cultural rights and interests as follows:first,it should eliminate discrimination in terms of system,and incorporate migrant workers' cultural rights and interests into the building scope of urban public culture;second,it should establish a variety of free public culture facilities,to adapt to the needs of migrant workers;third,it should formulate various kinds of laws and regulations,to effectively safeguard migrant workers' cultural rights and interests.

Safeguarding Farmer Workers' Rights and Interests——An interview with Ye Jingyi, professor of Beijing University Law School

Farmer workers are a new powerful workforce that has sprung up amid China＇s reform and door opening and in the process of the country＇s industrialization and urbanization. They have made great contributions to urban prosperity, rural development and their country＇s modernization. At present, however, farmer workers face numerous difficulties and problems in income, work safety, social security, vocational training, the schooling of their children and living conditions. To safeguard the legitimate rights and interests of farmer workers, the State Council in March 2006 issued Ideas of the State Council on Solving Farmer Workers-related Problems. In the document, the State Council promises to strengthen and improve leadership over work regarding farmer workers and prioritize the solving of farmer workers-related problems.

老年人社会参与实践考察与保障机制研究——以昆明市为例

社会参与是积极老龄化应对全球人口挑战提出的重要任务之一。以社会参与理念落地为研究背景,以昆明市老年人社会参与实践考察数据为例,从老年人社会参与实践特征维度予以分析。结果显示:昆明市老年人社会参与存在缺乏理论与制度保障、就业权益缺乏法律保障、社会参与能力不足的问题。对此,应通过优化老年人社会参与政策制度、完善老年人社会参与平台建设、分类管理指导老年人社会参与工作、优化老年人社会参与能力与环境四个保障机制推进积极老龄化发展。

新媒介使用与农民工权益表达——一个有调节的中介效应模型

通过对北京、上海、广州、湖南等省市农民工的调查研究,探索新媒介使用、权益认知、权益损害程度及维权效能感等因素和农民工权益表达之间的影响关系。研究发现:新媒介使用虽能直接影响权益表达,但效果有限,权益认知和权益损害程度等因素在新媒介使用影响权益表达过程中起到中介作用。新媒介使用通过权益认知和权益损害程度影响权益表达的中介过程受到维权效能感的调节作用:较高的维权效能感在权益认知和权益损害程度中介路径上起正调节作用;较低的维权效能感只在权益损害程度中介路径上起正调节作用;维权效能感在新媒介使用直接影响权益表达路径上调节作用不明显。

尊重劳动者与保护投资者

尊重劳动者,提高企业劳动收入份额,是实现社会主义共同富裕的本质要求,它对保护投资者是否同样有利,关系到这项要求能否得到自觉持续响应。以2013年至2022年我国沪深A股上市公司为样本进行研究,发现企业尊重劳动者也有利于保护投资者,当企业所处地区教育发展水平和企业数字化发展水平较高时,这种效应更显著。经过一系列稳健性检验,结论依然成立。进一步研究发现,提高创新投入和缓解投资不足发挥部分中介作用,尊重劳动者与保护投资者的正向关系在国有企业、劳动密集型企业中更显著。研究结论为企业自觉响应国家号召,提高劳动收入份额、保护投资者权益、实现共同富裕提供了有益启示。

就业性别歧视的法律治理路径分析

党和国家为实现就业公平做出了巨大努力,但就业中对女性的性别歧视仍然存在。实践中,法律条款的细化仍显不足,导致部分保护性条款被片面解读;司法裁判的执行也面临一定的挑战,影响了法律的有效实施。为避免性别歧视对经济增长和人口结构产生负面影响,治理应遵循淡化性别差异,强化性别平等的基本原则。在事前预防方面,应针对不同形式的歧视设立明确标准,增强法律的可操作性,扩大责任形式和物质赔偿力度,提升法律威慑力。在事后规制方面,可根据就业阶段细化案由,推行举证责任倒置制度,并引入公益诉讼机制,以提高女性维权的实效性。通过立法、司法、社会文化建设等多方联动,全面根治就业性别歧视,保持我国人力资源的禀赋优势,助力应对当前世界百年未有之大变局。

由“碎片化”走向“组织化”——中国新农村建设的战略构想

失地农民权益保障典型安置模式探析

失地农民权益保障是我国城市化进程中面临的一个突出问题。文章在对国内各地征地实践系统梳理和综合比较基础上,总结出社保型安置、产权型安置、实物型安置和综合型安置4种典型安置模式,并深入分析了每一种模式的具体做法、取得的成效及存在的不足。研究发现,每种安置模式都有自身显著特点和外在适用条件,很难找到具有普遍适用性的安置模式。分析表明为有效维护失地农民权益,各地应在辩证借鉴已有典型安置模式成功经验基础上,结合地方实际加快征地制度改革,积极探寻适合当地情况的安置措施。

股权众筹视角下投资者权益保护法律问题研究

投资者权益保护是股权众筹中的核心问题。当前,投资者权益保护存在着投资理念缺位、法律规定缺失、监管体制乏力、征信系统疏漏的问题。通过考察并借鉴域外国家关于股权众筹立法、投资额度规制、监管制度及其他法律制度的有益经验,并结合股权众筹投资者权益保护在我国的发展实际提出了应对思路:一要确立投资审慎和适度理念;二要明确立法路线,推动股权众筹立法不断完善;三要理清监管思路,促进股权众筹监管不断增强;四要贯通征信系统,确保股权众筹征信不断成熟。以期明晰股权众筹投资的价值观念、塑造股权众筹投资的诚信环境、防范股权众筹投资的固有风险、完善股权众筹投资的制度建设,促进我国多层次资本市场稳步构建。

刑满释放人员的社会保障权益维护研究

刑满释放人员在社会保险参与资格、社会保障待遇享受、安置帮教救助项目方面存在问题。另外,由于社会干预不足,社会歧视,缺乏组织依靠及其自身特这类人群的社会保障权益维护工作处于困境。为此,应借鉴美、日、英、加等国家的经验,落实刑满释放人员的社会保障权益维护。

以人为本保障农民工权益

由于历史与现实的诸多原因,农民工权益被损害现象十分突出,实际上暴露了在该问题上法律失效、政府不作为,未能坚持以人为本这一最基本的保障原则。本文认为保障农民工权益是落实科学发展观以及实现社会主义和谐社会的题中应有之义,农民工权益保障应以人为本,并于文末提出保障农民工权益的几点对策。
