Construction of Legal System of China's Farmland Protection under the Coexistence of Multiple Objectives:Historical Logic,Practical Problems and Optimization Paths

[Objectives]To explore the evolution of the legal system of farmland protection and explore the rules and characteristics of policy development based on the theory and logic of institutional change since China's reform and opening up,reveal the problems and deep-seated reasons of its legislation,clarify the direction of farmland protection in the new period,and solve the"non-agricultural""non-grain"and ecological problems of farmland.[Methods]Literature analysis and inductive deduction methods were used.[Results]The evolution of the farmland protection legal system has gone through the process of"national consciousness-policy guidelines-institutional system",the change from"single subject to multiple subjects";change from the use of"one-way administrative means to coordinated use of administrative,economic and technical means".The practical problems of the farmland protection legal system are mainly due to the insufficient systematization of the farmland protection legal system itself,the generalization of quantity protection,the transformation of quality protection,and the absence of ecological protection.[Conclusions]It is recommended to improve the existing farmland protection legal system from the establishment of the Farmland Protection Law,the improvement of the farmland protection public participation mechanism and supervision mechanism,the establishment of the farmland quality construction and improvement system,the differentiated farmland occupation and supplementation balance system,and the ecological restoration system.

Unenumerated Rights Clauses and the System of Restriction on Fundamental Rights——Another Construction Plan for Article 51 of the Constitution of PRC

According to constitutional jurisprudence in China,Article 51 of the Constitution is an unenumerated restrictive clause.Such theoretical construction fails to justify the differentiated restrictions established in the Constitution and makes it difficult to explain the constitutional status of human dignity. Article 51 implies the possibility of other theoretical constructions. It is not an unenumerated restriction clause but an unenumerated rights clause. It aims to provide guarantees for general freedom of action not enumerated in the Constitution rather than restricting fundamental rights. The actual benefit of this kind of theoretical construction lies in that it can establish the basis of the constitutional text for general freedom of action and promote the people’s correct understanding of the model of restriction on fundamental rights established by the Constitution of PRC.

Study and Application of Health Care Measure in Tunnel Construction of Qinghai-Tibet Railway

In this paper we studied a key control project in QinghaiTibet Railway construction. The project included the oxygen supplying system, the ventilation and air changing system measure of tunnel environment, monitoring and comprehensive treatment on airborne dust and toxic and harmful gases, hygiene intervention with builders in Fenghuoshan Tunnel construction. In the worst sector of the whole Qinghai-Tibet Railway line, we acquired a good achievement of the lowest incidence rate of altitude disease. Hence the Fenghuoshan Tunnel was joined up in advance, which set up a new record for frozen soil tunnel construction at high altitudes. The application of health care measure for tunnel construction promised rapid results.

Discussion on the Designing Difficulties of Fenghoshan Tunnel on Qinghai-Tibet Railway

The major technical difficulties of Fenghuoshan Tunnel were caused by arctic alpine, high altitude and permafrost. Through analysis of the major technical problems of Fenghuoshan Tunnel, this paper explored the designing methods and ways of tunnels in arctic alpine climate, on high altitude and on permafrost regions, to offer reference for the projects of similar nature.

Permafrost in Qinghai Province:Characterization and impact on transportation construction

Through a long-term summary of highway construction in the permafrost regions of Qinghai Province, the formation conditions and distribution characteristics of permafrost and their impact on transportation construction are analyzed. Research achievements on the stability of highways and urgent technical problems in the transportation construction in permafrost regions are discussed, and new development directions of highway construction in permafrost regions of Qinghai Province are introduced to provide cold regions engineering researchers with valuable references.

Construction Management Innovation and Practice in Qinghai-Tibet Railway Project

The construction of the Qinghai-Tibet Railway is one of the significant decisions made by the CPC Central Committee and the State Council at the beginning of the new millennium, it is also the landmark project of the China’s Western Region Development campaign. The railway will become an economical, high-speed, high capacity, all-weather passageway, which will play an irreplaceable role in the areas it links, in terms of economic prosperity and social advancement, the implementation of the opening up policy, in strengthening unity of different ethnic groups, as well as the wellbeing of all the residents along the way. Since its commencement on June 29 th , 2001, the Golmud-Lhasa Section (G-L Section) of the Qinghai-Tibet railway has been advancing safely and smoothly, with high construction quality. Up to now, the main structures along the whole section are nearly completed, experimental projects in the post-station section are almost concluded (except signal works), tracks of 743 km have been laid. In 2005, the whole project entered its decisive stage. The goal of this year is: totally complete the sub-track works, nearly complete post-station works, completely link up the whole section. During the construction, three major obstacles must be removed, i.e., permafrost soil, deficient oxygen content in arctic alpine regions, and the fragile ecological environment. Up to now, remarkable achievement has been made in struggling with the three problems, and precious experience of constructing railway on permafrost plateau has been acquired. All the roadbeds, culverts and tunnels are of stable and reliable quality so far.

Development in theoretical study and practice of library legislation in China

One of the most outstanding characteristics of library legislation in China is that theoretical research and legislative practice are mutually reinforcing, making important issues and basic rules and regulations closely associated with legislation and the research focus. A national library law is currently being enacted while several local library legislations have already seen fruitful results. In the enactment of 'Regulations for the Protection of Information Network Dissemination Rights', the library professional participated for the first time in enacting a national copyright law, which led to unprecedented flourishing of library activities and copyright studies. The promulgation of another legal framework,'Government Information Disclosure Regulations' further advanced the research on related issues and pushed forward government information services in public libraries in the same way. The dynamic design method is essentially the evolving processes of various information, it consists of dynamic design and information construction. It is a new technology of increasing popularity. Because of the particularity and complexity of the Qinghai-Tibet Railway construction, the technology of the dynamic design and information constructing was used tentatively. Based on processes of Qinghai-Tibet Railway construction, this paper discussed and analysed the idea of dynamic design and applications. Meanwhile in allusion to arisen problems in design and construction, some principles and suggestions of reinforced measurements were put forward. Though the works of construction and design are being carried through, good results have been obtained.
