The Dynamic System Theory of Legal Protection for Personal Information Rights Infringement

The advent of the big data era has presented unprecedented challenges to remedies for personal information infringement in areas such as damage assessment,proof of causation,determination of illegality,fault assessment,and liability.Traditional tort law is unable to provide a robust response for these challenges,which severely hinders human rights protection in the digital society.The dynamic system theory represents a third path between fixed constitutive elements and general clauses.It both overcomes the rigidity of the“allor-nothing”legal effect evaluation mechanism of the“element-effect”model and avoids the uncertainty of the general clause model.It can effectively enhance the flexibility of the legal system in responding to social changes.In light of this,it is necessary to construct a dynamic foundational evaluation framework for personal information infringement under the guidance of the dynamic system theory.By relying on the dynamic interplay effect of various foundational evaluation elements,this framework can achieve a flexible evaluation of the constitutive elements of liability and the legal effects of liability for personal information infringement.Through this approach,the crisis of personal information infringement in the era of big data can be mitigated,and the realization of personal information rights as digital human rights can be promoted.

Dynamic Identity Based Authentication Protocol for Two-Server Architecture

Most of the password based authentication protocols make use of the single authentication server for user's authentication. User's verifier information stored on the single server is a main point of susceptibility and remains an attractive target for the attacker. On the other hand, multi-server architecture based authentication protocols make it difficult for the attacker to find out any significant authentication information related to the legitimate users. In 2009, Liao and Wang proposed a dynamic identity based remote user authentication protocol for multi-server environment. However, we found that Liao and Wang's protocol is susceptible to malicious server attack and malicious user attack. This paper presents a novel dynamic identity based authentication protocol for multi-server architecture using smart cards that resolves the aforementioned flaws, while keeping the merits of Liao and Wang's protocol. It uses two-server paradigm by imposing different levels of trust upon the two servers and the user's verifier information is distributed between these two servers known as the service provider server and the control server. The proposed protocol is practical and computational efficient because only nonce, one-way hash function and XOR operations are used in its implementation. It provides a secure method to change the user's password without the server's help. In e-commerce, the number of servers providing the services to the user is usually more than one and hence secure authentication protocols for multi-server environment are required.

China＇s mainstream human rights theory has undergone tremendous changes since the reform-and-opening scheme was kicked off in the early 1980s. ＂Human rights,＂ which used to be seen as a concept of capitalist ideology, is now an important part of the Chinese system of socialist values.

Resource Extraction in the Territories of Indigenous Peoples： The Quest for Cultural Rights

The rapid industrial growth amidst the resource-rich habitats of indigenous people results in an unprecedented and inescapable influence of the other. Most often, such interactions are exploitative for the indigenous communities. Besides this, the development induced displacement escalate the fear of loss of ＂cultural practices＂ among the indigenous peoples. The ＂official＂ argument often confines to the fact that the people are displaced with better facilities to a place few kilometres away from the original habitat. Such an argument forces to establish harmony between development and the displaced and ignores cultural rights and customary boundaries. In such cases, indigenous peoples negotiate for the protection of cultural rights with the corporate establishments and statutory bodies using a variety of means. This idea is explored in the context of the resistance movement organized by the indigenous Kondhs of Niyamgiri region of Odisha, India.

Thermal state of ice-rich soils on the Tommot-Yakutsk Railroad right-of-way

This paper summarizes the results of investigations carried out in the northern section of the Tommot-Yakutsk Railroad in eastern Siberia, underlain by ice-rich permafrost. The ongoing permafrost and geotechnical research program in support of railroad construction includes assessment of the ground thermal state on the right-of-way and adjacent areas based on long-term field observations using the method of terrain thermal physics. These studies focus on the upper permafrost within the depth of annual temperature variation. In undisturbed areas, inter-annual variability of the ground thermal state shows little response to recent climatic variations. However, forest clearing and surface disturbance during right-of-way construction cause an increase in permafrost temperature, deepening of the active layer, thaw settlement, and water accumulation along the embankment. The active layer is thickest along the sun-exposed left berm and is thinnest along the more shaded right berm. Measures to prevent thaw-related embankment problems are recommended.

Robust Control for Uncertain Nonlinear Feedback Systems Using Operator-based Right Coprime Factorization

The robust control issue for uncertain nonlinear system is discussed by using the method of right coprime factorization. As it is difficult to obtain the inverse of the right factor due to the high nonlinearity, the proving of the Bezout identity becomes troublesome. Therefore, two sufficient conditions are derived to manage this problem with the nonlinear feedback system as well as that with the uncertain nonlinear feedback system under the definition of Lipschitz norm. A simulation of temperature control is given to demonstrate the validity of the proposed method.

The Three Principles of Institutional Safeguards for Women's Participation in Legislation in China

The participation of women in legislation is an important aspect and means of safeguarding women’s rights.Feminist theory,based on criticism of both the“citizenship identity theory as rights”and the“citizenship identity theory as responsibilities,”proposes the“citizenship identity theory as subjectivity.”Observing the current practice of women’s participation in legislation in China,two institutional safeguard principles can be summarized:the“minimum proportion”and the“influence evaluation.”However,each of these principles has its inherent limitations.Therefore,it is necessary to supplement them with the principle of“subjective participation”in a reflective manner.This principle requires women to participate substantively in the legislative process as subjects,express women’s needs and demands,input women’s perspectives and experiences,and reconstruct the distribution of rights and responsibilities in the existing legislation.The three principles complement each other and work together to comprehensively constitute the institutional structure of women’s participation in legislation,thereby promoting the reproduction of corresponding action structures.

Study on Dynamic Model of Initial Emission Rights for Medical Sewage System

The chemical oxygen demand (COD) is selected as the index in this paper. The system dynamics method is used to analyze the emission right price of medical sewage, the boundary of the emission right price system is determined, and the system dynamics model of the initial emission right of medical sewage is constructed, in which the system is divided into water resources subsystem, population subsystem, economic subsystem and social subsystem. It is expected to expand the theory of the system modeling of the initial discharge right of medical sewage, and to provide the basis for the relevant decision of the environmental management authorities.

Structure analysis of levitation chassis of medium-to-low speed maglev vehicles based on left-right decoupling

Levitation chassis, as an extremely important component of maglev vehicles, provides functions of transmitting levitation force and steering force, and directly affects the safety performance of the vehicle. Based on the vertical dynamics model of the levitation chassis, kinetic equations of the model are established, and a simulation program is designed to analyze the structural decoupling function of the chassis, especially under the influence of elastic constraints between the left and right modules, which are exclusively owned by maglev vehicles. A finite element model of the levitation chassis based on left-right decoupling is constructed. Analysis results of the model show that the mechanical properties of the chassis tailored for the vehicle meet the design requirements, and the stiffness and strength is adequate to bear the weight of the whole vehicle.

The Sumame of Turkish Women： A Question of Identity？

After the foundation of Turkish Republic in1923, Turkish Civil Code which was codificated from Switzerland in 1926 was a new code for modem Turkey that aimed gender equality. Even if, there were some articles, contrary to the equality of men and women, they were ignored when they were compared with the reforms performed in favor of women. The surname of woman was one of the issues where there was gender discrimination. In the Civil Code of 1926, it was stated that the married woman must have taken her husband＇s surname after the official marriage and she had to use it through her marriage life. In 1997, there was an amendment in TCC Article 153 that the married woman had the right to register her maiden name in front of her husband＇s surname which was also accepted in the new TCC in Article 187 in 2002. As the equality of the spouses is neglected under Article 187, many women are trying to change the current situation, by lawsuits. In this article, the regulations about the surname, will be discussed under personality rights and identity, within the current legislation with some court decisions from the last years in favor of women.

SCATTERING OF CIRCULAR CAVITY IN RIGHT-ANGLE PLANAR SPACE TO STEADY SH-WAVE

Complex function method and multi-polar coordinate transformation technology are used here to study scattering of circular cavity in right-angle planar space to SH-wave with out-of-plane loading on the horizontal straight boundary. At first, Green function of right-angle planar space which has no circular cavity is constructed; then the scattering solution which satisfies the free stress conditions of the two right-angle boundaries with the circular cavity existing in the space is formulated. Therefore, the total displacement field can be constructed using overlapping principle. An infinite algebraic equations of unknown coefficients existing in the scattering solution field can be gained using multi-polar coordinate and the free stress condition at the boundary of the circular cavity. It can be solved by using limit items in the infinite series which can give a high computation precision. An example is given to illustrate the variations of the tangential stress at the boundary of the circular cavity due to different dimensionless wave numbers, the location of the circular cavity, the loading center and the distributing range of the out-of-plane loading. The results show the efficiency and effectiveness of the mothod introduced here.

Risk Analysis of Industrial Internet Identity System

The risks of the current identity system represented by Domain Name System(DNS)and Object Identifier(OID)are studied.According to the characteristics of the industrial Internet Identity(Ⅲ)system,four open ecosystem planes are divided,and a corresponding risk analysis view is established to analyze risks for various planes.This paper uses Isaiah Berlin’s definition of liberty to more generally express the concept of security as positive rights and negative rights.In the risk analysis view,the target system is modeled from four dimensions:stakeholders,framework,architecture,and capability delivery.At last,three defensive lines are proposed to establish the identity credit system.

Collective Dynamics for Network-Organized Identical Excitable Nodes

We investigate the collective dynamics of network-organized identical excitable nodes. We theoretically analyze the stability of the rest state and propose that there are two different transition paths： the stationary path and the oscillatory path. We find that, although the onset of collective dynamics strongly depend on the network topology, the local dynamics and how local nodes interact with each other decide the transition path and the involved bifurcation.

The Enlarged Moral Self

Constitutional Patriotism is a new form of identity. It addresses the national component of identity formations in order to transform them in light of universal human rights principles. In this article, I seek to strengthen this theory left underdeveloped by Habermas. To do so, I use the idea of moral development which Habermas borrowed from Kohlberg. I argue that Constitutional Patriotism is the missing link in Habermas＇s reading of Kohlberg. I complement Kohlberg＇s reading of moral consciousness with the psychoanalytic idea of individuation. Communication, language, and autonomy all fall into their places in this interdisciplinary puzzle of Constitutional Patriotism spanning over the cultural terrain. This article takes part of the broader project of Constitutional Patriotism here only focusing on the notion of the selfhood.
