Speedy economic growth and material wealth pursuit social context stimulate the idiom alteration behavior which enforces the pragmatism value orientation. Criminal law is the most repressive branch of legal system and therefore should be applied sparingly by the state. Its usefulness should be the protection of legal interests and minimal restriction of personal liberty. The lawmaker should seek the best way to achieve this utility with the choice of the most relevant legal interests and less repressive means before appealing to the criminal law. The legal interests protected by criminal law must be the most important ones for a social life in harmony and prohibited behaviors must be injurious or dangerous to those legal interests. The Rule of Law does not authorize criminal prohibitions without a minimum limit that allows citizens to behave according to their wishes, provided that does not harm the interests of other people. The present study examined the impact of aging on ethical decision-making in simulated critical driving scenarios.204 participants from North America,grouped into two age groups(18–30 years and 65 years and above),we...The present study examined the impact of aging on ethical decision-making in simulated critical driving scenarios.204 participants from North America,grouped into two age groups(18–30 years and 65 years and above),were asked to decide whether their simulated automated vehicle should stay in or change from the current lane in scenarios mimicking the Trolley Problem.Each participant viewed a video clip rendered by the driving simulator at Old Dominion University and pressed the space-bar if they decided to intervene in the control of the simulated automated vehicle in an online experiment.Bayesian hierarchical models were used to analyze participants’responses,response time,and acceptability of utilitarian ethical decision-making.The results showed significant pedestrian placement,age,and time-to-collision(TTC)effects on participants’ethical decisions.When pedestrians were in the right lane,participants were more likely to switch lanes,indicating a utilitarian approach prioritizing pedestrian safety.Younger participants were more likely to switch lanes in general compared to older participants.The results imply that older drivers can maintain their ability to respond to ethically fraught scenarios with their tendency to switch lanes more frequently than younger counterparts,even when the tasks interacting with an automated driving system.The current findings may inform the development of decision algorithms for intelligent and connected vehicles by considering potential ethical dilemmas faced by human drivers across different age groups.展开更多

This argument is shown to depend on assuming a life-driven account of human motivation, rather than a goods-driven account of human motivation. The life-driven account, according to which voluntary actions are ultimately motivated by the pursuit of a certain kind of life, is defended against the goods-driven account, according to which actions are motivated by the pursuit of goods the enjoyment of which can only be episodes in a human life. 文摘As the mainstream media describes Rodrigo Roa Duterte,the 16th President of the Republic of the Philippines,widespread generalizations emerged.He was the country's first Mindanaoan president and acquired popularity among Filipinos by working on platforms to reduce drug addiction,corruption,and criminality,and received 39 percent of the vote in the 2016 Presidential Election.Back on the year 2016,during the first Presidential Debate,Duterte had sworn that he will eliminate the extensive propagation of drugs in the country with his first six months of authority.With the advent of his presidential campaign,arises the issue on extra-judicial killings from his ruthless hunt for drug pushers and users which is highly criticized by the human rights devotees.This was the cornerstone of Duterte's presidential campaign and the crime solution hallmark of his 22-year period as mayor of Davao City.While the president's critics state that this is unjust and immoral,this paper argues that Duterte's radical politics is necessary in the lessening if not total eradication of criminality and corruption that the country had been experiencing.Using the lens of Deontological Ethics and Utilitarian Ethics,this paper tries to explain Duterte's radical politics and why it is needed in the contemporary Philippine society.

文摘The present study examined the impact of aging on ethical decision-making in simulated critical driving scenarios.204 participants from North America,grouped into two age groups(18–30 years and 65 years and above),were asked to decide whether their simulated automated vehicle should stay in or change from the current lane in scenarios mimicking the Trolley Problem.Each participant viewed a video clip rendered by the driving simulator at Old Dominion University and pressed the space-bar if they decided to intervene in the control of the simulated automated vehicle in an online experiment.Bayesian hierarchical models were used to analyze participants’responses,response time,and acceptability of utilitarian ethical decision-making.The results showed significant pedestrian placement,age,and time-to-collision(TTC)effects on participants’ethical decisions.When pedestrians were in the right lane,participants were more likely to switch lanes,indicating a utilitarian approach prioritizing pedestrian safety.Younger participants were more likely to switch lanes in general compared to older participants.The results imply that older drivers can maintain their ability to respond to ethically fraught scenarios with their tendency to switch lanes more frequently than younger counterparts,even when the tasks interacting with an automated driving system.The current findings may inform the development of decision algorithms for intelligent and connected vehicles by considering potential ethical dilemmas faced by human drivers across different age groups.
文摘The fact that industrial and commercial taxation in the Song dynasty greatly exceeded agricultural taxation was unprecedented in previous dynasties.This is mainly explained by the Song government’s financial and economic policy which was dominated by industrial and commercial taxation,made good use of the laws and characteristics of market relations and the commodity economy in business operations,actively stimulated consumption and was clearly utilitarian.Under this policy,the rulers,in pursuit of huge profits,used state power and mobilized various resources to implement a monopolies system and a commercial tax system,which,in turn,helped develop the commodity money economy,expanded the scale of market exchange and promoted the high degree of development of the commodity economy of the time.The financial and economic policy of the Song dynasty showed the unique advantages of the imperial state’s intervention in the economy.It was this that distinguished the Song dynasty from other dynasties in terms of the prosperity of the commodity and monetary economy.
文摘The paper considers the account of happiness given in Boethius's Consolations of Philosophy. This account claims that happiness requires security of possession, and argues from this requirement to the conclusion that worldly goods, which of their nature cannot be securely possessed, cannot provide happiness. This argument is shown to depend on assuming a life-driven account of human motivation, rather than a goods-driven account of human motivation. The life-driven account, according to which voluntary actions are ultimately motivated by the pursuit of a certain kind of life, is defended against the goods-driven account, according to which actions are motivated by the pursuit of goods the enjoyment of which can only be episodes in a human life. It is claimed that Boethius is right in holding a life-driven account, and that his account of happiness follows from it.
