On the Western Conception of Natural Law

Natural law is an important concept of the Westem political culture. The author makes a simple investigation into the various definitions of natural law, based on which he comes to the conclusion that natural law is a key concept of Western political culture; that it is a moral norm of politics as well as a product of rational thinking; and that its meaning has varied over time.

Relationship between the Three Laws of Dialectics of Nature and Agricultural Development

Based on the three laws of dialectics of nature-the law of unity of opposites, the law of mutual change of quality and the law of negation of negation, this paper analyzes the relationship between the three laws and agricultural development, and proposes making good use of the three laws to promote the better development of agriculture and realize agricultural modernization.

A tentative model for the explanation of B?th law using the order parameter of seismicity in natural time

Using the order parameter of seismicity defined in natural time, we suggest a simple model for the expla- nation of Bath law, according to which a mainshock differs in magnitude from its largest aftershock by approximately 1.2 regardless of the mainshock magnitude. In addition, the validity of Bath law is studied in the Global Centroid Moment Tensor catalogue by using two different aftershock definitions. It is found that the mean of this difference, when considering all the pairs mainshock-largest aftershock, does not markedly differ from 1.2 and the corresponding distributions do not depend on the mainshock＇s magnitude threshold in a statistically significant manner. Finally, the analysis of the cumulative distribution functions provides evidence in favour of the proposed model.

Laminar natural convection characteristics in an enclosure with heated hexagonal block for non-Newtonian power law fluids

This work illustrates the steady state, two dimensional natural convective flow and heat transfer features in square enclosure containing heated hexagonal block maintained either at constant wall temperature(CWT) or uniform heat flux(UHF) thermal conditions. Governing equations(mass, momentum and energy) are solved by using finite volume method(FVM) with 3rd order accurate QUICK discretization scheme and SIMPLE algorithm for range of field pertinent parameters such as, Grashof number(10~3≤ Gr ≤ 10~6), Prandtl number(1 ≤ Pr ≤ 100) and power law index(0.5 ≤ n ≤ 1.5). The analysis of momentum and heat transfer characteristics are delineated by evolution of streamlines, isotherms, variation of average Nusselt number value and Colburn factor for natural convection(j_(nH)). A remarkable change is observed on fluid flow and thermal distribution pattern in cavity for both thermal conditions. Nusselt number shows linear variation with Grashof and Prandtl numbers; while rate of heat transfer by convection decreases for power law index value. Higher heat transfer rate can be achieved by using uniform heat flux condition. A Nusselt number correlation is developed for possible utilization in engineering/scientific design purpose.

Power Law Exponents for Vertical Velocity Distributions in Natural Rivers

While log law is an equation theoretically derived for near-bed region, in most cases, power law has been researched by experimental methods. Thus, many consider it as an empirical equation and fixed power law exponents such as 1/6 and 1/7 are generally applied. However, exponent of power law is an index representing bed resistance related with relative roughness and furthermore influences the shapes of vertical velocity distribution. The purpose of this study is to investigate characteristics of vertical velocity distribution of the natural rivers by testing and optimizing previous methods used for determination of power law exponent with vertical velocity distribution data collected with ADCPs during the years of 2005 to 2009 from rivers in South Korea. Roughness coefficient has been calculated from the equation of Limerinos. And using theoretical and empirical formulae, and representing relationships between bed resistance and power law exponent, it has been evaluated whether the exponents suggested by these equations appropriately reproduce vertical velocity distribution of actual rivers. As a result, it has been confirmed that there is an increasing trend of power law exponent as bed resistance increases. Therefore, in order to correctly predict vertical velocity distribution in the natural rivers, it is necessary to use an exponent that reflects flow conditions at the field.

On the Characteristics of Classical Natural Law

Classical natural law still retains its deep transcendental roots, i.e. ancient Greek cosmology, although it is no longer based on theodicy. The oldest meaning of the universe(kosmos) is not nature, but order. Therefore, the universe is larger than nature. Cosmology, which takes a holistic approach to everything, is superior to reason or ontology, which underlies modern natural law and is essentially a mechanistic worldview. Classical natural law does not regard reason as the ultimate cause to avoid the disconnection of "form" from "substance," which is a disadvantage of modern thought resulting in a loss of regulative capacity. The eternal recurrence(ewige Wiederkehr) of natural law requires us to constantly revisit the idea of classical natural law in order to find a real footing for the salvation of reality.

Dowry System and Natural Law in Shakespeare

Dowry was an important even decisive factor of forming a marriage in Renaissance,which was illustrated in Shakespeare’s plays.“No dowry,no marriage”was a common social phenomenon in Europe.Dowry was essentially a way of the actualization of male power in the context of patriarchal society,and the dowry system in Renaissance provided a unique angle to observe the social and family relationships,and the conflict between marriage freedom of children and actualization of parental power at that time.Shakespeare’s arrangement of dowry and marriage shows his satire to the unreasonable existing law.Actually we can find his inclination for natural law and consistence with Pufendorf who believes that family is the primary form of society,and marriage is the most primitive form of socialization,which is the requirement of natural law.

Has Okun's Law Become Invalid in China?——Estimation of Potential GDP Growth Rates and Natural Rates of Unemployment Based on Dual Structure

This paper calculates the potential GDP growth rates and the natural rates of unemployment in China using the dual decomposition of the simple Ohm's law.The results show that every 1%increase in China's urban registered unemployment rate leads to a 1.98%drop of GDP,the potential growth rate of GDP of China is about 10%,and the average natural rate of unemployment is about 3.2%in China in the past three decades.The paper finds that Okun's law is still valid in China in the long run,but the Okun coefficient is about-3.79,overestimating the impact of the registered unemployment rate on GDP growth,and needs to be corrected based on China's dual economic structure.

The Natural Law of Transition of a Charged Particle into a Compound State under the Action of an Electroscalar Field

This article is the continuation of article [1] where the experimental facts of observation of the electroscalar radiation in the spectrum of the Sun have been presented [2]. This radiation comes into the world having a long wavelength, being longitudinal and extraordinarily penetrating. In accordance with the principle of least action, the Lagrangian of the electroscalar field and the tensor of energy-moment are determined using the variation the potential and coordinates. The equation of motion the charged particle in electroscalar field is determined and the energy of particle has the negative sign with respect to the mechanical energy of particle and the energy of electromagnetic field. So, this is decreasing the electrical potential of particle during the propagation. The electroscalar energy of charged particle and field’s force acting on the particle during their motion change the particle’s electrical status which, in its turn, may trigger the transition of the particle into a compound state during interaction with any object. Due to the continuity this process can lead the particle to the state which enters into a compound state with a negative energy for a different particle’s velocity. This state is the physical vacuum’s state. Analysis of the solar spectrum demonstrates that scattering and absorption of electroscalar wave go on the cavities of solids. The spreading out of electroscalar field obeys to the law of plane wave and the transfer the energy and information can occur in vacuum and any medium.

Structure changes and succession dynamic of the natural secondary forest after severe fire interference

The structure and dynamic succession law of natural secondary forest after severe fire interference in recent 20 years were studied by adopting the method of deducing time series from the spatial sequence of vegetation in Heihe region, Heilongjiang, China.Two typical and widely distributed forest types in the study area, namely forest type A and forest type B, were selected as study subjects.Forest type A is pure broadleaf forest or broadleaf mixed forest mainly composing of superior Betula platyphylla and Populus davidiana in the area with gradient <25°, while forest type B is pure forest or mixed forest composing of superior Quercus mongolica and Betula davurica in the area with gradient >25°.Species richness, vegetation coverage, important value, and similarity index of community in different layers(Herb, shrub, small tree, and arbor layers) were investigated and analyzed for the two typical forests.The results show that after fire interference, the species richness and coverage in each layer in forest type A were higher than that in forest type B.Both for forest type A and B, with elapse of post-fire years, the species richness and coverage of herbs and shrubs showed a decline tendency, while those of arbor layer present a rising tendency.Through comparison of the important values of species in each layer and analysis of community structure changes, the dynamic process of post-fire vegetation succession for forest type A and B was separately determined.Post-fire 80 years' succession tendency of forest type A is B.platyphylla and Larix gmelinii mixed forest.Its shrub layer is mainly composed of Corylus heterophylla and Vaccinium uliginosum, and herb layer is dominated by Carex tristachya, Athyrium multidentatum, and Pyrola incarnate;whereas, the post-fire 80 years' succession of forest type B is Q.mongolica and B.davurica mixed forest.Its shrub layer is mainly composed of lespedeza bicolar and corylus heterophylla and herb layer is dominated by Carex tristachya, Asparagus densiflorus, and Hemerocallis minor.

Acupuncture as a bioinformatics science and a proposal for the recognition of a new law of nature “Law of therapeutic neuromodulation”

Brain, an organ similar to a computer, is the ultimate director of the body1. This means that organs, tissues and cells are under its control and that these parts of the body do not control what happen to them. If the brain is functioning properly, we have health;and if it works wrongly a disease will show. Acting on the brain by neuromodulation, by means of acupuncture, homeopathy or even allopathic drugs can produce a therapeutic response. The purpose of this paper is to recognize this effect and propose a new Law of Cure which explains how several complementary and alternative medicine (CAM) systems work. In this theory, acupuncture works by stimulating peripheral sensory receptors and transmitting information to the brain which in turn will trigger a curative response to the affected organ. In this sense, acupuncture is an informatics system for a biological system, and therefore it could be considered part of the bioinformatics sciences, in the same idea that the brain is a living computer which has inputs and outputs and controls all process inside the body. In this paper we present the basis for this theory.

Sorption of Gadolinium (III) Ions by a Natural Clinoptilolite-Containing Tuff

The equilibrium and kinetics of sorption of gadolinium (III) ions from sulfate solutions by a natural clinoptilolite containing tuff are studied. It is shown that gadolinium is completely extracted from dilute solutions (0.002 M). The kinetic parameters of the sorption process are determined.

Human Rights Connotations and Its Legal Protection in the Harmonious Coexistence between Humans and Nature

Promoting the unity of human nature and sociality in practice is a fundamental path dependence for achieving people's well-rounded development.Within the context of harmonious coexistence between humans and nature,the practice of the unity of human nature and sociality is allowed to be truly implemented,and people's well-rounded development moves from possibility to reality.Strengthening the protection of human rights for people's well-rounded development in the harmonious coexistence between humans and nature not only requires the expansion of the connotations of environmental rights from“the right to a healthy environment”to“the right to a beautiful environment”,but also necessitates the formation of a collaborative framework between environmental rights and development rights.For legal responses to the expansion of the connotations of environmental rights,it is necessary to implement such expansions in environmental legislation,enhance the underlying principles,and make progress in the development of systematic environmental legislation simultaneously.Regarding the legal promotion of the synergy between environmental rights and development rights,it is essential to follow the guidance of the“Two Mountains Theory,”take the coordinated functions of environmental and traditional legal departments as the basis,and build a legal mechanism for the realization of the value of ecological products and services.

维系共和国:西塞罗的整体法方案

目睹罗马共和国末期的种种危机,西塞罗不仅实际游说斡旋于各政治势力之间,而且进行政治哲学写作,希望在理论上设计一套维系共和国的方案,其整体法思想便是方案之一。整体法由市民法、智者之法和自然法三部分构成,其中自然法引导智者之法,智者之法引导市民法,这是一个动态上升的过程。任何国家或民族的市民法都有可能在这个动态中接近自然正当,这可以挽救政治危机导致的法律堕落,把法律从政客们的工具箱中解救出来,成为约束官员的有力武器;并且,共和国疆域内广泛存在的千差万别的法律因为自然法的最高引领而具有了统一性,这极大地消解了因法律的差异而造成的民族或区域分裂。总之,西塞罗的整体法具有维系罗马共和国的作用。

自然资源资产有偿使用是生态文明体制的改革重点。从基本属性、资源利用和表现形式三个方面廓清自然资源资产的概念内涵是建构自然资源资产有偿使用制度的逻辑起点。在宏观层面,公权力规制失范与私权利保障失衡是阻滞自然资源资产实现有偿使用的主要原因。在实践层面,价值核算体系混乱、使用范围模糊、使用方式粗放是推动自然资源资产有偿使用走向法治化道路的现实动因。以法治维度构造自然资源资产有偿使用制度,应以“公权管制”与“私权自治”为中心,准确释明自然资源资产的法律概念;明确允许有偿使用的自然资源资产范围;建立自然资源资产收益共享机制;完善自然资源资产有偿使用的程序性规则,为维护国家所有者权益和建设美丽中国提供制度保障。
