“隔离”与“留置”在中小学的异化与回归

伴随国家监察体制改革,"留置"成为监察法规定的新措施。现阶段对"留置"措施的评价更多基于现象的法解释范畴,对"留置"措施的解释力体系构建尚不充分,也就容易因先入为主的批判思维而形成误读。国家设立&q... 伴随国家监察体制改革,"留置"成为监察法规定的新措施。现阶段对"留置"措施的评价更多基于现象的法解释范畴,对"留置"措施的解释力体系构建尚不充分,也就容易因先入为主的批判思维而形成误读。国家设立"留置"措施基于三方面考虑:一是根据腐败犯罪特点完善反腐败运行结构;二是在保证反腐败效度基础上维系政治秩序结构的稳定;三是在政治指令设限和单法授权格局下,调适程序法权威与反腐败权威在法律结构磨合中形成的紧张格局。这三个逻辑起点恰好与反腐败运行及其调查措施的法政治属性同构。"留置"作为国家推进法治反腐的重要措施,将在不同战略时期形成对"留置"的不同制度设计。"留置"措施不是对"两规"的机械替代,而是兼具政治属性与法律属性,国家将在后期逐渐增塑其法律属性。 展开更多

监察体制改革试点方案虽运行已近一年,但尚存在很多疑难问题,不论是理论上还是实践中,都还未得出确切结论。"违法—犯罪二元追诉机制"与"一元追诉机制"在追诉对象、程序启动标准、调查主体、调查程序、权利保障水... 监察体制改革试点方案虽运行已近一年,但尚存在很多疑难问题,不论是理论上还是实践中,都还未得出确切结论。"违法—犯罪二元追诉机制"与"一元追诉机制"在追诉对象、程序启动标准、调查主体、调查程序、权利保障水平上存在不同,在实践中也存在缺乏可操作性、减损侦查效率等问题。监察委员会的调查权是犯罪侦查权和违纪违法调查权的有机统一。"谈话"措施不同于讯问、询问,为避免化解刑事诉讼法防范非法取证的立法努力,应将"谈话"一律视为对其进行讯问;调取与扣押在调取对象、调取主体、调取过程、行为方式上有所不同,立法应当对调取措施进行程序正当化改造并将其与技术侦查相切割。监察委员会的留置措施与公安的留置具有一定的相似性,也是被作为侦查措施而适用的,但监察立法应对留置适用的实体条件、程序控制和相关救济做出严格管控。《监察法(草案)》中的相关内容,既有进步也存在不足。 展开更多

Indwelling catheter and conservative measures in the treatment of abdominal compartment syndrome in fulminant acute pancreatitis 被引量:14

AIM: To study the effect of combined indwelling catheter, hemofiltration, respiration support and traditional Chinese medicine (e.g. Dahuang) in treating abdominal compartment syndrome of fulminant acute pancreatitis. METHODS: Patients with fulminant acute pancreatitis were divided randomly into 2 groups of combined indwelling catheter celiac drainage and intra-abdominal pressure monitoring and routine conservative measures group (group 1) and control group (group 2). Routine non-operative conservative treatments including hemofiltration, respiration support, gastrointestinal TCM ablution were also applied in control group patients. Effectiveness of the two groups was observed, and APACHE Ⅱ scores were applied for analysis. RESULTS: On the second and fifth days after treatment, APACHE Ⅱ scores of group 1 and 2 patients were significantly different. Comparison of effectiveness (abdominalgia and burbulence relief time, hospitalization time) between groups 1 and 2 showed significant difference, as well as incidence rates of cysts formation. Mortality rates of groups 1 and 2 were 10.0% and 20.7%, respectively. For patients in group 1, celiac drainage quantity and intra-abdominal pressure, and hospitalization time were positively correlated (r = 0.552, 0.748, 0.923, P 〈 0.01) with APACHE Ⅱ scores. CONCLUSION: Combined indwelling catheter celiac drainage and intra-abdominal pressure monitoring, short veno-venous hemofiltration (SVVH), gastrointestinal TCM ablution, respiration support have preventive and treatment effects on abdominal compartment syndrome of fulminant acute pancreatitis. 展开更多

Capsule endoscopy is an easy and painless procedure permitting visualization of the entire small-bowel during its normal peristalsis. However, important problems exist concerning capsule retention in patients at risk of small bowel obstruction. The present report describes a young patient who had recurrent episodes of overt gastrointestinal bleeding of obscure origin, 18 years after small bowel resection in infancy for ileal atresia. Capsule endoscopy was performed, resulting in capsule retention in the distal small bowel. However, this event contributed to patient management by clearly identifying the site of obstruction and can be used to guide surgical intervention, where an anastomotic ulcer is identified. 展开更多

In the context of a room-and-pillar mining gob in Shanxi province in China,this paper numerically investigates the stress distribution and deformation rules of roadway surrounding rocks at various locations of residual coal pillars in room-and-pillar mining gobs using software FLAC3 D.It is found that the concentrated stress beneath coal pillars distributes in a shape of ellipse.A reasonable roadway layout is then proposed.In this design,it is indicated that roadways should be designed to avoid the supporting zones of pillars with increasing compression and take into account the roof falling and crushing in the upper gob.According to the surrounding rock deformation characteristics and mining roadway locations as well as the supporting principles of timely support,rock reinforcing,piecewise management and suiting local conditions,a new asymmetric shield supporting plan is proposed.The field surveying results show that this supporting plan can effectively control the roadway rock deformation,thus guarantee the safe and smooth construction of roadways. 展开更多

This study investigates the stability problem of gob-side entry retaining (GER) and backfilling wall which located under the key block B. Based on the combined research of elastic-plastic mechanics, structure mechanics and modern theory of mining-induced pressure, the caving characteristic and roof structure over the GER were analyzed, and the vertical force and the torque on retained entry roof were also derived as the position for the retained entry varies. On the basis of the specific geology in Huainan mining area, the results indicate that a relatively more stable position for retained entry neighbors the hinge point of block A and B, and it also located at a scope ranging from this point to the one-third length of block B in horizontal direction. As to appropriate position for backfilling wall, this study recommends partial- road-in backfilling method for GER. Field trial conducted at panel face 12418 of Xieqiao Mine demonstrates that the recommended width for original entry is 3.6 m and the preferred width proportion between original retained entry and original entry is 75 % or so whereas the avoidable one is 88 % or so. These findings provide qualitative references to the mines which share similar geology as what Huainan mining area characterized. 展开更多

There is recent trend of providing additional treatment of wastewater beyond tertiary level. The purpose is to refine water to a quality that is safe for reuse for unrestricted irrigation and other non potable uses. For this purpose, Kuwait has built and operated an advanced wastewater treatment plant with capacity of 500,000 m3·dl. This plant providing treatment beyond tertiary utilizes the process of Ultra Filtration (UF) and Reverse Osmosis (RO). The reject water of this unit contains high concentration of total nitrogen and total phosphate. Safe disposal of this water into the environment or possible reuse needs substantial reduction of these chemicals. In this study, a bench scale up-flow sludge blanket filtration system was investigated. The system operated with an average Hydraulic-Retention Time (HRT) of 19 h, whereas, sludge age varied within the range of 14 days to 16.5 days. The results show that the average removal efficiencies of the system for Biological Oxygen Demand (BOD), Chemical Oxygen Demand (COD) were over 86% and 82% respectively. The phosphate and nitrogen's average removal were found to be 50% and 45% respectively. 展开更多

One quarter scale experiment device of a typical L-shape architecture structure including a burning room and an adjacent hallway is established to carry out the research.The smoke characteristics at the sampling points below the ceiling of the burning compartment and the roof of the hallway are studied systematically to find out the effects of different ceilings on the local fire origin compartment and the smoke transportation to a remote area.A series of tests is reported and the smoke residence time,the concentration peak and the concentration build up rate are investigated as functions of the type of the ceiling.The smoke residence time,the most important factor concerning smoke toxicity,is described by a novel concept,wavelength,in this study.Furthermore,it is worth emphasizing that the PVC ceiling exhibits a phenomenon of frequent collapse during the fire developing period.The single heat action is conducted to judge the smoke and the heat effect on the fire risk. 展开更多
