Whether a new generation of human rights emerges in the digital age has sparked widespread debate.Academic understanding of digital technology remains confined to thinking about network technology and products, often overlooking the revolutionary nature of digital media.Digital media has the sweeping potential to unify all forms of media and reshape social life, giving rise to new demands for a new generation of human rights. The concept of digital human rights can be defined as the legitimate rights of human's infinitely extended personalities through digital media. Its core characteristic is its transcendency, where every person lives in a networked space that surpasses physical boundaries, nations, and individual personalities.Human rights are generally considered the foundation for basic constitutional rights, which,in turn, form the basis for legislative acts across various sectors. In recent years,China has enacted numerous laws in the digital domain to keep pace with the times, but due to the lack of guidance on digital human rights, these laws tend to be fragmented and disjointed. It is urgent to unify digital legislation at all levels on the basis of reshaping basic constitutional rights. Thus,it is essential to reshape the basic rights based on the concept and characteristics of digital human rights and streamline legislation at all levels under the unified guidance of basic rights. This can help establish a comprehensive digital human rights protection system that meets the demands of the modern era. 展开更多

In the digital age,the rise of digital human rights has become an important expansion in the field of human rights. When advancing digital prosecution strategies, prosecutorial agencies should pay greater attention to the protection of digital human rights. The fragile state of digital human rights and the unique position of prosecutorial agencies in human rights protection make it imperative that prosecutorial agencies place more emphasis on fulfilling their responsibilities in legal oversight to promote the protection of digital human rights.Currently, prosecutorial agencies have strengthened the protection of digital human rights through such measures as promoting legal oversight with big data, enhancing the handling of criminal cases involving citizens'digital human rights, expanding the scope of public interest litigation protecting digital human rights, and improving their roles in civil and administrative prosecution. However, there are still challenges related to the inadequacy of updating the mindset, the incompleteness of measures, and the lack of innovation in mechanisms and systems. Therefore, prosecutorial agencies should further align with the implementation of digital prosecution strategies, update their human rights protection concepts, intensify efforts to combat cybercrime, strengthen the protection of citizens'personal information through prosecution, enhance public interest protection of collective digital human rights through public interest litigation, and actively innovate prosecutorial work mechanisms and systems to bolster the protection of digital human rights. 展开更多

The human digital twin(HDT)emerges as a promising human-centric technology in Industry 5.0,but challenges remain in human modeling and simulation.Digital human modeling(DHM)provides solutions for modeling and simulating human physical and cognitive aspects to support ergonomic analysis. However,it has limitations in real-time data usage, personalized services, and timely interaction. The emerging HDT concept offers new possibilities by integrating multi-source data and artificial intelligence for continuous monitoring and assessment.Hence, this paper reviews the evolution from DHM to HDT and proposes a unified HDT framework from a human factors perspective. The framework comprises the physical twin, the virtual twin, and the linkage between these two.The virtual twin integrates human modeling and AI engines to enable model-data-hybrid-enabled simulation.HDT can potentially upgrade traditional ergonomic methods to intelligent services through real-time analysis, timely feedback, and bidirectional interactions. Finally, the future perspectives of HDT for industrial applications as well as technical and social challenges are discussed. In general, this study outlines a human factors perspective on HDT for the first time, which is useful for cross-disciplinary research and human factors innovation to enhance the development of HDT in industry. 展开更多

The discharge of nuclear-contaminated water containing radionuclides into the ocean by Japan will lead to its integration into the entire ecosystem through processes of circulation and biomagnification, eventually entering the human body via the food chain. This poses a substantial risk of irreversible damage to both the ecosystem and human health,a situation that will worsen with the ongoing discharge of such water. The respect and protection of human rights represent an international consensus, and safeguarding fundamental human rights is a substantial obligation that states must undertake in accordance with both international and domestic law.Since the Fukushima nuclear disaster,Japan has continuously violated its international legal obligations to protect human rights in several areas, including the resettlement of disaster victims, the reduction of nuclear radiation levels, and the handling of contaminated water.Such actions have compromised and will continue to compromise the basic human rights of not only its citizens but also those of people worldwide, including environmental rights, the right to life, development rights, and food rights. In the aftermath of the Fukushima meltdown, the public and workers involved in handling nuclear contaminants have been continually exposed to high radiation levels, endangering their rights to life, development, and health.Japan’s inadequate efforts in victim resettlement and environmental restoration have jeopardized the environmental and food rights of its citizens to live healthily and access food in an environment unaffected by nuclear radiation. The release of nuclear-contaminated water poses a risk of Japan’s nuclear pollution to the people of neighboring countries and the global population at large. The principle of human rights underpins the theory of a community with a shared future for humanity, and human rights are a crucial area of China’s active participation in United Nations affairs and global governance.By voicing concerns over Japan’s potential human rights violations globally,China demonstrates its role as a responsible major country. In response to Japan’s breach of legal obligations and human rights violations,China can adopt a reasoned and beneficial approach, including calling on the international community to hold Japan criminally accountable for crimes against humanity under the Rome Statute and advancing scholarly discussions on ecocide and crimes against the marine environment.Furthermore,China should persist in seeking advisory opinions from the International Court of Justice and strive for substantive accountability, utilizing the mechanisms of international human rights organizations to make its voice heard. 展开更多

The digital development rights in developing countries are based on establishing a new international economic order and ensuring equal participation in the digital globalization process to achieve people's well-rounded development in the digital society. The relationship between cross-border data flows and the realization of digital development rights in developing countries is quite complex.Currently, developing countries seek to safeguard their existing digital interests through unilateral regulation to protect data sovereignty and multilateral regulation for cross-border data cooperation. However, developing countries still have to face internal conflicts between national digital development rights and individual and corporate digital development rights during the process of realizing digital development rights. They also encounter external contradictions such as developed countries interfering with developing countries'data sovereignty, developed countries squeezing the policy space of developing countries through dominant rules, and developing countries having conflicts between domestic and international rules. This article argues that balancing openness and security on digital trade platforms is the optimal solution for developing countries to realize their digital development rights. The establishment of WTO digital trade rules should inherently reflect the fundamental demands of developing countries in cross-border data flows. At the same time, given China's dual role as a digital powerhouse and a developing country,it should actively promote the realization of digital development rights in developing countries. 展开更多

The movement known as“Breque dos Apps”was a social movement of a striker nature, which took place in Brazil in July 2020.Such movement was organized by workers which provided services to delivery apps(like iFood,Loggi,Uber Eats and Rappi). They demanded better working conditions and social protection measures, since they were out of the protection of the Brazilian legal system. The reason for this lies in the fact that there is a debate about the classification of these workers-the maximum expression of the gig economy-as employees under Brazilian legislation. As a result, and with the exponential growth in the use of these applications due to the Covid-19 pandemic, thousands of workers were left on the fringes of any social protection. This study aims to analyze the aforementioned movement and its demands within the paradigm of social rights, especially the ones regarding collective representation, which are guaranteed by the Brazilian Constitution. In terms of methodology, the content analysis method will be applied, considering that the established objective presupposes the study of theoretical and legal texts that allow the structuring of concepts applicable to the theme. The research technique to be adopted will be the analysis of indirect documentation, that is,literature review,to be carried out through bibliographic and documentary research, focused on literature and legal texts related to the topic. 展开更多

The rapid development of the digital economy has provided a new impetus for rural residents to extend their working hours.Based on the data collected by the China Labor-force Dynamics Survey(CLDS)in 2014,2016,and 2018,this paper measured the development level of the digital economy in China from the perspectives of internet development and digital financial inclusion, and tested the mechanisms of how the digital economy affected rural residents’working hours. The results showed that the digital economy extended rural residents’working hours by expanding information channels and enhancing human capital, and this mechanism was affected by heterogeneity in rural residents’educational background, age, and social capital.Building on these findings, this paper holds that to increase rural residents’income by extending their working hours and achieving common prosperity for all,it is necessary to expand the opportunities for rural residents to participate in skills training and promote their accumulation of human capital. 展开更多

With the increasing attention to the state and role of people in intelligent manufacturing, there is a strong demand for human-cyber-physical systems (HCPS) that focus on human-robot interaction. The existing intelligent manufacturing system cannot satisfy efcient human-robot collaborative work. However, unlike machines equipped with sensors, human characteristic information is difcult to be perceived and digitized instantly. In view of the high complexity and uncertainty of the human body, this paper proposes a framework for building a human digital twin (HDT) model based on multimodal data and expounds on the key technologies. Data acquisition system is built to dynamically acquire and update the body state data and physiological data of the human body and realize the digital expression of multi-source heterogeneous human body information. A bidirectional long short-term memory and convolutional neural network (BiLSTM-CNN) based network is devised to fuse multimodal human data and extract the spatiotemporal features, and the human locomotion mode identifcation is taken as an application case. A series of optimization experiments are carried out to improve the performance of the proposed BiLSTM-CNN-based network model. The proposed model is compared with traditional locomotion mode identifcation models. The experimental results proved the superiority of the HDT framework for human locomotion mode identifcation. 展开更多

In China, the main discourse on human rights can be classified into four categories:political discourse, policy discourse, institutional discourse, and academic discourse. These four categories show significant differences in terms of the context, content, mode of expression, characteristics, and functions of the discourse. They cannot be simply equated or interchangeable with one another. However, they also rely on,restrict, and promote each other, and under certain conditions, they can be transformed into one another. It is needed to prevent imbalances, mismatches in context, isolation, and inadequate translation among human rights discourses.Meanwhile,it is essential to promote balanced development among different discourses, where each discourse maintains its own boundaries, refers to one another, and undergoes accurate translation,in order to construct their healthy interrelationships.Exploring appropriate methods of translation between discourses is an important and worthwhile topic for research in Chinese human rights discourse. It holds significant practical significance and academic value in constructing the Chinese human rights discourse system. 展开更多

The development of theories on human rights with Chinese characteristics and China’s engagement in global human rights governance cannot be separated from attention to contemporary Western human rights theory. The debate between naturalistic and political conceptions of human rights has a long history, but discussions on the basic criteria for evaluating human rights theories have been insufficient. This article, focusing on the criterion of fidelity to practice, attempts to identify the development trajectory and direction of human rights theory. The universal claims of naturalistic human rights perspectives and the human rights catalog they propose have been criticized for deviating from practice. On the other hand, political conceptions of human rights, while emphasizing domestic human rights practices, have been criticized for their occasional nature and perceived loss of criticality. The broad-way practice theory seeks a third way that goes beyond the divide between these two perspectives. On the one hand, the theory itself faces limitations and the need for reshaping, while on the other hand, the traditional singular practice theory is also undergoing self-renewal.It can be said that the“internal critique”of contemporary Western human rights theory is already underway and will continue. 展开更多

Environmental personality interests based on human rights reflect the multiple values of ecological order, ecological justice, and ecological freedom, and are closely linked to the protection of the right to life and the right to health. They are also related to human dignity and the personal freedom of civil subjects and conform to formal and essential standards of personality rights, which should be included in the scope of personality rights for protection. The construction and application of environmental personality rights faces bottlenecks such as the partiality of subjects, limitation of objects, and hysteresis of responsibilities in the protection of environmental personality rights.Environmental personality rights are supposed to reflect the needs of the development of modern human rights. We should expand the scope of its connotative power and function based on the Green Principle of the Civil Code, and follow a networked, typified, and systematic path of protection,so as to manifest the people-centered philosophy of the Civil Code and the Environmental Protection Law. 展开更多

Traditional human rights theory tends to hold that human rights should be aimed at defending public authority and that the legal issue of human rights is a matter of public law. However, the development of human rights concepts and practices is not just confined to this.A textual search shows that the term“human rights”exists widely in China’s civil judicial documents.Among the 3,412 civil judicial documents we researched, the concept of“human rights”penetrates all kinds of disputes in lawsuits, ranging from property rights, contracts, labor, and torts to marital property, which is embedded in both the claims of the parties concerned and the reasoning of judges.Human rights have become the discourse and yardstick for understanding and evaluating social behavior. The widespread use of the term“human rights”in civil judicial documents reflects at least three concepts related to human rights:first, the rights to subsistence and development are the primary basic human rights;second, the judicial protection of human rights is a bottom-line guarantee;third, the protection of human rights aims to achieve equal rights.Today, judges quote the theory of human rights in judicial judgments from time to time, evidencing that human rights have a practical function in judicial adjudication activities, and in practice this is mainly manifested in declaring righteous values and strengthening arguments with the values and ideas related to human rights, using the provisions concerning human rights in the Constitution to interpret the constitutionality, and using the principles of human rights to interpret blurred rules and rank the importance of different rights. 展开更多

The inequality faced by the elderly in a digital society is the digital inequality caused by both public and private actions,as well as the societal inequality exacerbated by the digital inequality. The essence of this issue lies in the unequal social participation due to the expansion of digital space under digital inequality. The characteristics of the elderly, combined with their inherent human dignity, determine that the ultimate goal of protecting their right to equality in a digital society is not limited to equal digital rights alone.Instead,it aims to ensure that the elderly have equal opportunities for social participation in both digital and non-digital spaces by eliminating digital inequality and curbing the expansion of digital space. This ensures the autonomy of the elderly in the digital society.Accordingly, the State should implement two policies based on both prohibitive obligations that prevent direct infringements and protective obligations that safeguard the equal rights of the elderly against encroachments from private entities. The first policy,“Digital Integration”,empowers the elderly with digital skills and helps them actively integrate into the digital society. The second policy,“Digital Coexistence,”ensures that the elderly can equally participate in society even when they choose to abstain from digital technology. 展开更多
