China's legislation relating to islands categorizes the latter into inhabited and uninhabited ones.Between the two different types,only uninhabited islands can be acquired by those who aspire to be private island ...China's legislation relating to islands categorizes the latter into inhabited and uninhabited ones.Between the two different types,only uninhabited islands can be acquired by those who aspire to be private island owners.In an effort to promote the development and utilization of uninhabited islands in China,a succession of laws and regulations have been formulated,including the Law of the People's Republic of China on the Protection of Offshore Islands,and the Application and Approval Measures on the Development and Utilization of Uninhabited Islands,among others.As the only tropical province in China,Hainan province boasts a large number of uninhabited islands,many of which are desired by prospective island owners.In order to promote the development of uninhabited islands,the Application and Approval Measures on the Development and Utilization of Uninhabited Islands in Hainan Province had been promulgated.Based on a detailed introduction on the main contents of the Measures,it is found that the Measures has set an innovative example for its kind in terms of the real estate publicity system,the construction permit and acceptance systems,solutions to using the islands before the issue of Island Protection Law,and verification systems.Nevertheless,the actual implementation of the Measures still brings a host of challenges with it.These relate to aspects of the Measures such as supply regulation premised on regulatory equilibrium,spatial planning with"Multiple-plan Coordination",and coordination between regulations on sea areas and islands.This paper proposes to maximize efforts to refine and coordinate general planning,to innovate systems and procedures regarding the use of islands and to promote the development and utilization of uninhabited islands through protective development in line with international standards.展开更多

As a prominent theorist in the field of democracy studies, David Held, by integrating the principle of autonomy in the model of constitutional democracy with the principle of participation in the model of participatory democracy, introduces a novel composition named ＂cosmopolitan democracy＂ that is a conception of democratic legal relations. Held is the first man who seeks to investigate democracy separated from the ideological models in relation to general human rights and identifies main areas of power in human life. He considers totally seven sets of rights necessarily enabling people to enjoy a free and equal participation in setting their communities. These rights include： right to health, welfare rights, cultural rights, civil rights, economic rights, political rights, and the right to enjoy a peaceful livelihood. Held＇s ultimate desire is to realize ideals of cosmopolitan democracy model in the global sphere, beyond the lessons of the West and the East. Through rethinking the theoretical and practical frameworks of this theory in today＇s world, the current paper seeks to study its role in reproducing democratic realism so that it would prepare the ground for the global consensus far from the ideal models.展开更多

Now, invested with infinite executive-presidential power, coupled with having complete control of the military, cabinet, judiciary and legislative branches, enables Mr. Erdogan to pursue his ambition to be a “nuclea3： power leader” in the Sunni Islamic world. The scientific denialism in general and environmental science, in particular, will reach a whole new level of insanity in Turkey where any conceivable environmental democracy will be abolished. The new government will further change the education establishment in every level and implement its anti-science political doctrines in which logic is an enemy and scientific truth is a menace. The systems framework on which the Chinese rule of law relies is shaped by the socialist democratic system. Socialist consultative democracy, which responds to the core themes of the determinant of socialism, Party leadership, the democratic tradition of New China and native resources for constructing the rule of law, is an important resource for constructing the rule of law in China. In a constitutional system of＂ruling Party--political power--the people＂ that takes the sovereignty of the people as the logic of its starting point, consultative democracy plays the role of functional coupling. Popular sovereignty gains political legitimacy on the basis of multi- party cooperation and political consultation under the leadership of the CPC, thus translating the will of the ruling Party into the will of the state. Consultative democracy constitutes an essential process in national decision-making, affording a basis for the construction of the inherent logical sequence of ＂ruling Party--Consultative Conference--People＇s Congress.＂ The democratic supervision exercised by the Consultative Conference is an extension of political consultation; from it unfolds the systems framework of the rule of law in China.展开更多
