民间融资以其灵活、多样性的方式在很大程度上缓解了社会资金供求的紧张关系,然而,司法实践中因为非法吸收公众存款罪刑事立法规制范围宽泛化和司法认定的不合理,导致该罪在行政和司法领域双重扩张,进而将大量民间融资行为作为非法吸收... 民间融资以其灵活、多样性的方式在很大程度上缓解了社会资金供求的紧张关系,然而,司法实践中因为非法吸收公众存款罪刑事立法规制范围宽泛化和司法认定的不合理,导致该罪在行政和司法领域双重扩张,进而将大量民间融资行为作为非法吸收公众存款罪处理。对此,刑事政策层面应当积极推进金融制度的革新和社会政策的跟进;刑事立法层面应当以非法融资行为对国家金融秩序和出资人利益的侵害为实质标准,审慎划定该罪犯罪圈;刑事司法层面应当合理界定"非法"的内涵与"公众"的范围。实现从刑事政策、刑事立法和刑事司法的三维视角合理限缩非法吸收公众存款罪规制民间融资的范围与限度,避免刑法过度干预。 展开更多

New algorithm for solving 3D incompressible viscous equations based on projection method

A new algorithm based on the projection method with the implicit finite difference technique was established to calculate the velocity fields and pressure.The calculation region can be divided into different regions according to Reynolds number.In the far-wall region,the thermal melt flow was calculated as Newtonian flow.In the near-wall region,the thermal melt flow was calculated as non-Newtonian flow.It was proved that the new algorithm based on the projection method with the implicit technique was correct through nonparametric statistics method and experiment.The simulation results show that the new algorithm based on the projection method with the implicit technique calculates more quickly than the solution algorithm-volume of fluid method using the explicit difference method. 展开更多

Due to the complexity of compressible flows,nonlinear hydrodynamic stability theories in supersonic boundary layers are not sufficient.In order to reveal the nonlinear interaction mechanisms of the rapidly amplified 3-D disturbances in supersonic boundary layers at high Mach numbers,the nonlinear evolutions of different disturbances in flat-plate boundary layers at Mach number 4.5,6 and 8 are analyzed by numerical simulations.It can be concluded that the 3-D disturbances are amplified rapidly when the amplitude of the 2-D disturbance reaches a certain level.The most rapidly amplified 3-D disturbances are Klebanoff type(K-type)disturbances which have the same frequency as the 2-D disturbance.Among these K-type 3-D disturbances,the disturbances located at the junction of upper branch and lower branch of the neutral curve are amplified higher.Through analyzing the relationship between the amplification rate and the spanwise wavenumber of the 3-D disturbances at different evolution stages,the mechanism of the spanwise wavenumber selectivity of K-type 3-D disturbances in the presence of a finite amplitude 2-D disturbance is explained. 展开更多
