“罪”“责”相异——清末“杨月楼案”的差异性归罪现象分析

发生于清末同治、光绪年间的"杨月楼案",由于当事人特殊的社会身份和《申报》等媒体持续的宣传报道,由一桩普通的伦理婚姻案件到被当时的民众所广为熟知,而后被最高当权者直接改变审理结果。该案的发生及其审理结果反映了当... 发生于清末同治、光绪年间的"杨月楼案",由于当事人特殊的社会身份和《申报》等媒体持续的宣传报道,由一桩普通的伦理婚姻案件到被当时的民众所广为熟知,而后被最高当权者直接改变审理结果。该案的发生及其审理结果反映了当时传统的等级礼教观念和旧式的律例条文已经无法在具体司法活动中实现"定纷止争"的社会功用。通过对"杨月楼案"整个过程的梳理分析可以发现,原本双方简单的良贱成婚行为,到最后却被认定为杨月楼个人单方在案中犯有诱拐妇女罪的行为,其中的罪名与责任之间的互异现象,即主观审断的罪名和客观责任的承担之间并不相符,实际上是由于审理者司法视角的局限性及其对案件信息进行了错误解读造成的。 展开更多

In psychology, the concept of interpretation has been namely associated to the subjectivist paradigm underpinning qualitative approaches, rather than the objectivist paradigm charactefising quantitative research. In this article, we challenge this belief by showing how interpretation concerns psychology as a whole. To do this, the authors will first consider some dominant tendencies characterising the psychological field in general, such as the "empiricist illusion" and the "trap of scientism" (Vygotsky 1999). Moreover, they will introduce the cultural perspective in psychology, pertinent to deconstruct several assumptions regarding research within the discipline. Stemming from this approach, "indirect methods" will be presented with regard to their potential to analyse psychological phenomena both qualitatively and scientifically. They will conclude by describing a set of principles that can be implemented when doing qualitative research as to ensure the quality and the adequacy of interpretation. 展开更多
