代理与代表是两种完全不同的技术与制度。在法人代表问题上 ,一直存在着将其处理为代理或代表的争论。比较来看 ,代表说更具有科学性与优越性。法人代表制是法人制度的重要组成部分 ,而在我国尚未形成系统性的规范 ,有待在精心设计中进一步得到健全与发展 。

一、问题的提出改党委领导下的所长负责制(简称“原模式”)为所长负责制(简称“现模式”),是我国科技体制改革的重要组成部分,但是,原模式是集体负责制,现模式是个人负责制,两者的优缺点在许多方面正好相反。因此,如何吸收集体负责制的优点,克服个人负责制的某些弊端,以补充完善现模式,是一个颇有研究价值的课题。个人负责制的鲜明优点是事权统一、责任明确、指挥灵活、效率高、易保密。

A Master-Slave Blockchain Paradigm and Application in Digital Rights Management

Upon flaws of current blockchain platforms of heavyweight, large capacity of ledger, and time-consuming of synchronization of data, in this paper, we proposed a new paradigm of master-slave blockchain scheme(MSB) for pervasive computing that suitable for general PC, mobile device such as smart phones or PADs to participants in the working of mining and verification, in which we separated traditional blockchain model in 2 layer defined as master node layer and a series of slavery agents layer, then we proposed 2 approaches for partially computing model(PCM) and non-computing of model(NCM) in the MSB blockchain, Finally large amounts of simulations manifest the proposed master-slave blockchain scheme is feasible, extendible and suitable for pervasive computing especially in the 5 G generation environment, and can apply in the DRM-related applications.

Correlation of serum leptin levels with anthropometric and metabolic parameters and biochemical liver function in Chinese patients with chronic hepatitis C virus infection

AIM: To determine serum leptin levels and investigate their correlations with anthropometric and metabolic parameters and biochemical liver function in patients with chronic hepatitis C virus (HCV) infection and their potential clinical implications.METHODS: Forty-two chronic HCV-infected patients without anti-viral treatment were enrolled in this study, 30 patients had chronic hepatitis C, 10 had cirrhosis, and 2 had hepatocellular carcinoma (HCC). Thirty age- and sex-matched healthy individuals served as controls. Serum leptin levels were determined by ELISA. The biochemical liver function and serum lipids were determined at the same time. The height and body weight of patients and controls were measured, and body mass index (BMI) and body fat were calculated simultaneously. The correlations of serum leptin levels with anthropometric and metabolic parameters and biochemical liver function were assessed statistically.RESULTS: The mean of serum leptin levels in patients with chronic hepatitis C, HCV-associated cirrhosis, HCVassociated HCC and control groups was (6.13±3.94),(5.25±4.21), (4.17±0.28), and (3.59±3.44) ng/mL, respectively. The serum leptin level in patients with chronic hepatitis C was significantly higher than that in controls. The serum leptin levels between cirrhotic patients and controls and between male and female cirrhotic patients had no significant difference. Serum leptin levels were positively-correlated with body fat, BMI, and apolipoprotein B (Apo B) in patients with chronic HCV infection. The serum alanine aminotransferase (ALT) levels were closelycorrelated with BMI in patients with chronic hepatitis C. CONCLUSION: HCV infection interferes with fat and lipid metabolism in patients with chronic HCV infection and leptin may play a role in hepatosteatosis.

Metabolic Control and Growth Regulation in the Regenerating Human Liver Measured in Vivo by 31—phosophorus Magnetic Resonance Spectroscopy

Objectives Partial hepatectomy induces a rapid transformation within the remnant liver, prompting a wave of hepatocyte mitosis which abates when the lost cell mass has been recovered. The mechanism of co-ordinated control of metabolism and maintenance of function during this period of dynamic change is incompletely understood. Furthermore, the biochemical basis of growth regulation in the regenerating liver has not been well defined. We have studied human liver regeneration using in vivo 31-phosphorus magnetic resonance spectroscopy (31 P MRS). This non-invasive technique allows assay of high-energy phosphate compounds and also of phospholipid metabolites thought to be involved in cellular renewal processes.Methods Five patients undergoing liver resection were studied. Hepatic metabolism was evaluated using 31P MRS before surgery and on postoperative days 2,4,6 and 14. Estimation of liver volume by magnetic resonance imaging and blood sampling for biochemistry were performed at the same time points.Results We found that the regenerative response following loss of liver parenchyma produced a reversible decline in energy state which necessitated compensatory adjustments in liver synthetic and excretory (unctions. Volume regain was associated with alterations in phospholipid metabolism, which normalized when the hepatic growth spurt was completed.Conclusion These observations indicate that modulation of hepatocyte energy economy is necessary for the integrated recovery of liver cell mass and function. We propose that deficient hepatic energy production may explain the mechanism of liver failure after hepatectomy, and suggest that in vivo measurement of liver metabolism may provide a rational basis for the development and evaluation of hepatic support strategies.

Pleistocene Birds of Gruta da Furninha （Peniche-Portugal）： A Paleontological and Paleoenvironmental Aproach

The cave-site of Gruta da Furninha is a coastal karstic cavity. In the late 19th century, excavation of the sedimentary infill of the cave allowed the identification of two lithostratigraphic units： a Holocene one dominated by sands, containing human bones and a Neolithic industry; and a Late Pleistocene one, containing a diverse set of fossils set and Paleolithic artifacts. This study mainly focuses on taphonomic and palaeoenvironmental data concerning the Pleistocene bird bones that were collected from six layers （at 11 m and 6.7 m asl）. A main result of this study was the discovery of a left humerus fragment, with osteological features of the Alcidae family; from comparison with upper arms of distinct species of this family, it was concluded that this fossil belongs to Penguin impennis. The Pleistocene birds of the Furninha cave were also compared with the avifauna that currently occurs in the region of Peniche peninsula and a climate and environmental interpretation of the Pleistocene fossiliferous set is provided.

Models of Presence and Loss of Transcendence in History

The article seeks to elucidate the status of transcendence in the historiography of secularization through the perspective of collective memory. It discusses two typological models dealing with the basic metaphysical problem concerned with the presence and meaning of transcendence in real human existence. According to the first, the historical reality of secularization causes a break from the collective memory whose roots are in religion. In contrast, the second model considers that despite the deep transformations in the status of religion in a reality of secularization, an experience of historical continuity may also occur there. These models denote the two poles in the argument about the meaning and value of history for modem people. The article suggests a phenomenological analysis of the two models and criticizes their deficiencies. Finally, the ＂tension model＂ is outlined as a third alternative that aims at overcoming the binary situation created by the first two in favor of a perspective that necessitates and contains both immanence and transcendence.

Mass Human Migration and the Urban Heat Island during the Chinese New Year Holiday: A Case Study in Harbin City, Northeast China

Many Chinese people leave big cities for family reunions during the Chinese New Year （CNY）, which is the most important public holiday in China. However, how modem mass human migration during the CNY holiday affects the urban heat island （UHI） is still un- known. Here, the authors investigate the role of modem human migration for the UHI effects during the CNY holiday for the period of 1992-2006 in Harbin City, Northeast China. The results show that during the CNY week, the UHI effects expressed as daily mean, maxi- mum, and minimum temperature differences between urban and rural stations averaged over the period of 1992-2006 are 0.65℃ （43%）, 0.31℃ （48%）, and 1.14℃ （71%） lower than during the background period （four weeks before and four weeks after the CNY week）, re- spectively. Our findings identify previously unknown impacts of modem mass human migration on the UHI effects based on a case study in Harbin City.

Liver is a primary site of ethanol metabolism, which makes this organ susceptible to alcohol-induced damage. Alcoholic liver disease （ALD） has many manifestations and complicated pathogenesis. In this Topic Highlight, we included the key reviews that characterize new findings about the mechanisms of ALD development and might be of strong interest for clinicians and researchers involved in liver alcohol studies.

Inheritance of Boron Efficiency in Oilseed Rape

Field experiments were conducted to study the inheritance of boron efficiency in oilseed rape (Brassica napus L.) by evaluating the boron (B) efficiency coefficient (BEC, the ratio of the seed yield at below the critical boron level to that at the boron-sufficient level) with 657 F2:3 lines of a population derived from a cross between a B-efficient cultivar, Qingyou 10, and a B-inefficient cultivar, Bakow. Qingyou 10 had high BEC as well as high seed yield at low available soil B. On the contrary, Bakow produced low seed yield at low B status. Boron deficiency decreased the seed yield of the F2:3 lines to different extents and the distribution of BEC of the population showed a bimodal pattern. When the 657 F2:3 lines were grouped into B-efficient lines and B-inefficient lines according to their BEC, the ratio of B-efficient lines to B-inefficient lines fitted the expected ratio (3:1), indicating that one major gene controlled the B-efficiency trait. 127 F2:3 lines selected from the population at random, with distribution of BEC similar to that of the overall population, were used to identify the target region for fine mapping of the boron efficiency gene.

Representing the fundamental eore of China's political fabric, the system of people's congresses ensures that the people are the mas- ters of the country. State power is exercised by the people through the National People's Congress (NPC) and local people's congresses. The preeminence of the NPC as the highest organ of state power is enshrined in China's Constitution. Heads of exeeutive, judicial and procuratorial organs are elected or appointed by people's congress- es, responsible to them and subject to their oversight. The decision- making on major public affairs is within the purview of people's congresses. The executive branch is responsible for implementing the laws, resolutions and decisions adopted by people's congresses.
