论侵占代管物罪

将代为保管的他人财物非法占为已有、数额较大、拒不退还的构成侵占代管物罪。“代管物”不仅仅指保管合同的标的物,而且也泛指受财物所有人、管理人的委托,或者依照法律规定,或者因为合同的约定等合法先行占有他人的财物,如租赁物、借用物、抵押物、加工物等。对代管物的范围作广义的理解符合民转刑的刑事立法精神,有利于同这类犯罪作有效的斗争,对于今后的司法实践有十分重要的意义。

The Study on Induction and Proliferation of Tube Bulbs in Lilium brownii

With different parts of bulb scale as explants, the proliferation method of Guizhou Lilium brownii were studied with 3% sodium hypochlorite and MS medium with different concentrations of hormones. The results show that it is feasible to disinfect the bulbs of Lilium brownii with 3% sodium hypoehlorite, moreover, the sodium hypochlorite is very cheap and harmless to researchers, experimental materials and environment. MS ＋ NAA 0.3 mg/L ＋ 6-BA 1.5 mg/L is optimum for the induction of bulbs and, the basal part of Lilium brownie is the optimum explants. After culture for 25 d on the same medium, the tube bulbs could be obtained with the characteristics of high propagation coefficient, strong and new roots. The survival rate is over 90% for transplantation of tube bulbs with diameter between 1-2cm. The method developed in the present study can proliferate abundant Lilium brownii seedling in short time.

C-reactive protein,procalcitonin,interleukin-6,vascular endothelial growth factor and oxidative metabolites in diagnosis of infection and staging in patients with gastric cancer

AIM:The current study was to determine the serum/pLasma levels of VEGF,IL-6,malondialdehyde (MDA),nitric oxide (NO),PCT and CRP in gastric carcinoma and correlation with the stages of the disease and accompanying infection. METHODS:We examined the levels of serum VEGF,IL-6, PCT,CRP and plasma MDA,NO in 42 preoperative gastric cancer patients and 23 healthy subjects.There were infection anamneses that had no definite origin in 19 cancer patients. RESULTS:The VEGF levels (mean±SD; pg/mL) were 478.05±178.29 and 473.85±131.24 in gastric cancer patients with and without infection,respectively,and these values were not significantly different (P>0.05).The levels of VEGF, CRP,PCT,It-6,MDA and NO in cancer patients were significantly higher than those in healthy controls and the levels of CRP,PCT,It-6,MDA and NO were statistically increased in infection group when compared with non- infection group (P<0.001). CONCLUSION:Although serum VEGF concentrations were increased in gastric cancer,this increase might not be related to infection.CRP,PCT,IL-6,MDA and NO have obvious drawbacks in the diagnosis of infections in cancer patients. These markers may not help to identify infections in the primary evaluation of cancer patients and hence to avoid unnecessary antibiotic treatments as well as hospitalization. According to the results of this study,IL-6,MDA,NO and especially VEGF can be used as useful parameters to diagnose and grade gastric cancer.

Caring for Unclean Animals in Ancient Israel： An Ecological Perspective

In view of the biblical kosher law of clean and unclean animals, the question of whether unclean animals could be reared or not in Ancient Israel becomes an ecological concern （Lev. 7：21; 11：26） for religious bodies today who still consider certain animals as unclean. A theological study of the law in the Pentateuch suggests that, in Ancient Israel, unclean animals were well catered for. Physical contact with live unclean animals did not render one unclean. Rather, uncleanness could be acquired through the touching of the carcass of clean or unclean animals （11：24-28, 38-39）. As part of their stewardship ordained by God （Gen. 1：26）, the people of Israel touched and reared/cared for unclean animals. Amongst other things, analysis of Gen. 1：26, in the Hebrew text, indicates that the primary purpose of human creation, as cosmic stewards over all creatures （including unclean animals）, is underlined. Hence, contemporary religious bodies, who still consider certain animals as unclean, should have an unfeigned care and positive attitude towards all unclean animals.

Construction of new deepwater terminal is the best usage of land resources and can strengthen the status of Shanghai as an international shipping center,thus support the preparation and strategic decision of future urban development of Shanghai.

A Clinical Investigation on Garlicin Injectio for Treatment of Unstable Angina Pectoris and Its Actions on Plasma Endothelin and Blood Sugar Levels

To investigate the therapeutic effects and mechanisms of garlicin for treatment of unstable angina pectoris (UAP), garlicin injectio was intravenously dripped 60 mg/day in 34 cases for 10 days. Nitroglycerine was used in 21 cases of the control group. The results showed that the total effective rates in improving symptoms and electrocardiogram after garlicin treatment were respectively 82% and 62%, and that the plasma endothelin and blood sugar levels were markedly lowered in cases with hyperglycemia.

Perspectives of Using L-Tryptophan for Improving Productivity of Agricultural Crops: A Review

Plant growth regulators are biologically active signaling molecules that regulate a number of plant physiological processes. Auxin(indole-3-acetic acid) is an important plant growth regulator and is synthesized within plant tissues through L-tryptophan(L-TRP)-dependent and-independent pathways. It has been found that plants respond to exogenously applied L-TRP due to insufficient endogenous auxin biosynthesis. The exogenous application of L-TRP is highly significant for normal plant growth and development.L-tryptophan is applied through foliar spray, seed priming, and soil application. Soil-applied L-TRP is either directly taken up by plants or metabolized to auxin by soil microbiota and then absorbed by plant roots. Similarly, foliar spray and seed priming with L-TRP stimulates auxin synthesis within plants and improves the growth and productivity of agricultural crops. Furthermore, L-TRP contains approximately 14% nitrogen(N) in its composition, which is released upon its metabolism within a plant or in the rhizosphere and plays a role in enhancing crop productivity. This review deals with assessing crop responses under the exogenous application of L-TRP in normal and stressed environments, mode of action of L-TRP, advantages of using L-TRP over other auxin precursors, and role of the simultaneous use of L-TRP and auxin-producing microbes in improving the productivity of agricultural crops. To the best of our knowledge, this is the first review reporting the importance of the use of L-TRP in agriculture.
