论公共行政体

我国现有行政主体概念存在诸多缺陷,在公共行政改革的冲击下,更加明显。在行政主体概念的外延已经发生嬗变的情况下,应该把现有行政主体分为行政主体与公共行政体。公共行政体只是指在公共行政组织体系中能够代表行政主体依法独立行使公共行政职权,并对其公共行政行为以担当行政争议当事方的方式,承担形式法律责任的组织。

行政主体概念的缺陷与完善刍议

我国现有行政主体概念存在诸多缺陷,难以与时俱进地反映公共行政社会化、行政权力分化与行政主体多元化的冲击与要求。文章借鉴西方国家的行政主体理论,结合我国实际将现有行政主体概念一分为二,称为行政主体与公共行政体,以期克服现有行政主体概念的缺陷,拓展行政法学研究的新视野。
