公物法视域下国家文化公园的法治化运行

行政法上的公物,是实现行政目的的“物的手段”,高校体育设施是以教育目的为主、社会公益性为辅的公物。不同地区、城乡、学校类别之间体育设施的配置和利用状况存在差异,导致体育设施向社会开放的条件有所不同。法律、法规有关学校体... 行政法上的公物,是实现行政目的的“物的手段”,高校体育设施是以教育目的为主、社会公益性为辅的公物。不同地区、城乡、学校类别之间体育设施的配置和利用状况存在差异,导致体育设施向社会开放的条件有所不同。法律、法规有关学校体育设施向社会开放的规定,是通过对特定行为模式的肯定和倡导的“鼓励性规定”来发挥指引作用,“鼓励性规定”在规范结构上缺乏相应的法律后果,难以作为公民主张权利和司法裁判的依据,需要具体认识其规范效力。“鼓励性规定”一方面为高校设定了努力向社会开放体育设施的积极义务,另一方面要求政府部门负责消除学校开放体育设施的各项障碍和隐患,完善高校体育设施社会开放的规范体系、管理体制、绩效评价体系和风险分担机制,逐步提高学校体育设施向社会开放的水平。 展开更多

Improvements on environmental DNA extraction and purification procedures for matagenomic analysis

Our previously described environmental DNA extraction method has been widely used in environmental microbial community analysis. However, residual humic substances may remain with obtained environmental DNA, which interferes downstream molecular analyses. To remedy this situation, two DNA extraction buffers (PIPES and Tris-HCl) and four purification strategies including our new modified low melting point gel purification method and three commercial kits from QIAEX, Omega and Promega were evaluated with diverse soil samples. The PIPES buffer (pH 6.5) is found to be more effective for removing the humic substances, but it leads to lower DNA yield and causes more severe DNA shearing than using the Tris-HC1 buffer (pH 8.0). Gel purification and the Promega purification kit achieve much higher DNA recoveries than QIAEX or Omega kit, and higher purity of DNA is obtained by gel purification than by the Promega kit with both DNA extraction buffers mentioned above. Considering all results together, two alternative methods for DNA extraction and purification are proposed: one uses Tris-HCl buffer extraction and gel purification as the primary approach when the amount of soil or biomass is not a major concern, and the other uses PIPES buffer extraction and the Promega kit purification when severe DNA shearing and/or limited biomass occurs. Purified DNA samples by both methods are amenable for use as templates for whole community genome amplifications and PCR amplifications of bacterial 16S rRNA genes. It is demonstrated that these two alternative methods could be applied to a wide variety of environmental samples. 展开更多

Property investment in Malaysia is increasingly popular among local and foreign investors. The strong support by the government through the relaxation and lifting of certain restrictions and regulations on property ownerships, have attracted investments in the Malaysian property market. This research studies the factors affecting the performance of 36 property firms listed on the Main Board of Bursa Malaysia from 2003 to 2007. This research employed ordinary least squares (OLS) method to represent all the variables comprising stock performance, return on assets (ROA), return on equity (ROE), debt ratio (DR), net profit margin (NPM), effective tax rate (ETR), earnings per share (EPS), and price earning (PE) ratio. Results show that ROA, ROE, and EPS have strong significant relationships with the property stock performance. Although it is a small sample size, some relevant changes and modifications can be included in future studies to obtain better results. 展开更多

The Contingent Valuation Method for Thessaloniki's Aesthetic Pollution in Greece

The purpose of this study is to provide an evaluation of the possible criteria used by the people of Thessaloniki for the evaluation of public goods and the investigation of the benefits of the conservation and restoration of city structures affected by carbon monoxide. These benefits are expressed in monetary units by using the CVM (Contingent Valuation Method). The maintenance of the urban environment often entails excessive costs paid by the people through taxation. A city free of aesthetic pollution results in an increase in tourism. A portion of taxation paid by the citizens is allocated to cleaning the city. An increase in tourism provides the government with additional revenue through VAT (Value Added Taxes). The main findings show that in a large proportion, 28% of the interviewees are willing to pay, but those that are willing to pay significant amounts tend to prefer mild interventions to the buildings, while those (42%) that agree with minimal to null amount demand radical intervention. The latter group, also, considers any contribution of theirs to restoration as unfair, judging that this expenditure should be covered exclusively by the State. Last but not least, from a sociopsychological point of view, this attitude could be attributed to extreme personalities which tend to prefer more holistic and direct solutions (i.e., no mixed strategy involving people and the State is acceptable by interviewees who considered themselves as having no further obligations after regular tax-paying); as a result, they think that the State is exclusively responsible to resolve the situation. 展开更多

We study a problem of two-point resistance in a non-regular m × n cylindrical network with a zero resistor axis and two arbitrary boundaries by means of the Recursion-Transform method. This is a new problem never solved before, the Green's function technique and the Laplacian matrix approach are invalid in this case. A disordered network with arbitrary boundaries is a basic model in many physical systems or real world systems, however looking for the exact calculation of the resistance of a binary resistor network is important but difficult in the case of the arbitrary boundaries, the boundary is like a wall or trap which affects the behavior of finite network. In this paper we obtain a general resistance formula of a non-regular m × n cylindrical network, which is composed of a single summation. Further,the current distribution is given explicitly as a byproduct of the method. As applications, several interesting results are derived by making special cases from the general formula. 展开更多

The paper presents a simplified numerical model of evaporation processes inside vertical tubes.In this model only the temperature fields in the fluid domain(the liquid or two-phase mixture) and solid domain(a tube wall) are determined.Therefore its performance and efficiency is high.The analytical formulas,which allow calculating the pressure drop and the distribution of heat transfer coefficient along the tube length,are used in this model.The energy equation for the fluid domain is solved with the Control Volume Method and for the solid domain with the Finite Element Method in order to determine the temperature field for the fluid and solid domains. 展开更多
