中国船舶油污损害赔偿基金法律制度研究

我国正在着手制定油污基金管理使用办法，本文从法律的视角对建立我国油污基金制度的主要问题进行了研究。指出设立船东强制责任保险是建立我国油污基金法律制度的前提；分析了油污基金制度中摊款人、基金管理人和受害人之间的法律关系，指出他们之间的关系实质上是一种信托关系，进而提出了依据信托法理构建我国油污基金法律制度的思路；在此基础上，根据我国的海洋环境保护法和信托法等有关法律法规的规定，设计了我国油污基金管理组织的法律地位、组织机构及其职责、基金使用和监督等方面的具体法律制度。

Analysis on management of philanthropic endowment in Chinese universities

Philanthropic endowment, along with government allocation, tuition fee and extra income, is one of the four major means for funding higher education in China. Research on philanthropic endowment is at its beginning stage, and so it is not yet well known. With a view to providing some useful information to our government, universities and society, this paper aims at making a brief analysis of the status quo and management of philanthropic endowment in Chinese universities.

Analysis on preserving or increasing the value of social security funds under the new normal economy in China

The ＂new normal＂ is the current stage of development of China＇s economy. The ＂new＂ in new normal means different to past; the ＂normal＂ means relatively stable. For a period of time in the future, the decrease of potential growth rate has become an indisputable fact. Social security fund is an important source of funds for the protection of people＇s livelihood, whose every movement often attract much attention. Under the situation of new normal economy, how to ensure the preserving or increasing value of social security funds on the premise of security is the core task in the operations management of social security fund investment. At present, there are some difficulties in the development of the social security funds, such as the management system and operation mechanism are not perfect, some institutional measures have not been fully implemented and the progress of the law and regulations is slow. In this paper, we will put forward some corresponding improvement measures, such as expand the scope of social security fund investment, accelerate the implementation of the nominal account system and strengthen the actuarial management of social security fund.

Alkalibacillus halophilus subsp. hitensis subsp. nov.:A new subspecies of moderately halophilic bacterium isolated from a chemical plant in China

In order to develop halophilic microorganism resources to improve environment, a Gram-positive, strictly aerobic and moderately halophilic bacterial strain JSA1 was obtained from the waste water sample collected from Jinhong Chemical Plant at Weihai city, by the methods of quick isolation and screening of halophilie bacteria. Systematic studies on it were carried out. Results show that the strain JSA1 is bacillus. The temperature range most suitable for its growth is 29 - 35 ℃ and the most suitable pH is 6. 5 - 9. 0. It can grow well at the salt mass concentration of 30 - 150 g/L. The C ＋ G mole fraction of its DNA is 37.5%. The analytical result of 16S rRNA gene sequence reveals that this strain has the closest relationship with Alkalibacillus halophilus （DQ359731） of Alkalibacillts. Their similarities are as high as 99%. However, they have obvious differences in aspects of whole-cell main fatty acid components, cell size, cell morphology, motility, oxidase, gelatine liquefication, NaCl tolerance range, pH tolerance range, G ＋ C mole fraction, sole carbon source, sole nitrogen source, antibiotic sensitivity and strain source. Comparing with other species of the same genus, differences of this strain are even more obvious. In view of muhiple identification results, we believe this strain is a new subspecies ofAlkalibacillus halophilus and name it Alkalibacillus halophilus subsp, hitensis subsp, nov.

Conclusions on the Implementation of Regulation of the National Significant Seismic Monitoring and Protection Regions from 1996 to 2012 in the Chinese Mainland

The regulation of the National Significant Seismic Monitoring and Protection Regions(NSSMPR for short) is defined by the Law of the Peoples Republic of China on Protecting Against and Mitigating Earthquake Disasters.The first stage of implementation of the regulation of NSSMPR in the Chinese mainland was finished from 1996 to 2005.The second stage is being carried on from 2006 to 2020.With the support of the National Social Science Foundation,this paper follows up and evaluates the implementation of the regulation of NSSMPR from 1996 to 2012 in the Chinese mainland.Based on analysis of earthquake examples and investigation data,we find that the effect of disaster mitigation is good,and on this basis,some suggestions are proposed to improve the regulation of NSSMPR.

CEFTA as Trade Agreement and Its Role in Its Countries＇ Economic Development and E.U. Integration （Case of Albania）

CEE （Central Eastern European） region comprises a group of countries at a relatively similar stage of economic development and with the common objective of becoming member of EU. The size of the market has pushed CEE countries to find ways towards a larger market. Joint forces, into free trade agreements, have contributed to their economic growth and European Integration. How did it happened, and what are the consequences of free trade agreements, under the example of Albania, it has been studied and analyzed, through data collections from different sources like the WB, IMF, National Banks, business round table discussions, etc.. Among all the free trade agreements CEFTA has shown to be the most effective. Central European Free Trade Agreement, CEFTA, since 2006, has been a tool to businesses making the rules and regulations governing trade in the European Region. It has contributed to make trade simpler and increasingly harmonized all procedures with those of the EU and the WTO （World Trade Organization）. As a conclusion, CEFTA experience has shown to have improved considerably business ability of developing European economies, to trade with the EU countries and the world. CEFTA has created an attractive market for investments while before the market in the Region was fragmented and unattractive to important investments, has promoted growth, and contributed to job creation. Albania is a recent success of it.

Effect of Liuweibuqi capsule, a Chinese patent medicine, on the JAK1/STAT3 pathway and MMP9/TIMP1 in a chronic obstructive pulmonary disease rat model

OBJECTIVE： To observe effect of Liuweibuqi Capsule, a Traditional Chinese Medicine （TCM）, on the janus kinase （JAK）/signal transducer and activator of transcription （STAT） pathway and matrix metalloproteinases （MMPs） in a chronic obstructive pulmonary disease （COPD） rat model with lung deficiency in terms of TCM＇s pattern differentiation. METHODS： Rats were randomly divided into a normal group, model group, Liuweibuqi group, Jinshuibao group, and spleen aminopeptidase group （n= 10）. Aside from the normal group, all rats were ex-posed to smoke plus lipopolysaccharide tracheal instillation to establish the COPD model with lung deficiency. Models were established after 28 days and then the normal and model groups were given normal saline （0.09 g/kg）, Liuweibuqi group was given Liuweibuqi capsule （0.35 g/kg）, Jinshuibao group was given Jinshuibao capsules （0.495 g/kg）, and the spleen group was given spleen aminopeptidase （0.33 mg/kg）, once a day for 30 days. Changes in symptoms, signs, and lung histology were observed. Lung function was measured with a spirometer. Serum cytokines were detected using enzyme-linked immunosorbent assay, and changes in the JAK/STAT pathway, MMP-9, and MMPs inhibitor 1 （TIMP1） were detected by immunohistochemistry, RT-PCR, and western blotting, respectively.RESULTS： Compared with the normal group, lung tissue was damaged, and lung function was reduced in the model control group. Additionally, the levels of interleukin （IL）-1β, y interferon （IFN-γ）, and IL-6 were higher, while IL-4 and IL-10 were lower in the model control group than those in the normal group. The expressions of JAK1, STAT3, ρ-STAT3, and MMP-9 mRNA and protein in lung tissue were higher, and TIMP1 mRNA and protein was lower in the model group compared with the normal group. After treatment, compared with the model group, the expression of inflammatory cytokines was lower in each treatment group, and expressions of JAK/ STAT pathway, MMPs were lower. Compared with the positive control groups, the Jinshuibao and spleen aminopeptidase groups, lung function was better, and JAK1, STAT3, and p-STAT3 protein were lower and TIMP1 was higher in the Liuweibuqi group.CONCLUSION： Liuweibuqi capsules can improve the symptoms of COPD possibly by regulating the expression of the JAK1/STAT3 pathway and MMP9/ TIMP1.

Timing,scale and mechanism of the destruction of the North China Craton

The North China Craton (NCC) is a classical example of ancient destroyed cratons.Since the initiation of the North China Craton Destruction Project by the National Natural Science Foundation of China,numerous studies have been conducted on the timing,scale,and mechanism of this destruction through combined interdisciplinary research.Available data suggest that the destruction occurred mainly in the eastern NCC,whereas the western NCC was only locally modified.The sedimentation,magmatic activities and structural deformation after cratonization at ～1.8 Ga indicate that the NCC destruction took place in the Mesozoic with a peak age of ca 125 Ma.A global comparison suggests that most cratons on Earth are not destroyed,although they have commonly experienced lithospheric thinning;destruction is likely to occur only when the craton has been disturbed by oceanic subduction.The destruction of the NCC was coincident with globally active plate tectonics and high mantle temperatures during the Cretaceous.The subducted Pacific slab destabilized mantle convection beneath the eastern NCC,which resulted in cratonic destruction in the eastern NCC.Delamination and/or thermal-mechanical-chemical erosion resulted from the destabilization of mantle convection.

Joint Funds of National Natural Science Foundation of China:Strategy,Practice and Development

Joint Funds of National Natural Science Foundation of China （ NSFC ） are initiated by different stakeholders, which aim to play a better 9ufdin9 role to support basic research in specific areas and directions. They have formed an important part of the national natural science funding system, which is responsible for advancing science and technology in an expanding frontier. The article would briefly summarize the joint funds strategic goals, programs implementation and achievements in the past decade, and provide a perspective on their future development.

Heart failure research in China： current status and future direction

Heart failure is a major public health problem worldwide. Despite advances in the therapy and care of heart failure, morbidity and mortality remain persistently high. Recent years have witnessed major breakthroughs in the investigations of pathogenesis, prevention, and treatment of heart failure in China. It is noteworthy that the continuing and growing support from funding agencies in China including the National Natural Science Foundation of China has yielded substantial effects on the basic and clinical research in heart failure in the last decade. In this review, we provide an update on the current status of heart failure research, both basic and translational/clinical, in China, including funding and publications. We also discuss the future challenges and possible strategies in improving our understanding and management of heart failure in China.

Mathematical knowledge hidden in diagram of Nine-mansions based on Nine-mansions and Eight-winds discourse

OBJECTIVE: To introduce diagram of Nine-mansions in which another diagram named Xian-Tu is nested together with the mathematical knowledge hidden in them. METHODS: Exploring with algebraic method the diagram of Nine-mansions and diagram of Xian-Tu nested in it and comparing the diagrams with the eight-pointed-star veins. It widely exists in the Neolithic Age's antiques found in China. RESULTS: The golden rectangle and golden spiral were found hidden in the diagrams and they show close relationship with eight-pointed-star veins. CONCLUSION: The mathematical knowledge does exists in the diagram of Nine-mansions and Xian-Tu, which may mean something for Traditional Chinese Medicine (TCM) for its discourse on Nine-mansions and Eight-winds obviously employed the diagram of Nine-mansions for its medical purpose.

Thoughts on the Performance Evaluation of NSFC
