The new mode of operation of the internet has caused a great impact on China’s existing criminal theory and punishment system. The Ninth Amendment to the Criminal Law stipulates the crime of refusing to fulfill obligations in the management of information networks for the first time, followed by the release of relevant judicial interpretations. However, it has not specified the specific obligations of various network service providers, including e-commerce platforms, and their information network security management obligations, which resulted in the difficulty of applying this crime in the judicial activities of the relevant e-commerce platforms.
