实践中,加班工资立法对加班工资计算基数的范围、自主加班的工资支付、加班工资共决权都缺乏明确规定,同时对用人单位不(足额)支付加班工资的惩罚也较轻。本文主张明确将劳动者的全部收入作为加班工资的计算基数;认为标准工时制下用人... 实践中,加班工资立法对加班工资计算基数的范围、自主加班的工资支付、加班工资共决权都缺乏明确规定,同时对用人单位不(足额)支付加班工资的惩罚也较轻。本文主张明确将劳动者的全部收入作为加班工资的计算基数;认为标准工时制下用人单位允许和默认的自主加班以及计件工资制下定额不合理导致的自主延时工作,用人单位都需要支付加班工资;建议赋予劳方加班工资共决权,使加班工资共决变成资方的义务,而并非平等的对话;主张加重用人单位的法律责任,不仅要补足应支付的加班工资,同时还要给付一定数额的赔偿。 展开更多

The coal industry in China has been moving from the semiarid eastern to the drier western regions since the beginning of this century.Water protection is of the utmost concern for coal mining in these regions.Lu'an,as one of the state coal mining bases in China,has been seeing increasingly heavier pressure for the protection of water resources.This article considers Lu'an as an example and describes the ways these concerns may be alleviated.High mine-water utilization rates have effectively reduced wasting of water and,consequently,have reduced water demand.Using the top layers of the Ordavician as aquifuge barriers can prevent floor karst water inrush into the longwall face and can protect the regional Ordovician karst water resources at the same time.The strength of the overlying Quaternary clay can protect against roof collapse and has successfully preserved the Quaternary porous water resource. 展开更多

Measures and suggestions for upgrading resources utilization are put forward, such as to optimize coal-firedthermal power structure, develop cogeneration, clean coal combustion techniques and gas-steam combined cycletechniques. 本文以外卖骑手的劳动报酬作为切入点,管窥平台用工当中隐含的工资保护问题。外卖骑手的劳动报酬虽然远高于当地月最低工资,但"高报酬"实乃"高工时"堆砌之功,平均至小时工资并不高--往往勉强维持在非全日制工的最... 本文以外卖骑手的劳动报酬作为切入点,管窥平台用工当中隐含的工资保护问题。外卖骑手的劳动报酬虽然远高于当地月最低工资,但"高报酬"实乃"高工时"堆砌之功,平均至小时工资并不高--往往勉强维持在非全日制工的最低小时工资线上。外卖骑手的实际劳动报酬如若再行扣除社会保险等费用,就存在击穿最低工资水平之忧。而且,困于外卖骑手在劳动法上的适格性不明,外卖骑手的劳动报酬常常享受不到劳动法对工资的特殊保护和救济机制。本研究从劳动法视阈下的工资概念及理论出发,没有选择传统的以劳动关系确认为前提的适格性分析方法,而是运用本质主义的研究进路,探究平台用工劳动报酬的内在属性和形式保障。笔者认为,以外卖骑手为代表的平台用工劳动报酬仍属工资的范畴,也即"劳动给付之对价",传统劳动法的工资保护机制亦是平台用工的现实需要,与劳动关系认定不存在互相依存或冲突关系,应跳出劳动关系认定为前提的思维,将最低工资制度、社会保障机制和支付保障机制适用于对平台用工劳动报酬的保护。与此同时,也不能将传统制度生搬硬套地运用于新生事物,需根据平台用工的特点进行微调以更好地达到劳资两利的效果。 展开更多

This paper discusses the evolution regularity and the absorption characters of sulfide for bituminous briquette burned in a horizontal burning fornace. The evolution rate of sulphur is affected by some factors, such as the sulphur content in the burning coal, burning time and the mean excess air coefficient in the furnace. With processing the experimental result, the calculation related expression has been obtained to predict the evolution rate of sulfide. The sulphur absorption efficiency of briquette is affected by tbe factors such as the character of the sulphur sorbent, the type of the coal and the operating parameters. By means of appropriately adjusting the calciumsulphur mole ratio, the mean excess air coefficient and the time-interval between pushing two layer briquettes, a high sulphur absorption efficiency (>74% ) can be obtained. 展开更多
