There are two ways to resolve business disputes, through litigation and non-litigation process. The non-litigation process mainly depends upon the agreement of the parties involved and does not have a formally binding force upon them. Although the non-litigation process is more preferred in resolving business disputes, sometimes it does not completely resolve the issue. A specific business dispute resolution procedure such as the mechanism of small claims court （an informal court） is required. The objectives of the small claims court are to settle cases in prompt and cost-effective manner, and to avoid lengthy and complex formal legal procedures. Although it is still a part of the litigation process, the small claims court applies simplified procedures that are different from those of conventional civil cases. Nonetheless, the judgment of the small claims court has the same legally binding force as that of general court. The small claims court is situated in the District Court, but the examination of cases is different from general procedures and until now the mechanism has not been widely known in Indonesia.展开更多
An integrated nonlinear planning(NLP) model is built for space station long-duration orbital missions considering both the vehicle visiting schedules and the interaction effects between target phasing,vehicle return a...An integrated nonlinear planning(NLP) model is built for space station long-duration orbital missions considering both the vehicle visiting schedules and the interaction effects between target phasing,vehicle return adjusting and Earth observation aiming.A two-level optimization approach is proposed to solve this complicated problem.The up-level problem employs the launch times of visiting vehicles as design variables,considers the constraints of crew rotations,resource resupplies and rendezvous launch windows,and is solved by a genetic algorithm.The low-level problems employ the maneuver impulses and burn times within each orbital mission as design variables,and a high-efficient shooting iteration method is proposed based on an analytical equation for the phase angle correction considering the J 2 perturbation.The results indicate that the integrated NLP model for space station long-duration orbital missions is effective,and the proposed optimization approach can obtain the optimal solutions that satisfy the multiple constraints and reduce the total propellant consumption.展开更多
Since some years, the strategy of a Green Economy as a current form of ecological modernization was proposed. The paper highlights the core issues of the concept and its structural constraints. Several constraints of ...Since some years, the strategy of a Green Economy as a current form of ecological modernization was proposed. The paper highlights the core issues of the concept and its structural constraints. Several constraints of a far-reaching realization of a Green Economy are presented, and one constraint is highlighted, i.e., the imperial mode of （production and） living. The latter gives emphasis to the continuous and largely unquestioned access to products produced by cheap labor and under environmentally problematic conditions. This mode of living, the paper argues, is also attractive among the upper and middle classed in countries with emerging economies like China. Moreover, it compares it with the concept of sustainable development which emerged some 15 years ago. Like sustainable development, proposals for a Green Economy might become ＂a tranquilizing dis- positive＂ in order to silence doubt and criticisms. However, it is argued that, despite the improbability of realizing the ambitious objectives, the Green Economy strategy might contribute to further capitalist development. Environmental issues might be integrated into the mode of production and living. However, given capitalist and imperial structures and dynamics, this will occur in highly selective and partial ways. The author calls this emerging constellation and possible new mode of development in some countries or regions of the world Green Capitalism.展开更多
