在无效审查程序中,当面临涉案专利说明书和现有技术仅仅公开有限的实验数据时,请求人常常主张权利要求既得不到说明书的支持又不具备创造性的无效理由。由于适用不同法条会带来不同的审查结论,由此产生了有限实验数据在判断权利要求是... 在无效审查程序中,当面临涉案专利说明书和现有技术仅仅公开有限的实验数据时,请求人常常主张权利要求既得不到说明书的支持又不具备创造性的无效理由。由于适用不同法条会带来不同的审查结论,由此产生了有限实验数据在判断权利要求是否得到支持和是否具有创造性的判断中,存在结论不一致的争议。本文从涉及支持性和创造性的立法宗旨出发,并结合具体案例考虑发明的技术贡献、现有技术的整体状况、发明所属领域的可预测性、本领域技术人员的知识和能力等因素,分析了上述争议的原因,认为实验数据在判断支持性和创造性中遵循相同的标准,并不意味着一定得出相同的审查结论,并就判断权利要求是否得到支持和是否具备创造性中对有限实验数据的考量提出建议。 展开更多

In the present analysis, several parameters used in a numerical simulation are investigated in an integrated study to obtain their influence on the process and results of this simulation. The parameters studied are element formulation, friction coefficient, and material model. Numerical simulations using the non-linear finite element method are conducted to produce virtual experimental data for several collision scenarios. Pattern and size damages caused by collision in a real accident case are assumed as real experimental data, and these are used to validate the method. The element model study performed indicates that the Belytschko-Tsay element formulation should be recommended for use in virtual experiments. It is recommended that the real value of the friction coefficient for materials involved is applied in simulations. For the study of the material model, the application of materials with high yield strength is recommended for use in the side hull structure. 展开更多

This paper presents a new continuum thermal stress theory for crystals based on interatomic potentials.The effect of finite temperature is taken into account via a harmonic model.An EAM potential for copper is adopted in this paper and verified by computing the effect of the temperature on the specific heat,coefficient of thermal expansion and lattice constant.Then we calculate the elastic constants of copper at finite temperature.The calculation results are in good agreement with experimental data.The thermal stress theory is applied to an anisotropic crystal graphite,in which the Brenner potential is employed.Temperature dependence of the thermodynamic properties,lattice constants and thermal strains for graphite is calculated.The calculation results are also in good agreement with experimental data. 展开更多

Dual throat nozzle (DTN) is fast becoming a popular technique for thrust vectoring. The DTN is designed with two throats, an upstream minimum and a downstream minimum at the nozzle exit, with a cavity in between the upstream throat and exit. In the present study, a computational work has been carried out to analyze the performance of a dual throat nozzle at various mass flow rates of secondary flow and nozzle pressure ratios (NPR). Two-dimensional, steady, compressible Navier-Stokes equations were solved using a fully implicit finite volume scheme. The present computational results were validated with available experimental data. Based on the present results, the control effectiveness of thrust-vectoring is discussed in terms of the thrust coefficient and the coefficient of discharge. 展开更多

Taking a small pressure change in the gas film of self-acting gas-lubricated journal bearings into account, the corresponding nonlinear Reynolds equation is linearized through appropriate approximation and a modified Reynolds equation is derived and solved by means of the finite difference method (FDM). The gas film pressure distribution of a self-acting gas-lubricated journal bearing is attained and the load capacity is calculated. The numerical solution has a better agreement with experimental data than a direct numerical solution for different values of the bearing number. It is of interest to note that the eccentricity ratio, at which the new numerical solution is in better agreement with experimental data, is different when the bearing number is changing. The new numerical solution is slightly larger when the eccentricity ratio is smaller, and becomes slightly smaller when the eccentricity ratio is larger. 展开更多
