随着大数据时代的到来,依托信息技术、数据技术等各项技术,电子商务平台得以繁荣发展。但在发展过程中出现经营者过度收集、使用消费者个人信息,通过“大数据杀熟”侵犯消费者多项合法权益等现象,有必要对其进行法律规制从而保障互联网...随着大数据时代的到来,依托信息技术、数据技术等各项技术,电子商务平台得以繁荣发展。但在发展过程中出现经营者过度收集、使用消费者个人信息,通过“大数据杀熟”侵犯消费者多项合法权益等现象,有必要对其进行法律规制从而保障互联网产业可持续健康发展。面对法律标准模糊、监管机制落后、权利救济不完善等问题,本文提出激活现有的法律规定、加强消费者个人信息保护、完善算法技术的法律治理、增加事后救济与监督管理等办法与措施,以期进一步完善消费者合法权益的保护。With the advent of the big data era, e-commerce platforms have thrived thanks to the support of various technologies, including information technology, data technology, etc. However, there have been phenomena, such as excessive collection and use of consumer personal information by business operators, and violations of consumer’s multiple legal rights through “big data killing the regular customer”, which call for legal regulation to ensure the sustainable and healthy development of the internet industry. Faced with problems such as vague legal standards, backward regulatory mechanisms, and imperfect rights remedies, this paper proposes ways and measures such as activating existing legal provisions, strengthening consumer personal information protection, improving the legal governance of algorithm technology, and increasing post-event remediation and supervision, with the aim of further improving the protection of consumer’s legitimate rights.展开更多
