However, most studies of CDM focus on economics, and few on its legal problems. CDM involves too many aspects. And the clear legal attribute of trading object is the basis of progress of the transaction and also the start point of legal protection. Therefore, this paper in accordance with the inherent principle of property rights economics, and environmental economics in CDM, only discusses CDM carbon emission right legal interpretation and its attribution. The paper recommends that in order to ensure and promote the carbon emission right trading, carbon emission right should be attributed into the system of real rights to be regulated by Real Right Law. In this way, carbon emission right can gain exclusive power of possession and use, which can achieve a clear right def inition of environmental goods in line with Coase's theory to protect Chinese prof it in carbon trading market and promote the development of the carbon trading market further.展开更多

The purpose of this article was to analyse how fisheries governance can be improved when there is low enforcement capacity by state＇s institutions. Based on the theoretical arguments from the neo-institutionalism and...The purpose of this article was to analyse how fisheries governance can be improved when there is low enforcement capacity by state＇s institutions. Based on the theoretical arguments from the neo-institutionalism and the social capital approaches, the findings of this research point to the role of fishing cooperatives＇ structural organization on the attitude of individuals to comply with regulations. Using a most similar comparative method, it was found that fishers with higher scores of compliance belong to cooperatives that have an outstanding leader, control mechanisms, as well as multi-actor external networks which connect the organization with other networks and thus facilitate the access to knowledge, technology and activities related to conservation and sustainable fishing. The findings of the research coincide with other studies about the importance of leadership that enable good fishing management. This may help in the design of different strategies to address situations with low state capacity to ensure compliance and contribute to solve problems of commons, such as the one in marine fisheries.展开更多

Then taking J...Based on the theory of system dynamics, the paper analyzes the mechanism of socio-economic benefits of highway projects and establishes the system dynamics model of regional economic-highway development. Then taking Jinji（Tianjin--Jixian） Highway of Tianjin as an example, the errors of system simulation are tested, and the system dynamics model built is verified to be quite stable, which has a high performance. Through the comparison of simulation results with and without Jinji Highway, the paper simulates and predicts the socio-economie benefit of each year from 2003 to 2013. Thus the quantification evaluation of socio-economic benefit of highway project is realized and will provide the theory instructions for similar projects in the future.展开更多
