作为对现代社会复杂性的一种理论解释,德国学者图依布纳的自创生理论试图整合自主性、外部性、社会调和三种规范性价值。面对诸社会次级系统的自创生性闭合,法律系统惟有承认自身理性的有限性,并通过反思理性的模式,才能有效的完成社会... 作为对现代社会复杂性的一种理论解释,德国学者图依布纳的自创生理论试图整合自主性、外部性、社会调和三种规范性价值。面对诸社会次级系统的自创生性闭合,法律系统惟有承认自身理性的有限性,并通过反思理性的模式,才能有效的完成社会整合的任务。反思理性模式下,成功的法律调整必须满足下列条件:法律规制不能破坏其他系统的自主性;法律通过程序导向的结构性约束促使各种社会权力结构内化公共目标,并通过积极的、创造性的自我管理和自我反思克服负外部性;法律调整的目的是实现不同次级系统之理性的外部调和,以使整体社会作为一种自我指涉的超循环成为可能。反思理性法自提出以来,因其特殊的优势(非强制性、法律自身之结构完整性、自治与规制的结合),已经被广泛的运用于实践领域,尤其是在环境保护领域,并被认为具有回应社会治理危机的巨大潜力。 展开更多

Project teaching stud... At present, a new teaching model - Project Approach rises in English education. Project teaching is a student-centered, inquiry-centered practice, with project activities centered learning model. Project teaching students focus on learning strategies to help students become independent learners, to improve students' motivation to help students learn practical ability, communication skills, collaboration skills, creative thinking skills and the ability to solve practical problems. Project-based learning in the late 1990s was introduced in China. Within ten years, research project studying abroad connotation, significance and theoretical foundation, extension are applied research to classroom practice. However, most of the research object of the project is teaching primary and secondary students, higher education, adult education and general higher education students in science and engineering students. Research related to the field of English teaching is not much; the theory is applied to the case of teaching practice rarely. Therefore, this article introduced the project teaching college English classroom, through the implementation of the teaching aims to stimulate the enthusiasm of the students, so that students learn more explicit goals, enhance self- confidence and motivation to learn, to develop their creativity, initiative and independent learning and the purpose of learning ability. 展开更多
