The Constitution of the Republic of Indonesia provides a guarantee of religious freedom for every citizen under Article 28 E of the 1945 Constitution. The Constitutional Court, which is required to protect, maintain, and ensure religious freedom for religious minorities, is deemed to fail guarding the right of religious minorities, because in addition to providing a restrictive ruling on a judicial review of the rule of law which is contrary to the basic law, it also fails to interpret legal products under the laws as part of the constitution. The Constitutional Court dysfunction as a guardian of the constitutional rights of religious minorities occurs because of the vacuum of law (recht vacuum), a narrow interpretation of the constitution by the constitutional judges. The urgency that needs to be addressed is to provide the Constitutional Court with a more extensive authority, which is not limited only to review legal products under laws, but also includes production of Law on Freedom of Religion and Belief for protection in the application of Article 28 E of the 1945 Constitution.展开更多

The CSF erad...Classical swine fever (CSF) is a highly contagious viral disease of Suidae animals, caused by a Pestivirus from Flaviviridae family, considered one major cause of economic losses to the swine producers. The CSF eradication and control program (CSFECP) established from 1992 evolved to 2001, divide the country in CSF Free Zone, without CSF vaccination and CSF infected area. The purpose of this work was to analyze the CSFECP efficacy in all Brazilian territory from 2000 to 2011 including CSF outbreaks in infected area of North and Northeast regions. CSF epidemiological data were obtained mainly from Federal Agriculture Defense Secretary and States Official Inspection Agencies. The CSF outbreaks occurred in CSF infected area were plotted and the tendency line analyzed by quadratic trend model (Minitab). The results of Brazilian statutory for CSF point to a gradual CSF-eradication in all country since the number of Federal States including at CSF Free Zone, is increasing and reached 15 of 27 Brazilian States, in period from 2001 to 2009. In seven States of infected area, 49 CSF outbreaks occurred. The stamping out was the main sanitary measure but in two Federal States Amap~. and Rio Grande do Norte the emergency vaccination was also applied. In conclusion, the eradication of CSF of all Brazilian territory is in progress but depend on the continuity of official swine diseases surveillance jointed with a rigorous control of animal movement, serological and viral activities investigations until no more outbreaks could be cited in all country.展开更多

In this paper the authors inquire why, after more than 25 years of domestic agricultural reforms in Mexico and 15 years of trade liberalization of maize under the North American Free Trade Agreement (NAFTA), the dom...In this paper the authors inquire why, after more than 25 years of domestic agricultural reforms in Mexico and 15 years of trade liberalization of maize under the North American Free Trade Agreement (NAFTA), the domestic production of maize, a non-competitive crop and the major staple in Mexico, has increased. The authors present new empirical evidence showing that, as expected, maize prices in Mexico dropped until 2006 and have experienced a process of convergence with USA prices, and maize imports from the USA have increased. However, despite lower prices, maize production in Mexico has trended upward since 1992, two years before the beginning of NAFTA's implementation. Based on the heterogeneity of maize production in Mexico, three possible explanations are proposed to explain this unexpected outcome: government supports to big commercial farmers in the agriculturally rich North of Mexico; the persistence of maize production by subsistence farmers; and to a lesser degree, increasing yields on some irrigated maize farms. We finish the paper by drawing lessons from the experience of Mexico for other Less Developed Countries.展开更多
