电子商务纠纷中,证明责任的分配首先要遵循《民事诉讼法》关于举证责任的一般规定,本文在理清电子商务纠纷中证明责任分配这个特定领域的理论基础后,着重探析了三类电子商务纠纷具体领域的责任分配问题:电子商务交易合同的证明责任分配...电子商务纠纷中,证明责任的分配首先要遵循《民事诉讼法》关于举证责任的一般规定,本文在理清电子商务纠纷中证明责任分配这个特定领域的理论基础后,着重探析了三类电子商务纠纷具体领域的责任分配问题:电子商务交易合同的证明责任分配、电子商务侵权纠纷的证明责任分配、电子证明作为证据的证明责任分配,对于电子商务领域内的相关立法具有一定的借鉴意义。此外本文还对比了国内外在该领域内的立法与司法现状,通过对比获得启示进而为完善电子商务领域内相关法律法规提供针对性的建议。In e-commerce disputes, the allocation of burden of proof should first follow the general provisions of the Civil Procedure Law on the burden of proof. After clarifying the theoretical basis of the specific field of burden of proof allocation in e-commerce disputes, this article focuses on exploring the allocation of burden of proof in three specific areas of e-commerce disputes: the allocation of burden of proof in e-commerce transaction contracts, the allocation of burden of proof in e-commerce infringement disputes, and the allocation of burden of proof as evidence in electronic proof. It has certain reference significance for relevant legislation in the field of e-commerce. In addition, this article also compares the legislative and judicial status quo in this field at home and abroad, and obtains inspiration through comparison to provide targeted suggestions for improving relevant laws and regulations in the field of e-commerce through the comparison.展开更多
