我国高校学生实习伤害事故归责问题研究

高校作为实现制造强国战略的重要组成部分,成为社会各行业人才最直接的供给来源,实习实训则是全面提高学生操作技术水平与能力的关键环节。从我国司法实践来看,高校学生实习伤害事故的司法判决多遵循"过错责任原则",辅以"公平原则",根据具体情况适用"过错推定原则"和"无过错原则"。实习过程中实习生从事劳动的行为和接受教育的行为在时空区分上存在一定的模糊性,在法律上存在重合的关系。良好的归责制度是健全学生实习实训制度,推进实习实训规范化的重要手段。
