Determination of Liability for Violation of “Sexual Autonomy” and Compensation for Mental Damages

At the legislative level in China,there has been insufficient theoretical preparation to explicitly include“sexual autonomy”within the scope of general personality rights.In handling the increasing number of disputes related to violations of“sexual autonomy,”judicial biases have emerged during the trial process when courts determine the attribute of the right to“sexual autonomy.”This situation necessitates a clear legal analysis of the concept and attributes of“sexual autonomy”to establish its essential attribute as a personality right,and,from the perspective of legal doctrine,enable the justification of the right to“sexual autonomy”as either a general personality right or other personality interests,thereby providing theoretical support for courts to“adjudicate according to law.”By delineating and categorizing instances of violations of“sexual autonomy,”the constitutive elements and fundamental characteristics of such violations can be clarified.By examining the legal norms governing civil litigation and civil litigation associated with criminal cases concerning violations of“sexual autonomy,”the responsibility determination,remedies,and existing regulatory loopholes regarding violations of“sexual autonomy,”especially in cases involving both criminal and civil matters,can be defined.Based on this foundation,the legal basis,determination mechanism,and compensation standards for claiming compensation for mental damages resulting from violations of“sexual autonomy”can be elucidated. 展开更多

The question of“new moral subjects”arises today in connection with the use of advanced technologies in the context of Industry 4.0,i.e.,the industrial enterprise investing in smart factories,co-robotic,additive manufacturing,augmented reality,cyber security,big data,etc.Industry 4.0 underpins what is being heralded as Industry 5.0.Technologies in this field excel in that they are not used for the mere execution of processes designed,programmed,and controlled by man,but are applied to realise“autonomously”goals in the industrial context.Consequently,their degree of automation is no longer defined by increasing independence from human beings,but by the ability to spontaneously initiate a process and implement it to useful effect.The comparison between man and machine,and the justification for the introduction of“new moral subjects”thus crucially depend on the location of“moral being”in the reference to their“autonomy”as a property characterising the“subject man”,but not the exclusive prerogative of the latter. 展开更多

With the rapid development of information and communication technology (ICT) and sensor technology, ubiquitous computing (or pervasive computing) has become widely used with much convenience to human life. For ins... With the rapid development of information and communication technology (ICT) and sensor technology, ubiquitous computing (or pervasive computing) has become widely used with much convenience to human life. For instance, people can use their electronic devices at hand (e.g., Google glasses or Apple watch) to access information they need. However, this '~ubiquitous" service poses challenges to human autonomy. Based on the analysis of the features of pervasive computing, this paper points out the ambiguity between the subject and object of ubiquitous computing and shows technological interventions can affect human autonomy at three levels: technology addiction, the degradation of human capacities, and the reversal of the end and the means caused by the fuzziness of ma^-machine interface. In other words, ubiquitous computing gives people unprecedented convenience, and it also deprives of their freedom. According to Kant's Theory of Freedom, this article reflects on the relationship between the autonomy of technology and that of humankind. 展开更多

Based on this situation,some investigations were conducted on the topic of TA among 5 vocational colleges in Kunming, Yunnan Province. At the same time, they are used to learning all by themselves, lacking the spirit of cooperation. This paper describes an experiment aimed to promote learner autonomy and cooperation among college students. A new teaching mode was used in a class, which has 38 students and the class was chosen randomly from 9 classes of the first year students in Wuhan Commercial Service College. Analysis statistics and questionnaire information indicated that the new teaching mode introduced was effective both in helping students acquire knowledge and in promoting learner autonomy and cooperation. The result of the experiment provides a quotable teaching mode for English teachers of colleges. 展开更多

For many years now," autonomy" in learning has been a topic of widespread discussion in educational field.Accordingly,it is Henry Holec who introduced learner autonomy to the field of second language in his project report to the Council of Europe in 1981.Motivation is also a widely used psychological term in our daily life and research.Both learner autonomy and motivation are important factors in influencing learning effects.Many researchers conduct studies on learner autonomy and motivation.There are also some studies on the correlation between learner autonomy and motivation in SLL(Second Language Learning).However,few of them focus on the effect of learner autonomy on motivation.Thus,it makes an attempt to investigate whether learner autonomy has an enhancement effect on motivation.It combines motivation and learner autonomy together to find some effective and efficient ways of promoting foreign or second language learning.In another way,it enriches learner autonomy research.It holds that learner autonomy is a very important factor in influencing motivation.It will make a combination between learner autonomy and motivation in SLL to find some new ways of promoting learners' motivation and learning efficiency.A survey methodology has been employed which consists of qualitative and quantitative methods.Specifically,both questionnaire and interview have been conducted in the research. 展开更多

The increasingly complex battlefield environment requests much closer connection in a team having both manned and unmanned aerial vehicles(MAVs and UAVs). This special heterogeneous team structure causes demands for effective organizational structure design solutions. Implementing adjustable autonomy in the organizational structure, the expected evaluation function is established based on the physical resource, intelligent resource, network efficiency, network vulnerability and task execution reliability. According to the above constraints, together with interaction latency, decision-making information processing capacity, and decision-making latency, we aim to find a preferential organizational structure. The proposed organizational structure includes cooperative relationships, supervisory control relationships, and decision-making authorization relationships. In addition,by considering the influence on the intelligent support capabilities and the task execution reliability created by adjustable autonomy, it helps to build the proposed organizational structure designed with certain degree of flexibility to deal with the potential changes in the unpredictable battlefield environment. Simulation is conducted to confirm our design to be valid. And the method is still valid under different battlefield environments and interventions. 展开更多
