On Autonomy of Will and the Applicable Law of Labor Contract:From the Perspective of Chinese Legislation

There are so many different opinions on whether the autonomy of will is applied in labor contract.In this paper,the author discusses the application and limitation of autonomy of will in labor contract,and puts forward some suggestions on the application of Article 43 of Law of the Application of Law for Foreign-related Civil Relationships after the introduction of Chinese legislation of the applicable law of labor contract.Autonomy of will is a useful principle in resolving disputes arising from foreign-related labor contract in China.

Determination of Liability for Violation of “Sexual Autonomy” and Compensation for Mental Damages

At the legislative level in China,there has been insufficient theoretical preparation to explicitly include“sexual autonomy”within the scope of general personality rights.In handling the increasing number of disputes related to violations of“sexual autonomy,”judicial biases have emerged during the trial process when courts determine the attribute of the right to“sexual autonomy.”This situation necessitates a clear legal analysis of the concept and attributes of“sexual autonomy”to establish its essential attribute as a personality right,and,from the perspective of legal doctrine,enable the justification of the right to“sexual autonomy”as either a general personality right or other personality interests,thereby providing theoretical support for courts to“adjudicate according to law.”By delineating and categorizing instances of violations of“sexual autonomy,”the constitutive elements and fundamental characteristics of such violations can be clarified.By examining the legal norms governing civil litigation and civil litigation associated with criminal cases concerning violations of“sexual autonomy,”the responsibility determination,remedies,and existing regulatory loopholes regarding violations of“sexual autonomy,”especially in cases involving both criminal and civil matters,can be defined.Based on this foundation,the legal basis,determination mechanism,and compensation standards for claiming compensation for mental damages resulting from violations of“sexual autonomy”can be elucidated.

Examining the Experiences and Challenges of Haze-Fog Governance in China

With the rapid development of industrialisation and urbanisation, China is facing the challenge of severe HF (Haze-Fog) pollution. This essay compares the advantages and disadvantages of China’s HF management and summarizes the important lessons China can teach the rest of the world about applying this tactic. China’s capabilities in the digital economy, National Innovation Demonstration Zones, and urban innovation systems are examined in this article, along with its shortcomings in information mechanisms and pollution sources. This essay also summarizes China’s achievements, particularly regarding local autonomy. The essay goes on to say, however, that China is probably going to be under more pressure to manage HF in the future, both in terms of long-term solutions and the economy.

Meta-cognitive Strategy Training and the Development of Learners＇ Autonomy in Language Learning

As the ultimate goal of education, autonomy in language learning has aroused a lot of attention from scholars at home and abroad. While in universities of China, students do not have strong autonomy in English language learning. The author tries to adopt specific meta-cognitive strategies to facilitate students＇ autonomy in learning by improving learners＇ capacities in study planning or management, monitoring and evaluating in learning to raise their consciousness and ability in autonomy, and lay a foundation for life-long learning.

A Study on Teacher Autonomy in English Language Teacher's Professional Development in Vocational Colleges

Teacher professional development(TPD), which is related with teacher education, has been the topic of vital significance in the world educational reform. There are diverse modes and approaches of teacher development, among which, teacher autonomy(TA) is a new concept. It is relatively new and has received insufficient attention in China, especially in vocational colleges. The related research of this kind on English teachers in vocational colleges is far from enough. Based on this situation,some investigations were conducted on the topic of TA among 5 vocational colleges in Kunming, Yunnan Province. By utilizing questionnaires and interviews as the main investigation tools, the present author conducted the survey of the current situation of the English teachers' professional development and the existing problems, aiming at exploring the effective ways of promoting English language teachers'(autonomy) development in the context of vocational colleges.

The Enhancement Effect of Learner Autonomy on Motivation in SLL

For many years now," autonomy" in learning has been a topic of widespread discussion in educational field.Accordingly,it is Henry Holec who introduced learner autonomy to the field of second language in his project report to the Council of Europe in 1981.Motivation is also a widely used psychological term in our daily life and research.Both learner autonomy and motivation are important factors in influencing learning effects.Many researchers conduct studies on learner autonomy and motivation.There are also some studies on the correlation between learner autonomy and motivation in SLL(Second Language Learning).However,few of them focus on the effect of learner autonomy on motivation.Thus,it makes an attempt to investigate whether learner autonomy has an enhancement effect on motivation.It combines motivation and learner autonomy together to find some effective and efficient ways of promoting foreign or second language learning.In another way,it enriches learner autonomy research.It holds that learner autonomy is a very important factor in influencing motivation.It will make a combination between learner autonomy and motivation in SLL to find some new ways of promoting learners' motivation and learning efficiency.A survey methodology has been employed which consists of qualitative and quantitative methods.Specifically,both questionnaire and interview have been conducted in the research.

Design method of organizational structure for MAVs and UAVs heterogeneous team with adjustable autonomy

The increasingly complex battlefield environment requests much closer connection in a team having both manned and unmanned aerial vehicles(MAVs and UAVs). This special heterogeneous team structure causes demands for effective organizational structure design solutions. Implementing adjustable autonomy in the organizational structure, the expected evaluation function is established based on the physical resource, intelligent resource, network efficiency, network vulnerability and task execution reliability. According to the above constraints, together with interaction latency, decision-making information processing capacity, and decision-making latency, we aim to find a preferential organizational structure. The proposed organizational structure includes cooperative relationships, supervisory control relationships, and decision-making authorization relationships. In addition,by considering the influence on the intelligent support capabilities and the task execution reliability created by adjustable autonomy, it helps to build the proposed organizational structure designed with certain degree of flexibility to deal with the potential changes in the unpredictable battlefield environment. Simulation is conducted to confirm our design to be valid. And the method is still valid under different battlefield environments and interventions.

An Exploration of the Concept of Learner Autonomy

The concept of learner autonomy is well known as very complex as many scholars put emphasis on differences between his ideas and others'. That no consensus has reached so far puzzles us. However, a good understanding of autonomy is the basis of putting development of autonomy into practice. Through examining common features of different concepts and explaining the relationship between autonomy and its related concepts, the highly condensed qualities of "relativity" and "duality" are put forward and some implications about specific ways of fostering autonomy in Chinese educational context are also discussed.

The relationship between professional autonomy and moral distress among nurses working in children's units and pediatric intensive care wards

Background: Nurses serve as the primary source of care for minor patients in intensive care units. Even though they support both patients and their relatives, these nurses may experience moral distress from their profession. While managing their daily relationships with their patients, nurses must also be able to control their actions to feel that they are from a social unit and feel their competence in association with others.Objective: This study aimed to investigate the relationship between professional autonomy and moral distress among nurses working in children's units and pediatric intensive care wards. Methods: This descriptive/comparative cross-sectional study was conducted in 2015 using 120 nurses as subjects. Subjects were selected using the census method. The research tools used to gain measurable data were the Pankratznursing questionnaire(PNQ) and Corley'sMoral distress scale (MDS). In order to analyze the collected data, descriptive statistic tests such as the relative frequency distribution, mean, standard deviation and the Pearson correlation test, T-test, ANOVA, and regression were used. The SPSSv.20 software was also used to analyze the data obtained. Results: The relationship between professional autonomy and moral distress revealed that there was a significant positive relationship between professional autonomy and moral distress in the intensity (r=0.39;P<0.001) and the iteration (r=0.41;P<0.001). In addition, professional autonomy predicted 18% of changes in intensity of moral distress in total(MR = 0.42, R2 = 0.18) and also professional au-tonomy predicted 25% of iteration in moral distress in total(MR = 0.507, R2= 0.25). Conclusions: The results of this study revealed that there was a direct positive relationship between professional autonomy and moral distress.

Research on the Judicial Relief System of Villagers' Autonomy Rights

Starting from the division of the functions of the village committee,the use of self-government rights of the villagers was examined in view of the different functions.Judicial remedies should be screened whether or not the exercise of autonomy,as well as the main disputes in order to determine the specific litigation.The responsibility determination of the villagers' autonomy rights prosecution in different circumstances is put forward.

A Comparative Study of Teacher Autonomy Between Novice Teachers and Proficient Teachers in the Context of University English Teaching Reform in China

Teacher autonomy has become a popular focus in the field of teacher education at present. The development of learner autonomy depends largely on teacher autonomy. Teacher autonomy is also one of the most effective ways to support teachers in their classroom practice, as well as to improve and expand their professional preparation and practices. Apart from that, the research of teacher autonomy at different phases of teachers＇ professional development may provide insight into how to strengthen their autonomy capability and to better understand the differences in teachers＇ development at different stages. The current study aims to explore the different level of how university novice and proficient English teachers see themselves as autonomous practitioners on the five dimensions of teacher autonomy： teaching autonomy, assessment autonomy, school management autonomy, professional development autonomy, and curriculum development autonomy. In addition, it proposes coping strategies to facilitate the development of teacher autonomy, which may shed some light on cultivating teacher autonomy for teachers at different developing stages, development of expertise, and teacher education.

A Study on the Relationship between Intrinsic Motivation and Learner Autonomy in English Learning of Non-English Major College Students

To provide scientific feedback and advice on improving the English autonomous learning ability of non-English majorsand in improving the quality of English for non-English majors, it is urgent to study the relationship between intrinsic motivationand learner autonomy. Based on the theory of intrinsic motivation and learner autonomy, a questionnaire survey is used to investi-gate non-English students at Northeast Agricultural University. The obtained data through SPSS analysis and case simulation showthat there is a positive correlation between intrinsic motivation and learner autonomy, which proves the necessity and feasibility ofconstructing autonomous learning factor model to improve the self-learning ability of contemporary non-English majors.

Learner autonomy,the ability of taking one's own learning in charge,plays an important role in language learning.The paper reviews the definition and the level of learner autonomy,the characteristics of autonomous learners,the application of learner autonomy in the classroom and out of the classroom and the relationship between learner autonomy and culture.In the paper,the development and the study of learner autonomy in China are also summarized.

Nurses' lived experiences of professional autonomy in Iran

Objectives: Nurses' autonomy is a complex and multi-dimensional concept that has often been overlooked.Although many studies have addressed patients' autonomy,there has been no assessment of nurses' experience of professional autonomy.The present study aimed to assess nurses' lived experiences of professional autonomy in Shiraz,Iran.Methods: The present qualitative study was conducted in Shiraz (Iran) from January 2016 to February 2018.The target population was selected among nursing professionals employed by various hospitals affiliated to Shiraz University of Medical Sciences,Shiraz,Iran.The experiences of the participants were assessed through 14 in-depth semi-structured interviews.The response of the participants was analyzed using Van Manen's 6-step approach for interpretive phenomenology.Results: Based on the analysis of the interviews,4 themes,11 categories,and 13 sub-categories were extracted.The themes were: Advocacy for patients and nurses,independence in the workplace,Involvement in professional decision-making,and Professional accountability.Conclusion: Due to the intense interaction between nurses and patients,a better quality of care will be achieved if the professional autonomy of nurses is ensured.Healthcare authorities and hospital managers should provide the framework and permit the nurses to practically exercise full independence in the workplace.
