The World Telecommunication Standardization Assembly(WTSA-24) took place on October 15-24 in New Delhi, India. Held by ITU every four years, the global event defines the next period of study for ITU-T.The assembly was attended by over 3,000 representatives from more than 150 ITU member states, six regional telecommunication organizations in the Asia-Pacific, Europe, Americas, Africa, Arab, and the Commonwealth of Independent States, as well as related international organizations and renowned enterprises, which reaches a record high. The event focused on the direction of ITU's standards research in the period of 2025-2028, and the election of research group management positions, and other important issues.

Full-Blind Delegating Private Quantum Computation

The delegating private quantum computation(DQC)protocol with the universal quantum gate set{X,Z,H,P,R,CNOT}was firstly proposed by Broadbent et al.[Broadbent(2015)],and then Tan et al.[Tan and Zhou(2017)]tried to put forward a half-blind DQC protocol(HDQC)with another universal set{H,P,CNOT,T}.However,the decryption circuit of Toffoli gate(i.e.T)is a little redundant,and Tan et al.’s protocol[Tan and Zhou(2017)]exists the information leak.In addition,both of these two protocols just focus on the blindness of data(i.e.the client’s input and output),but do not consider the blindness of computation(i.e.the delegated quantum operation).For solving these problems,we propose a full-blind DQC protocol(FDQC)with quantum gate set{H,P,CNOT,T},where the desirable delegated quantum operation,one of{H,P,CNOT,T},is replaced by a fixed sequence(H,P,CZ,CNOT,T)to make the computation blind,and the decryption circuit of Toffoli gate is also optimized.Analysis shows that our protocol can not only correctly perform any delegated quantum computation,but also holds the characteristics of data blindness and computation blindness.

税收法定原则三阶:中西协商民主税收立法史辨

税收法定原则是人类社会商品经济发展和民主政治完善的必由之路,其制度基因密码是协商民主。税收法定原则呈现出两个层面的三级阶梯递进模式:在法律层面,它包含议会自主立法、授权立法、平移立法三级立法模式;在政治层面,它经历英国、美国、中国三级协商民主政治制度。科学理解税收法定原则应当坚持运用马克思主义唯物史观基本原理,既客观肯定英国古典税收法定原则的历史进步性,又充分关注美国现代税收法定原则的时代变革性,同时还应当甄别其由阶级局限性和政治保守性决定的反协商民主的阶级本质。新时代中国税收法定原则具有包容、吸纳西方先进历史经验的开放性,能够全面、真正践行协商民主,在全国人大主导下,充分调动全社会的热情和智力,实现税收立法效率最大化和立法质量最优化,真正实现全过程人民民主。

全国人大及其常委会立法授权的类型与价值

全国人大及其常委会立法授权是制定、修改、废止、解释法律和编纂法典等立法权基本配置机制以外的非常态化规则输出机制。对全国人大及其常委会立法授权的一体探讨,既忽视了立法授权的历史变迁,也忽视了立法授权不同的法律渊源与实践诉求,更忽略了不同的授权对象以及彼此相互区分的事实。根据我国《宪法》和《立法法》《香港特别行政区基本法》《澳门特别行政区基本法》等宪法性法律,全国人大及其常委会立法授权实践发展出了授权制定法律规范、授权暂调法律和授权区域治理三种相对独立的主要类型。最高国家权力机关立法授权的三种主要类型是直面中国经验、继承授权传统而构建的,在授权主体、授权监督等方面确实存在共通之处,但在授权时是否存在相关法律、授权时权力是否转移、授权事项范围、受权主体范围以及授权运行过程等方面都存在明显不同。针对全国人大及其常委会立法授权的类型化探讨,阐释了因应各种特殊需要的授权制度实践与完善,明晰了实践理性类型化适用于法治与改革的具体情境,丰富了实践基础上国家制度创新的治理现代化路径,展示了中国立法授权制度发展的继承性、民族性与开拓性。

基于“放管服”改革珠江流域水行政“审、批分离”的探索研究

为深入贯彻“放管服”改革,珠江流域各级水行政主管部门积极探索尝试“审、批分离”。结合珠江流域“审、批分离”试行情况,对比分析了现行审批模式和“审、批分离”模式,对比发现“审、批分离”能提高审批质量和审批效率并降低廉政风险。总结了目前“审、批分离”存在的问题,并结合“放管服”改革的要求提出了改进措施建议,为探索推进“审、批分离”提供有益的工作探讨与借鉴。

以“一件事一次办”为突破口持续优化营商环境

“一件事一次办”是提升政务服务标准化、规范化、便利化水平的重要内容,是加快政府职能转变、优化营商环境的核心要义,其实质是以公众诉求为导向,重塑政府流程,提升政府整体效能与公共福祉。借助制度经济学和新公共管理范式的整体治理理论,以“一件事一次办”政务服务改革为突破口,充分发挥区域比较优势,以大数据赋能打造透明高效的“数智”环境、持续优化公平正义的法治环境、竞争有序的市场环境和互利共赢的国际化的营商环境,充分释放行政改革集成效应。

基于SVM的DPoS共识机制改进

共识机制是区块链技术的重要组成部分,针对委托权益证明(delegated proof of stake,DPoS)共识机制中对恶意节点不能及时有效处理的问题,提出了一种基于支持向量机的DPoS共识机制改进方案(SVM-DPoS)。首先构建基于SVM的节点判别模型,通过训练好的模型分析节点的行为动机,根据判别结果及时剔除恶意节点;其次基于固定协商出块顺序优化传统算法的出块流程,提升出块效率,进一步提高了整个区块链网络的运行效率。在公开数据集上的实验结果表明,与已有的几种方法相比,改进后的共识机制能够快速剔除恶意节点,不仅维护了系统稳定性,而且增强了对恶意行为的防范能力,从而在保障区块链网络正常运行的同时,提高了整体共识的安全性。

构建新发展格局视域下的营商环境治理研究

营商环境治理作为中国国家治理的重要部分,是国家治理体系和治理能力现代化的重要标志,也是中国式现代化在经济领域的突出表现,彰显着国家治理现代化水平。因此,要牢牢把握营商环境发展方向,坚持以习近平新时代中国特色社会主义思想和党的二十大精神为指导、以中国式现代化为目标、以马克思主义中国化时代性成果和经验为基础,将营商环境的制度优势转化为国家治理效能。文章以中国式现代化作为营商环境治理的方向引领,以大国经济发展理论、新新贸易理论、马克思主义政治经济学为理论支撑,剖析了构建新发展格局视域下营商环境治理的内在机制,即大国经济理论从“人口规模巨大的现代化”出发,从人口规模多样性和市场多样性的现实角度,揭示了构建形成强大国内市场的重要意义;共同富裕、物质文明与精神文明相协调、人与自然和谐共生的中国式现代化目标,与新新贸易理论中基于企业异质性、挖掘企业潜力、关注企业参与度与社会责任感、最终实现产业整体效益的逻辑相符合;马克思主义政治经济学追求的国民经济良性循环目标,从国内国际“双循环”的角度,诠释了“和平发展道路”的政治经济学内涵。其次,文章基于三大理论基础,解析新发展格局视域下营商环境治理促进经济发展的多维动态逻辑,即基于大国经济发展理论的要素市场化配置逻辑、基于新新贸易理论的产业链供应链升级逻辑与基于马克思主义政治经济学的现代流通体系建设逻辑。最后,文章将营商环境治理的多维动态逻辑融入中国当前构建新发展格局的目标取向和战略选择中,提出构建新发展格局视域下营商环境治理的市场化改革路径、创新驱动路径和“放管服”改革路径,三条作用路径相辅相成、协同发力,以制度创新为新发展格局经济体系注入源源不断的活力。

论未出资股权转让后的出资责任——新《公司法》第88条的正当性与适用解读

新《公司法》第88条规定了未出资股权转让后的出资责任,其法理正当性与具体适用有待进一步研究。依据股权转让时出资期限是否届满,可将未出资股权分为瑕疵股权与未届期股权,两者的规制共性大于异性。而受让人与转让人的责任配置原理不一,依债务承担原理,受让人因继受取得股东资格,当然需要承担后续的出资义务与出资责任,仅在瑕疵股权转让时受让人享有例外性的善意抗辩权,而转让人的责任应然性与责任形态需结合制度目的与制度成本进行综合衡量。第88条的适用范围应包含抽逃出资的股权,且加速到期规则衔接第1款与第2款;第88条的出资责任应包含向公司足额缴纳出资、损害赔偿的责任以及包含股东向债权人的补充清偿责任。但是,第88条在股权多次转让时存在不可忽视的未尽问题,无期限、无顺序的转让股东责任可能过分侵害股东退出自由,主观心态的割裂性可能导致责任规则的适用困难,应考虑增加时间限制规则、切断规则。

轻资产运营模式与数智化管理赋能——基于珠海万达商管的案例研究

越来越多的企业热衷于轻资产运营模式,本文以珠海万达商业管理集团股份有限公司(简称珠海万达商管)为研究对象开展单案例研究,通过分析该公司对外招股说明书等公开资料,结合相关理论文献,提出了商业物业类企业轻资产运营模式的基本框架,分析了委托运营管理和收益分成型租赁等轻资产运营模式的主要特征。本文认为,轻资产运营模式在不同行业和企业应有差异化的应用,并匹配管理体系的创新变革。本文研究发现,企业的数智化管理主要聚焦于收入、成本、管理三个方面,通过服务体验、客户画像、智能运营、数据分析规划等方式,支撑企业轻资产运营模式,最终提高经营绩效与企业价值。这些结论既丰富了轻资产运营模式的理论逻辑和数智化支撑的管理方略,也为相关企业应用轻资产运营模式提供了实操性启示。

雷达双层双模健康监视架构设计

雷达设备健康监视主要实现雷达故障预测与健康管理系统的数据解析和显示。传统的监视架构为单一架构层次、面向单一对象的监视架构,并且软件实现与设备紧耦合,其开发和维护成本巨大。文中首次将模型-视图-代理(MVD)模式应用到雷达状态监视架构设计中,提出一种基于MVD的双层双模架构。该架构无需代码定义接口结构体,利用模型工具软件直接编辑设备编号、响应策略,利用高效的封装基类将内置测试设备的状态数据与显示实现挂接;采用“全面+重点”双布局、“用户+专家”双模式设计,可实现目标态势与健康态势同时掌握,并满足用户/专家等不同对象的显示需求。通过工程验证,相比于传统的健康监视架构,该架构提供多样化作战视图,提高了软件可读性、可维护性,节约了软件开发成本,提高了开发效率。

央企母公司混改与子公司创新产出:促进还是抑制?

党的二十大报告明确提出深化国资国企改革,加快国有经济布局优化和结构调整。基于2008—2021年中国A股央企集团旗下已混改上市公司及其母公司数据,探讨了央企母公司混改对子公司创新产出的影响。研究发现,央企母公司混改促进了子公司创新产出。机制检验结果表明,母公司混改通过减少行政干预与缓解代理冲突促进了子公司创新产出。异质性分析结果显示,当地方政府放权意愿较高时,上述促进效应显著;当集团内部资本市场效率较高时,上述促进效应更明显。基于母子公司混改差异视角进一步分析发现,央企母公司混改程度低于子公司时会抑制子公司创新产出。因此,应进一步深化央企母公司混改,完善相关法规制度,促进央企混改提质增效。
