Pioneering a New Realm of Human Rights Civilization in the Chinese Path to Modernization——An Overview of the Symposium on“The Chinese Path to Modernization and the Promotion of Free and Comprehensive Human Development”

On October 14,2023,a symposium themed“The Chinese Path to Modernization and the Promotion of Free and Comprehensive Human Development”was held in Changchun,Jilin Province,China.More than fifty experts,scholars,and researchers from national institutions and universities engaged in discussions and exchanges on human rights on the Chinese path to modernization,including the path,practice,knowledge systems,and civilization forms of human rights.This symposium played a significant role in advancing the construction of the disciplinary system,academic system,and discourse system of human rights in China.

Human Rights Implications of the Civil Code of the People's Republic of China

Putting the people first in human rights protection is the most distinctive feature of the outlook on human rights in contemporary China. The codification of the Civil Code of the People’s Republic of China reflects the people’s legislation for themselves, which is guided by the principle of putting the people first in its external system and internal values. Functionally, the Civil Code of the People’s Republic of China reflects the obligation of the country to protect human rights, constructs the framework relationship between the country and individual people, and perfects the mechanism for human rights protection. The continuous expansion of the types, contents, and functions of civil rights in the Civil Code of the People’s Republic of China is required by the broad scope of human rights, with an aim to realize a happy life for the people, the most important human rights, and protect people’s personal rights, property rights, and right to dignity through specific rules. The universal sharing of human rights requires the universality of the subjects of civil rights. The equal sharing of human rights requires the equality of forms of civil rights protection. Meanwhile, it further requires the substantive equality of civil rights protection. Attention is paid to protecting the rights and interests of specific groups in external and embedded ways.

重写文明史:建构中国自主知识体系的底座

中国自古便有完整的哲学体系、文论体系、史学体系、艺术体系、教育体系、医学体系、科学技术体系以及其他各个学科的自主知识体系。然而,中国原有的自主知识体系在现当代基本上不被承认。这一问题的根源在文明观,文明观是基础,是自主知识体系的底座。近现代以来支撑各学科知识生产的标准、内涵、体系都建立在西方文明的底座上。文明底座是西方的,所构建的知识体系也就必然唯西是从,直接导致了对中国文明的贬低,对中国知识体系的全盘否定,形成了中国自主知识体系整体性的垮塌,走上了自毁长城之歧途。建构中国自主知识体系,首先要“重塑文明观”,重塑文明观则必须“重写文明史”,再从文明底座上建构哲学、史学、医学、科学技术等各个学科的自主知识体系,重获各学科知识体系本来的“话语权”,向世界呈现“理论中的中国”“创新中的中国”“文明中的中国”,建构自立自强的中国自主知识体系。

普遍服务义务及其私法实现——兼论《民法典》第494条内蕴的公法与私法关系

《民法典》第494条规定了三种强制缔约方式,其第2款为落实普遍服务义务最重要的私法措施。普遍服务义务的性质为最终由国家对公民承担的行政给付义务,并非市场主体的义务。其正当性源于技术革新和经济发展对“体面和有尊严的生活”的新要求、因国家职能变迁而兴起的“担保国家”观念、部分基础设施的自然垄断属性等。普遍服务义务的设置需厘定公私畛域,防范企业不当扩张自然垄断的范围,从而阻碍市场化进程。依我国现行法,特定企业承担的普遍服务义务为法定义务,并非其社会责任。我国有必要承认间接强制缔约理论,在所有公共事业领域类推适用电力、电信和邮政领域的普遍服务规范。普遍服务的义务人应获得基金补贴,而不应通过其业务获得交叉补贴。普遍服务义务的实现程度受经济能力和技术水平的双重限制,故强制要约义务原则上不宜强制履行;在强制承诺时,相对人的要约必须合理。违反强制承诺义务的,义务人应承担缔约义务,因此给对方造成损失的,应承担侵权责任。

《民法典》动产与权利担保制度的商法属性解释论

《民法典》第388条对功能主义担保立法模式的引入,使动产和权利统一担保体系具有了较为鲜明的商法属性。但囿于民商合一的立法体例,其商事元素大多隐藏在民事规范之下,不得彰显。现行担保体系对商事担保的特殊性及商事交易实践需求不能及时作出回应,对商事交易实践造成影响。故而民商合一的立法体例需通过法律适用在实质上实现一般化一体规制,特殊化区分规制的立场。对此,商法视角的引入极为必要。商事担保以效益优先为价值理念,以功能主义为底层逻辑,在制度设计上具有更多的商事元素。利用区分原则,对担保体系中的民商事担保规范进行区分、整合,以形成担保体系“形式民商合一,实质统分结合”的体例。同时,商法思维的适用应兼顾商事规范的个性及民事规范的稳定,从而对动产和权利统一担保体系的商法属性作出回应,以期促进商事金融的发展创新。

长期以来,中国的法治形象由西方“他者”的话语进行塑造,无法准确、完整地表达和阐释中国的法治实践。要“自塑”中国当代法治形象,关键是有效地传播中国的法治话语。《民法典》是“自塑”中国法治形象的重要话语资源,其术语系统是话语建构的基础。《民法典》的核心术语系统、权利术语系统、多源术语系统和文本术语系统分别呈现出语符表征性、知识系统性、概念丰富性和形态生成性的系统特征。这些术语系统特征从话语主题凸显、话语逻辑构建、话语内容充实和话语形态生成四个方面,对《民法典》话语体系的建构发挥了基础性作用,塑造了具备人文之性、系统之态、多彩之色和科学之形的中国当代法治形象。

交际术语学视域下法律术语翻译多维评价初探——兼评《民法典》术语英译问题

随着中国法治的发展,法律翻译的方向从输入为主转变为输入和输出并重,法律翻译的功能也由借鉴移植转变为传播和交流并重。当今,法律外译作为国际法治交往的重要媒介,影响着中国法治的国际传播效果和中国法治话语权的提高。本研究首先回顾我国法律术语翻译的准确性单一评价标准,揭示传统法律术语翻译标准反映的非交际性翻译问题。基于我国法律外译的法治交际现实需求,借鉴交际术语学的多维术语考察视角,阐释国际传播时代法律术语外译的跨语系、跨法系和跨文化的多维交际功能。从语符表征、概念构建和传播交际三个维度对《民法典》术语的英译进行多维评价,构建出适应国际传播时代需求的法律术语外译质量评价体系。
