Study on Transfer Problem of Contract and Management Right of Agricultural Land in Anhui Province

The status quo and significance of contract and management right transfer of rural land are analyzed,and major problems existed in contract and management right transfer of rural land in Anhui Province are studied,containing unsound transfer market,insufficient flow demand motion,single transfer form,non-standard register,right determination and certificate issuing. On this basis,several policies and suggestions are proposed,such as combining practical use with suitable use of land right determination and certificate issuing,establishing multilayer rural social security system and expanding land management range.

Research on Contract Management and Control in the Process of Project Cost

In the current economic situation, strengthening the contract management of the construction cost has a beautifully role. At the same time, according to construction project cost management, the scientific management of the contract, can promote the reasonable and balanced investment cost allocation in the quality and safety and other aspects of the project, so that the construction project can obtain higher added value, and to further promote China＇ s economic construction and accelerate the pace of the city. This paper first briefly elaborates our construction project cost of the contract management on the present situation, and some problems are analyzed and discussed, and then puts forward some suggestions on the measures and countermeasures for cost management of construction engineering contract.

Psychological Contract within Labor Relation and Its Management Strategy

The paper argues that labor contracts between employees and organization includes two facets, i.e. economic contracts and psychological contracts, and along with enterprise competition becoming fierce increasingly and labor force becoming diversified all the more, the psychological contracts have crucial effects on employees＇ attitudes, behaviors and performances. We also argue that, under the challenging organization context, if managers want to make strategic partnership with employees, they must link employees with hearts, pay attention to the management of psychological contracts before, during and after signing labor contracts, and keep dynamic equilibrium of psychological contracts.

Technical Management in Power Plant Constructionfor Export Contract

Regarding the technical management during construction of Thailand PTA Co-generation, there are some problems due to the typical method in electric power construction in China, which show the differences between international methods and ours. In order to do the technical management in the project for export contract, it is necessary to do the work based on the Contract, to know the related laws and regulations, and national conditions, to coordinate the relationship among various parties well, and to carry out the management ahead of time.

Risks and new transformations of PPP contracts

This paper tries to demonstrate that the principle of the risk allocation based on the balance is the most effective way to resolve the risk allocation problems of public-private partnership （PPP） contracts and presents suggestions how to carry out this principle. For PPP projects, it is necessary to set up a workable and commercially viable risk sharing mechanism to satisfy the different interests and the objectives of both the public sector and the private sector. An effective risk allocation mechanism is not only an important part in preparing project documents, but also an essential part in the success of PPP contracts. Risk allocation can be represented in a risk matrix. The more balanced the risk allocation is, the lower the risk degree of PPP contracts is. Therefore, the most effective risk allocation of PPP contracts is that the public sector and the private sector take part in risk management together in all the stages of the project and allocate the balanced risks. The outcomes of this paper can be used by both the public sector and the private sector to make a good choice of the PPP contract form.

The Role of the Outsourcing Contract From a Partnership-based Perspective

The definition of relational contents which outsourcer and outsourcee arrange and formalize inside a contract is one of the critical success factors of the outsourcing choice. The contract criticality is greater if the outsourcing aim is made of highly strategic activities, functions, or processes and if the real aim is not the cost saving but the sharing of added value resources, skills, and knowledge. That is, this paper aims to provide some conceptual insights about the role of the contract with a specific reference to the strategic outsourcing, which is the kind of outsourcing where the relationship between the outsourcer and outsourcee is set inside the ＂partnership-based＂ logic. In particular the remarks proposed concern the role of the contract as a tool to face the risk and manage the relationship.

Some suggestions are also advanced for companies to prompt involvement management and gain advantages.

A Benefit Measurement Framework for an Online Contract Change Management System

The contract change management (CCM) system is an online collaboration tool, which supports the contract change management process of new engineering contract (NEC) contract. It is currently used in practice on a wide range of civil, power, and building projects in the UK. The aim of this study is first to identify the tangible and intangible benefits of the system through a user survey; then to develop a framework to measure these benefits. A questionnaire survey is conducted, which reveals that CCM can help project teams improve process effectiveness, reduce risk of process failures, and increase the compliance with NEC requirements. Subsequently, a spreadsheet tool is developed to allow CCM users to calculate the tangible cost savings as a result of using the system. For intangible benefits, a change management maturity model (CM3) is developed, which provides a measurement framework for assessing the improvement of a project team’s capability in dealing with contract changes.

Agricultural Land Contract and Management Rights:Transferring Price and Countermeasures in Typical Agricultural Areas of China

Henan is a large agricultural province and one of China’s major grain-producing areas. Agricultural land transfer and large-scale operations will have a profound impact on regional economic development and food security. This is a case study taken in Xiwan village in Qinyang city, Henan. This paper builds a transferring pricing model using land use rights assessment and characteristic correction of land contract and management rights. Results show that the transferring price of land contract and management rights should include the economic price, social price and corrected price. The use of a price model should focus on the distinction of theory and practical application. If there is no change in agricultural project,the actual transferring price should be the sum of the economic price and social security price. If there is a change in agricultural projects,such as cropland into cash crops,the actual transferring price should be the sum of the economic price, social price and corrected price. Because of the complexity of income distribution following the transfer, transferring gains should follow a rational distribution in the outflow side, inflow side, managers and land owner. The government should establish reasonable and orderly contracted management of land circulation transferring and use this to build a land transferring price system.

Assessment of Performance Based Road Maintenance Practices in Nepal

Roads are the major asset of any country and to conserve them maintenance is essential. The delay of maintenance works can lead the road in the stage of expensive rehabilitation and reconstruction. In Nepal, Department of Roads (DoR) is responsible for maintenance of strategic roads of country. The maintenance practice of the road under Department of Road is predominantly based on Strengthen Maintenance Division Process where several maintenance activities like Routine maintenance, Recurrent Maintenance, Periodic Maintenance and Emergency Maintenance are planned and carried out. The maintenance work is based on traditional quantity and unit price based short term maintenance contracts, where maintenance of physical works is outsourced. Client demands the contractor what work is to be done, when to be do it and the extent of the work. The contractor is paid on the basis of a defined output or quantity accomplished, and the schedule of the rates. DoR engineers required full time supervision of work. Pilot based performance based maintenance practice of road started in Nepal in 2003. The study assesses performance road maintenance practices of road maintenance in Nepal on the basis of the framework of cost efficiency, level of service effectiveness and quality of service. The study concluded that implementation of Performance Based Maintenance Contract (PBMC) was not successful in Nepal as Road Asset condition was not maintained to performance standard. One of the reasons is the weak service delivery of contractor alongside weak contract enforcement from the road agency.

Excess Benefit Allocation in Shared Savings Based on Non-cooperative Game Theory

Energy saving income distribution mode is of great significance to the energy industry.With the continuous application of new technologies,the problem of excess energy saving income distribution has become one of the obstacles to the appreciation of energy performance.At present,the distribution of risk and income is mainly based on the contribution of risk and income,which has some limitations.The benefit distribution of energy saving negotiation between energy saving service companies and clients can be regarded as a bargaining process where an effective range satisfying both parties can be obtained.This provides a new perspective in solving the problem of excess energy saving income distribution in energy management contract projects.

The outlook of blockchain technology for construction engineering management

Current construction engineering management suffers numerous challenges in terms of the trust,information sharing, and process automation. Blockchain which is a decentralised transaction and data management technology, has attracted increasing interests from both academic and industrial aspects since 2008. However,most of the existing research and practices are focused on the blockchain itself(i.e. technical challenges and limitations) or its applications in the finance service sector(i.e.Bitcoin). This paper aims to investigate the potential of applying blockchain technology in the construction sector.Three types of blockchain-enabled applications are proposed to improve the current processes of contract management, supply chain management, and equipment leasing, respectively. Challenges of blockchain implementation are also discussed in this paper.
