Deference or Proportionality: Two Concepts of Margin of Appreciation in the Strasbourg Court and Their Influences

Since its first reference in the case of Greece vs. UK, the meaning of this doctrine has evolved from deference to derogation from the European ... The margin of appreciation is controversial and difficult to understand. Since its first reference in the case of Greece vs. UK, the meaning of this doctrine has evolved from deference to derogation from the European Convention to an inflation of language used or misused by the Strasbourg Court to preserve the State's 'room for manoeuvre' or 'latitude of deference or error.' In this paper, I divide the concept of margin of appreciation into two categories: the substantive and structural concept. The Strasbourg Court usually generously defers to national decisions in structural scrutiny where it has to respect European pluralism and the collective interests of the contracting parties unless domestic decisions are regarded as 'manifestly unreasonable.' In contrast, the European Human Rights Court scrutinizes carefully in the substantive sense of margin of appreciation. Some factors or test approaches will be identified first, by which the Court substantively narrows or limits the scope of margin preserved for the States. The result of two conceptual margins of appreciation may be reciprocally transformed in some circumstances. When the collective good surely undermines the core of Convention rights, the Court will not stand with the domestic argument since it must ensure the implementation of pan-European human rights standards. On the other side, the Court has no capacity to further increase strict scrutiny in cases where there is a complicated relationship between the means and ends in the proportionality test, implying that domestic courts are better placed than the supranational court given the fact that they know better the local reality and have more local knowledge. 展开更多

Self-Coexistence Among Cognitive Radio Networks Using Risk-Motivated Channel Selection Based Deference Structure 被引量:1

Among cognitive radio networks there is a persistent trend of competition to acquire under-utilized and idle channels for data transmission. The competition for spectrum resources often results in the misuse of the spectrum resources as networks experience contention in attempt to access unoccupied spectrum bands. The competitive scenario causes cognitive radio networks to incur a huge amount of loss, which constitutes a major problem of self-coexistence among networks. As a way to minimize these losses we present a self-coexistence mechanism that allows cognitive radio networks to coexist with each other by implementing a risk-motivated channel selection based on deference structure. Cognitive radio networks form deference structure community to have more efficient access to a channel of interest and can defer transmission to one another on that channel, thereby minimizing the chances of conflicts. As part of the decision making process to become a member of a deference structure community, cognitive radio networks rely on a risk-motivated channel selection scheme to evaluate the tentative deference structure channel. We provide numerical and simulation results that demonstrates the benefits of the proposed self-coexistence mechanism and show how it helps networks to coordinate their spectrum activities, minimize contention experienced and improve their utility. We also emphasize on the importance of the deference structure community size with regards to the average performance of member networks. 展开更多

Due to the coupling between the hydrodynamic equation and the phase-field equation in two-phase incompressible flows,it is desirable to develop efficient and high-order accurate numerical schemes that can decouple these two equations.One popular and efficient strategy is to add an explicit stabilizing term to the convective velocity in the phase-field equation to decouple them.The resulting schemes are only first-order accurate in time,and it seems extremely difficult to generalize the idea of stabilization to the second-order or higher version.In this paper,we employ the spectral deferred correction method to improve the temporal accuracy,based on the first-order decoupled and energy-stable scheme constructed by the stabilization idea.The novelty lies in how the decoupling and linear implicit properties are maintained to improve the efficiency.Within the framework of the spatially discretized local discontinuous Galerkin method,the resulting numerical schemes are fully decoupled,efficient,and high-order accurate in both time and space.Numerical experiments are performed to validate the high-order accuracy and efficiency of the methods for solving phase-field models of two-phase incompressible flows. 展开更多

In this paper,we explore bound preserving and high-order accurate local discontinuous Galerkin(LDG)schemes to solve a class of chemotaxis models,including the classical Keller-Segel(KS)model and two other density-dependent problems.We use the convex splitting method,the variant energy quadratization method,and the scalar auxiliary variable method coupled with the LDG method to construct first-order temporal accurate schemes based on the gradient flow structure of the models.These semi-implicit schemes are decoupled,energy stable,and can be extended to high accuracy schemes using the semi-implicit spectral deferred correction method.Many bound preserving DG discretizations are only worked on explicit time integration methods and are difficult to get high-order accuracy.To overcome these difficulties,we use the Lagrange multipliers to enforce the implicit or semi-implicit LDG schemes to satisfy the bound constraints at each time step.This bound preserving limiter results in the Karush-Kuhn-Tucker condition,which can be solved by an efficient active set semi-smooth Newton method.Various numerical experiments illustrate the high-order accuracy and the effect of bound preserving. 展开更多

In this paper,we investigate the peaking issue of extended state observers and the anti-disturbance control problem of tethered aircraft systems subject to the unstable flight of the main aircraft,airflow disturbances and deferred output constraints.Independent of exact initial values,a modified extended state observer is constructed from a shifting function such that not only the peaking issue inherently in the observer is circumvented completely but also the accurate estimation of the lumped disturbance is guaranteed.Meanwhile,to deal with deferred output constraints,an improved output constrained controller is employed by integrating the shifting function into the barrier Lyapunov function.Then,by combining the modified observer and the improved controller,an anti-disturbance control scheme is presented,which ensures that the outputs with any bounded initial conditions satisfy the constraints after a pre-specified finite time,and the tethered aircraft tracks the desired trajectory accurately.Finally,both a theoretical proof and simulation results verify the effectiveness of the proposed control scheme. 展开更多

In arid and semi-arid regions consumptive use is the best index for irrigation requirements. A large part of the irrigation water applied to farm land is consumed by Evapotranspiration (ET). Irrigation water consumption under each of the physical and climatic conditions for large scale will be easier with remote sensing techniques. In Egypt, Agricultural cycle is often tow agricultural seasons yearly;summer and winter. Common summer crops are Maize, Rice and Cotton while common winter crops are Clover and Wheat. Landsat8 bands 4 and 5 provide Red (R) and Near Infra-Red (NIR) measurements and it used to calculate Normalized Deference Vegetation Index (NDVI) and monitoring cultivated areas. The cultivated land area was 3,277,311 ha in August 2013. In this paper Kc = 2 * NDVI ? 0.2 represents the relation between crop coefficient (Kc) and NDVI. Kc and Reference evapotranspiration (ETo) used to estimate ETc in Egypt. Objective: To characterize the bacteriocin-like inhibitory-substances(BLIS) activity of Streptococcus macedonicus MBF10-2 [named BLIS(MBF10-2)], a bacteriocinogenic strain isolated from an Indonesian tofu byproduct.Methods: BLIS(MBF10-2) was obtained by culturing the bacterium, and standard deferred antagonism assays were used to demonstrate its activity. The antibacterial testing of fractions collected by filtration using 3–30 kDa cut-off membrane sizes were carried out by performing well diffusion method.Results: The growth of Micrococcus luteus, Streptococcus pyogenes, Lactococcus lactis,Leuconostoc mesenteroides and Weissella confusa were inhibited by BLIS(MBF10-2).Interestingly, BLIS-containing fractions obtained from sequential application on ultrafiltration membranes indicated that this bacterium Streptococcus macedonicus MBF10-2 could produces at least two antimicrobial peptides activities, one of which is likely to be a lantibiotic peptide. Potential synergistic activity against certain Gram-positive(but not Gram-negative) species when partnered with antibiotics(ampicillin, tetracycline or kanamycin) were observed.Conclusion: Combination of some BLIS(MBF10-2) active fractions with antibiotics(ampicillin, tetracycline or kanamycin) could demonstrate synergistic activities against certain Gram-positive species. 展开更多

We present a computational gas dynamics method based on the Spectral Deferred Corrections (SDC) time integration technique and the Piecewise Parabolic Method (PPM) finite volume method. The PPM framework is used to define edge-averaged quantities, which are then used to evaluate numerical flux functions. The SDC technique is used to integrate solution in time. This kind of approach was first taken by Anita et al in [1]. However, [1] is problematic when it is implemented to certain shock problems. Here we propose significant improvements to [1]. The method is fourth order (both in space and time) for smooth flows, and provides highly resolved discontinuous solutions. We tested the method by solving variety of problems. Results indicate that the fourth order of accuracy in both space and time has been achieved when the flow is smooth. Results also demonstrate the shock capturing ability of the method. 展开更多

In recent years, image-based anti-aliasing techniques have been widely investigated in real-time computer graphics. Compared to traditional routine of anti-aliasing, image-based methods, which combined with deferred shading, can efficiently decouple anti-aliasing step from standard graphics pipeline. However, most of the existing image-based methods consume video memory, bandwidth and computation resources heavily. In this paper, we propose an optimized anti-aliasing method, which can efficiently reduce the multi-sampling rate by a multi-sampling mask. We carefully designed the rendering system to avoid serial execution on branch divergence, by utilizing both modern GPU’s features and latest shader model. Experimental results demonstrate that our method can achieve high-quality synthesized image with real-time performance. 展开更多

The problem of capacity shortage in some airports needs to be dealt with sustainable solutions including a more efficient use of the existing runway slots at the airports. The Collaborative Decision Making(CDM) is an important approach applied to Air Traffic Management(ATM)to achieve this efficient use of the slots allocation. Using the Matching approach for two-sided markets of Game theory, the Top Trading Cycle CDM(TTC-CDM) algorithm developed in this research is an extension of the CDM approach aggregating the Ground Delay Program(GDP)of the air sector. The paper compared the developed TTC-CDM model to the existing models such as the conventional Compression algorithm in CDM, the Trade Cycle algorithm and the Deferred Acceptance CDM(DA-CDM) model to evaluate the performance of the proposed model. Through a case study, the results show the effective application of TTC-CDM model to slot allocation in ATM and also presents the advantage of considering the preferences of airport managers beside ATC controllers and airlines in the decision processing. 展开更多

In this paper, we present a local discontinuous Galerkin (LDG) method for the AllenCahn equation. We prove the energy stability, analyze the optimal convergence rate of k + 1 in L2 norm and present the (2k+1)-th order negative-norm estimate of the semi- discrete LDG method for the Allen-Cahn equation with smooth solution. To relax the severe time step restriction of explicit time marching methods, we construct a first order semi-implicit scheme based on the convex splitting principle of the discrete Allen-Cahn energy and prove the corresponding unconditional energy stability. To achieve high order temporal accuracy, we employ the semi-implicit spectral deferred correction (SDC) method. Combining with the unconditionally stable convex splitting scheme, the SDC method can be high order accurate and stable in our numerical tests. To enhance the efficiency of the proposed methods, the multigrid solver is adapted to solve the resulting nonlinear algebraic systems. Numerical studies are presented to confirm that we can achieve optimal accuracy of (O(hk+1) in L2 norm and improve the LDG solution from (O(hk+1) to (O(h2k+1) with the accuracy enhancement post-processing technique. 展开更多

In this paper,we will develop a first order and a second order convex splitting,and a first order linear energy stable fully discrete local discontinuous Galerkin(LDG)methods for the modified phase field crystal(MPFC)equation.In which,the first order linear scheme is based on the invariant energy quadratization approach.The MPFC equation is a damped wave equation,and to preserve an energy stability,it is necessary to introduce a pseudo energy,which all increase the difficulty of constructing numerical methods comparing with the phase field crystal(PFC)equation.Due to the severe time step restriction of explicit timemarchingmethods,we introduce the first order and second order semi-implicit schemes,which are proved to be unconditionally energy stable.In order to improve the temporal accuracy,the semi-implicit spectral deferred correction(SDC)method combining with the first order convex splitting scheme is employed.Numerical simulations of the MPFC equation always need long time to reach steady state,and then adaptive time-stepping method is necessary and of paramount importance.The schemes at the implicit time level are linear or nonlinear and we solve them by multigrid solver.Numerical experiments of the accuracy and long time simulations are presented demonstrating the capability and efficiency of the proposed methods,and the effectiveness of the adaptive time-stepping strategy. 展开更多

This paper presents a high order time discretization method by combining the semi-implicit spectral deferred correction method with energy stable linear schemes to simulate a series of phase field problems.We start with the linear scheme,which is based on the invariant energy quadratization approach and is proved to be linear unconditionally energy stable.The scheme also takes advantage of avoiding nonlinear iteration and the restriction of time step to guarantee the nonlinear system uniquely solvable.Moreover,the scheme leads to linear algebraic system to solve at each iteration,and we employ the multigrid solver to solve it efficiently.Numerical re-sults are given to illustrate that the combination of local discontinuous Galerkin(LDG)spatial discretization and the high order temporal scheme is a practical,accurate and efficient simulation tool when solving phase field problems.Namely,we can obtain high order accuracy in both time and space by solving some simple linear algebraic equations. 展开更多

This paper focuses on the leader-following consensus control problem for nonlinear multiagent systems subject to deferred asymmetric time-varying state constraints.A distributed eventtriggered adaptive neural control approach is advanced.By virtue of a distributed sliding-mode estimator,the leader-following consensus control problem is converted into multiple simplified tracking control problems.Afterwards,a shifting function is utilized to transform the error variables such that the initial tracking condition can be totally unknown and the state constraints can be imposed at a specified time instant.Meanwhile,the deferred asymmetric time-varying full state constraints are addressed by a class of asymmetric barrier Lyapunov function.In order to reduce the burden of communication,a relative threshold event-triggered mechanism is incorporated into controller and Zeno behavior is excluded.Based on Lyapunov stability theorem,all closed-loop signals are proved to be semi-globally uniformly ultimately bounded.Finally,a practical simulation example is given to verify the presented control scheme. 展开更多

In this paper,a high-accuracy numerical scheme is developed for long-time dynamic simulations of 2D and 3D wave propagation phenomena.In the derivation of the present approach,the second order time derivative of the physical quantity in the wave equation is treated as a substitution variable.Based on the temporal discretization with the Krylov deferred correction(KDC)technique,the original wave problem is then converted into the modified Helmholtz equation.The transformed boundary value problem(BVP)in space is efficiently simulated by using the meshless generalized finite difference method(GFDM)with Taylor series after truncating the second and fourth order approximations.The developed scheme is finally verified by four numerical experiments including cases with complicated domains or the temporally piecewise defined source function.Numerical results match with the analytical solutions and results by the COMSOL software,which demonstrates that the developed KDC-GFDM can allow large time-step sizes for wave propagation problems in longtime intervals. 展开更多
