Rule of law education in primary and secondary schools is an educational process to popularize legal knowledge,establish legal awareness,and cultivate the ability to respect,abide by,and use the law for the special group of primary and secondary school students.The research found that rule of law education in primary and secondary schools in Chaoshan has yielded positive outcomes.However,there exist problems such as uneven synergy,incomplete inclusion of teachers and students,shortage of adequately trained professional teachers,and the need for enhanced organizational support.The relevance and effectiveness of rule of law education in primary and secondary schools will be enhanced by clarifying the target tasks,enhancing the effectiveness of the classroom,creating an atmosphere of the rule of law,and strengthening organizational support. 展开更多

With the advent of the learning age,the connotation of the“right to education”can no longer meet the requirements of personal and social development,so it is necessary to introduce the concept of the right to learn with a richer connotation.As a basic human right,the proposal and guarantee of the right to learn directly respond to the practical problems in the information age and the learning age.The right to learn is fundamental freedom enjoyed by everyone to acquire useful knowledge,skill,value,spirit,and attitude through reading,watching,listening,thinking,researching,practicing,being educated,and other learning methods to develop and perfect a personality.The philosophical basis,connotation,attribute,extraterritorial legislative guarantee of the right to learn and the development of the times de termine it should be regarded as a basic human right.Treating the right to learn as a basic human right and systematically guaranteeing it through the amendment of China’s Education Law and other supporting legislation will contribute to the realization of this right,the improvement of national knowledge,and the progress of China’s social civilization. 展开更多

The educational function of law is to inherently and positively standardize and institutionalize core ideologies and values by directly affecting those ideologies,incorporating the outlook on values,ethics,life and honor and disgrace.The purpose of the Legislative Revision Plan of Integrating the Core Socialist Values into the Construction of Rule of Law,adopted by China's central government in 2018,is to comprehensively strengthen the educational function of law under the guidance of the socialist core values within the entire socialist legal system,to consolidate a solid socialist ideological foundation,and to improve ideology and ethics across China.As a family is the cell of a society and the first classroom of life,family value is not only at the core of a family but also an essential part of a society.The legal system relating to family property,based on the family property system and spousal inheritance right,can rationally adjust the family property relationship;this system can combine,cultivate and carry forward socialist core values,guide and cultivate ethics,and promote family values,family culture and family traditions.Moreover,it can educate people to formulate an appropriate outlook on life,values and money and sense of honor.Today,the legal system of family property,such as the joint possession of marital incomes and the unlimited right to spousal inheritance,has shown a negative effect on educational function,since it was born during the period of the relative shortage of family property in the past.Therefore,the Civil Code should follow the socialist core values,and update and innovate the family property legal system and thereby provide an effective and efficient path to rectify the hitherto negative effect on educational function of the family property legal system. 展开更多

Because of the massive expansion in enrollment, the number of graduates from law schools across the country is unprecedented, but the rate of unemployment is also unprecedented in comparison with the graduation. In stark contrast, many employees are finding it difficult to find graduates of talent fitting directly to working requirements. The traditional mode of education is to cultivate students with legal research abilities, but the main social need calls for graduates who are prepared to practice, which has caused the low employment. As a result, the graduates' failure to meet the social demand caused serious imbalance between supply and demand. The characteristic of legal practice skills is to solve practical problems through the practice of adapting legal knowledge, but practical skill training in law school education now is basically nonexistent. The training of legal practice skills must be conducted through aspects of course design, and therefore teaching methods necessitate comprehensive reformation. The practice skills of the legal profession, such as basic literacy, basic skills, and work skills, are indispensable to the education of students. Educating them to attain these skills will aid them directly in practical work after graduation, improve their work quality and employment rate, and consequently improve the whole overall quality of the legal profession. 展开更多
