Building International Consensus and Working Together to Advance the Development of the Global Human Rights Cause—Summary of Academic Views at the Forum on Global Human Rights Governance

On June 14-15,2023,the Forum on Global Human Rights Governance,jointly hosted by the State Council Information Office,the Ministry of Foreign Affairs,and the China International Development Cooperation Agency,was held in Beijing under the theme of“Equality,Cooperation and Development:The 30th Anniversary of the Vienna Declaration and Programme of Action and Global Human Rights Governance.”Participants conducted in-depth discussions and exchanges on topics such as“International Cooperation and Global Human Rights Governance,”“Global Development Initiative and the Realization of the Right to Development”,“Global Security Initiative and Human Rights Protection,”“UN Human Rights Mechanisms and Global Human Rights Governance,”and“Human Rights Protection in the Digital Age.”The event helped build international consensus and yielded fruitful achievements.

China’s international human rights cooperation and exchanges from 2010 to 2020 have the following main characteristics: China’s cooperation with United Nations multilateral human rights institutions is the main part of China’s international human rights cooperation and exchanges China has been deeply involved in cooperation with UN multilateral human rights agencies and is playing an increasingly important role in them Bilateral human rights dialogues are the main focus of China’s bilateral human rights cooperation and exchanges, and in recent years the objects of the human rights dialogue have been expanding In addition to the official level of multilateral and bilateral human rights cooperation and exchanges, the Chinese government also encourages human rights organizations to actively participate in the international human rights exchanges and makes those organizations play an increasingly important role in international human rights exchanges The Chinese human rights organizations also develop innovative ways for international human rights exchanges and become an important channel for the international community to understand the ideas and situation of human rights protection in China.

The global outbreak of COVID-19 has posed a great challenge to the human rights protection.On May 18,2020,the second session of the series of international seminars on"Global Pandemic Prevention and Control and Human Rights Protection",organized by the Institute of Human Rights of China University of Political Science and Law under the guidance of the China Society for Human Rights Studies,was held online.The seminar was themed on the Concept of Building a Community with a Shared Future for Human Beings and International Cooperation on Pandemic Prevention and Control."Through the seminr,Chinese and foreign experts discussed in depth the values of human rights theories,the specific practices and measures taken by China and the European Union in fighting COVID-19,the protection of human rights in emergencies and the issue of human rights derogation.The seminar delivered a general consensus that prejudice should be abandoned in public health emergencies and international cooperation is continuously promoted within the framework of the United Nations to build a community with a shared future for human beings.

International Cooperation and Human Rights Protection in the Fight against the COVID-19 Pandemic

The protection of human rights through international cooperation has a long history.Core human rights conventions,regional human rights treaties and other human rights instruments have continuously developed the meaning and scope of international human rights cooperation.The modern risk-laden society with a high degree of complexity and uncertainty has changed the world pattern,which calls for the building of a community with a shared future for human beings with cooperation as the starting point.Under the constant threat of the novel coronavirus,we must continue to deepen the concept of a community with a shared future for human beings,adhere to a“human rights-oriented”approach,and pay particular attention to the current supply and distribution of the COVID-19 vaccine as an important global public good.Only through solidarity and cooperation can mankind finally win the battle against this pandemic and protect human rights.

Reform and Opening-up and China's Participation in International Human Rights Cooperation Process

The process of China’s participation in international human rights cooperation is closely related to the process of reform and opening-up launched at the end of the 1970s, while participation in international human rights cooperation is based on the process of reform and opening-up. It is the fruit of the reform and opening-up policy and the emancipation of the mind for China to decide to participate in international human rights cooperation. Since then, along with the process, the process of China participating in international cooperation can be divided into four periods. The first established the multi-ministries cooperative group to do research on international human rights activities in 1980. The second, was the first white paper on human rights published by the government in 1991. The third was the incorporation of human rights in the Constitution in 2004, and the fourth been putting forward the idea "a community with shared future for human beings" in 2013. All of these are landmark events for China to participate in international human rights cooperation against the general background of the reform and opening-up policy.

Summary of the Seminar Commemorating the 30^(th) Anniversary of the Release of the White Paper Entitled Human Rights in China

On November 1,1991,the State Council Information Office of the People’s Republic of China issued its first white paper entitled Human Rights in China.In the past 30 years,China’s human rights cause has developed rapidly,and relevant theoretical research has been continuously improved.On October 15,2021,the Seminar Commemorating the 30;Anniversary of the Release of the White Paper Entitled Human Rights in China was held in Beijing.It focused on three topics:the theoretical significance of the white paper,its discourse building and its practice.The meeting held that the Chinese human rights philosophy emphasized in the white paper is in line with China’s national conditions and development path philosophy,and is a typical achievement of adapting Marxism to Chinese conditions.Over the past 30 years since the release of this white paper,China’s human rights cause has completed the basic work of theoretical building and path exploration,and meanwhile,China has established a human rights discourse system and human rights protection system in line with China’s history and development stage,participated in global human rights cooperation,and contributed Chinese wisdom to the advancement of the world’s human rights cause.

联合国人权公约缔约国报告制度述评

缔约国报告制度是联合国人权公约监督实施的主要手段,是一种通过寻求人权国际保护与国家主权之间的平衡,从而促使缔约国履行尊重和保护人权的有效手段。缔约国报告制度的主要特征是独立专家机构通过接受,审查缔约国提交的报告,与缔约国建立建设性对话关系,从而促使缔约国履行人权公约规定的义务。缔约国报告制度从产生发展到今天,其运行存在一定问题,主要原因是国家没有正确认识这种监督实施措施的性质,正确处理人权国际保护与国家主权之间的关系。国际社会应该对缔约国报告制度进一步改革,国家应该增强与国际社会合作的意愿。联合国人权公约缔约国报告制度才能充分发挥其监督作用。

人权的历史维度与社会维度

在进行人权研讨和分析的过程中,需要高度重视历史发展与社会环境的时空维度。强调人权的历史维度,就是要关注人权与历史的密切关系,而不是将人权视为一种无涉历史的超验概念。而强调人权的社会维度,则意味着应该充分重视人权与社会生活、文化场景的关系,从文明演进和发展的角度看待人权,而非将人权简单地看成一个普适的理念和制度。强调人权的历史维度和社会维度,标志着不同的人权理念、观点、制度规范与实践方式之间应平等看待、充分交流,避免观念与实践之间的傲慢与偏见,以动态发展的态度评价人权的制度实践与国际运行,在人类命运共同困境与风险的前提下思考人权的国际化进程,以积极建设的态度促进人权事业的共同发展。

论人权保护对反腐败国际合作的价值

腐败是对人权的侵犯,拒绝腐败应该被视为一项基本人权。但目前国际反腐败合作机制普遍没有确认这一基本原则,这导致国际反腐败国际合作机制的表面化和缺乏深层次内容。建议国际反腐败合作机制承认腐败是对人权的侵犯、拒绝腐败是一项基本人权,这样将给与国际法与国内法更重的约束力量,在公共政策中增加反腐败的重要性;可以改变对于腐败的公共态度;同时会带来新的行动可能,尤其是可以使用现存的国家的、区域性的以及国际的监督人权履行状况的机制来遏制腐败行为;对于腐败的治理也将提供更多的路径。

人权是人类社会发展到较高级阶段,人类自我意识提高的必然产物,“人权”概念的出现和人权的发展都离不开国家主权,主权原则既是人权国内管辖和国际保护的依据,又是人权领域开展国际合作的基本条件,主权是人权保护的基础。

联合国人权领域的技术援助和能力建设活动始于上世纪中叶,长期以来帮助各国特别是在保护人权方面遇到困难的国家克服障碍、提高其行动能力和人权享受水平。联合国人权机制与各国在实践中遵守相关程序与原则,自愿申请与平等协商是联合国这一领域活动的援助基础,彼此尊重与合作交流是其必要形式,多方受益与互利共赢是其追求目标。总结联合国人权技术援助和能力建设的实践,推广其正面做法与原则,无论是对今天维护与尊重人权的国际努力,还是对未来国际人权活动的健康发展,均十分必要。中国支持和参与联合国这一领域活动,并为之作出贡献。2018年3月23日,中国在联合国人权理事会提出题为“在人权领域促进合作共赢”的第37/23号决议,获得会议通过。
