This paper analyses the status quo of migrant workers' lack of cultural rights and interests as follows:the holistic cultural life of migrant workers is scant and monotonous;the cultural facilities provided by the majority of enterprises are critically short;the cultural life of migrant workers has the characteristic of closeness to some extent;the holistic cultural consuming capacity of migrant workers is very low,and they are not satisfied with their own cultural life.This paper puts forward the measures that the government should adopt to make up for the lack of migrant workers' cultural rights and interests as follows:first,it should eliminate discrimination in terms of system,and incorporate migrant workers' cultural rights and interests into the building scope of urban public culture;second,it should establish a variety of free public culture facilities,to adapt to the needs of migrant workers;third,it should formulate various kinds of laws and regulations,to effectively safeguard migrant workers' cultural rights and interests.

Safeguarding Farmer Workers' Rights and Interests——An interview with Ye Jingyi, professor of Beijing University Law School

Farmer workers are a new powerful workforce that has sprung up amid China＇s reform and door opening and in the process of the country＇s industrialization and urbanization. They have made great contributions to urban prosperity, rural development and their country＇s modernization. At present, however, farmer workers face numerous difficulties and problems in income, work safety, social security, vocational training, the schooling of their children and living conditions. To safeguard the legitimate rights and interests of farmer workers, the State Council in March 2006 issued Ideas of the State Council on Solving Farmer Workers-related Problems. In the document, the State Council promises to strengthen and improve leadership over work regarding farmer workers and prioritize the solving of farmer workers-related problems.

Chinese Trade Unions Strive to Protect Workers' Rights and Interests in Dealing with the Global Financial Crisis

Protecting the rights and interests of workers and staff members constitutes an important aspect of China＇s human rights protection. At the time when the country is dealing with impacts of the global financial crisis, the All-China Federation of Trade Unions has been working fruitfully and effectively to accelerate economic and social development and safeguard the legitimate rights and interests of workers, therefore making contributions to the protection of the rights and interests of Chinese workers. Zhejiang Keen to Protect Migrant Workers' Rights and Interests

EDITOR＇S NOTE： FoUowing are some of the stories about how migrant workers＇ rights and interests are protected in Zhejiang, one of the best developed province on the Chinese mainland. Through interviews with more than 100 migrant workers in the province, we found that migrant workers there enjoy equal treatment as their counterparts registered as urban residents, and that their rights and interests are effectively protected.

“两栖”背景下农民工福利提升:农村与城镇协同保障的路径

在农民工“农村户籍、城市生活”的“两栖”状态下,发挥农村和城镇两类保障的协同作用在提升农民工福利和对高质量实现城镇化、扎实推进共同富裕方面具有重要意义。本文按照“功能与能力—主观感受—城镇机会”的思路构建农民工福利衡量指标,采用“农民工市民化课题组”的微观调研数据,考察了农村集体权益对农民工福利的影响,以及城镇保障在其中的调节作用。研究结果表明,农村集体权益能显著促进农民工福利,使用工具变量法缓解内生性结果依然稳健。值得注意的是,农民工的城镇保障在农村集体权益与福利关系中具有调节作用,以城镇保险、城镇住房和城镇就业为代表的城镇保障,均能够弱化农村集体权益促进农民工福利的作用,城镇保障替代农村保障提升农民工福利。在农民工“两栖”的现阶段,本文的研究结论为发挥农村保障与城镇保障的协同作用,提升农民工福利,提供了微观层面的经验证据。研究结论对农民工顺利从农村保障过渡到城镇保障,对国家高质量实现新型城镇化和共同富裕有重要的参考价值。

Probe into liquidated damages and dismissal wage in Labor Contract Law

《劳动合同法》在立法过程中引起了劳动者、用人单位的广泛关注。从最终的立法文本中我们看到了诸多的制度创新，分析这些制度创新对于充分理解和贯彻执行《劳动合同法》具有重要的意义。本文将结合劳动合同法的立法理念对新确立的合同违约金制度和劳动补偿金制度进行分析，并提出今后完善立法的几点建议。

论数据资源持有权:个体与社会双重视角下的限制

在数据成为关键生产要素的背景下,数据资源持有权在数字经济中具有重要意义。基于数据处理流程,数据资源持有权的客体被限定为合法取得的原始数据,不包括经过进一步加工的数据集合。数据资源持有权实现方式包括有限控制的持有、有限范围的收益和方式受限的处分。权利实现方式受到双重限制。在个体层面,个体同意是数据资源持有权实施的基础,商业秘密和数据来源者权利是权利实施的边界。在社会层面,竞争法和合理使用原则限制数据资源持有权,竞争法约束权利以维护市场公平竞争,合理使用原则平衡数据持有者与公众利益,其适用条件包括非商业性利用、科研教育及公益研究。

农民环境权益保护问题探析

农民环境权益至关重要,关乎人们的生命健康、农业的可持续发展以及社会的和谐稳定。本文通过分析当前我国农民环境权益保护方面存在的主要问题,提出要健全农村环保法律体系、增强农民环保维权意识、强化环保部门的监管作用以及完善司法救济制度四个方面的对策建议,为进一步加强农民环境权益保护,实现农村环境正义提供思路和借鉴。

劳动关系微分化视角下网约工劳动权益的法律保障

在算法技术与平台经济相得益彰共同推进数字经济向纵深方向发展的过程中,劳动关系日益呈现出微分化的演化趋势,使得以网约工为代表的新业态从业人员陷入了“身份不明确”的主体性危机与“权益保障难”的双重困境,不仅对传统的劳动从属基础性理论提出了新的挑战,而且也日益凸显现行法律制度供给不足的现状。基于网约工群体经济从属性、人格从属性与组织从属性微分化趋势之系统理论分析,科学审视与证成微分化视阈下具有劳动从属性的网约工“第三类劳动者”之身份,并将“内在经济与人格从属程度的差距均以外在劳动量的差别为表现形式”这一从属性微分化之核心作为识别与判定标准,对具有不同强度从属性的“第三类劳动者”给予不同程度的劳动法倾斜保护,希冀能平衡平台经济有序发展与网约工劳动权益合法保障之间的关系,为健全和完善我国劳动法律制度体系提供符合数字经济内在运行规律的科学立法选择。

数据产权刑法保护模式的构建

数据产权是一种具有财产权属性的新型权利,该权利与虚拟财产权和知识产权具有明显差异。数据产权属于刑法保护的公法益范畴,其应归属于市场经济秩序法益之中。现行刑法有关财产犯罪、知识产权犯罪和数据犯罪的规定均无法实现对数据产权的全面保护。刑法对数据产权的保护应以促进数据流通为主要目标,且应当覆盖数据处理的各流程阶段。对侵犯数据产权行为进行刑法规制时,应对“未经同意”获取数据行为审慎入罪。应增设妨害数据流通管理秩序罪,对“情节严重的”妨害数据流通管理秩序行为予以刑法规制。

权力概念的法学定位——兼论全球化时代的法益分析范式

“right”形同实异的一词多义现象,囿于宽泛的“能力”说,只看到权力和权利的共同性而无视其根本差异,权力和权利在一定条件下的可相互转换性,导致人们长期以来误把“权力”混同或归属于“权利”。法律思维的日益精细和法律观念的不断分化;“把权力关在制度笼子里”的政治诉求和政治共识;作为现代法治灵魂的“权利本位论”,唯有在“权力”独立于“权利”以及“权利—权力—义务—责任”四位一体的思维坐标中才能凸显其真正的意义和精髓;这些因素决定了权力概念成为法学独立范畴的必要性。萨尔蒙德和霍菲尔德的分析法学图式,虽然有些琐碎和似是而非,但第一次系统梳理了法律分析及法学研究的核心范畴,较为充分地区分了“权力”和“权利”,初步意识到“法益”的本体地位,从而为我们构建全球化时代的法益分析范式奠定了基础。如果说现象层面的“权利—权力—义务—责任”的分析方法主要服务于法律实务,那么深究法律本体、相对繁复的法益分析范式,则主要着眼于法学的体系性学理建设及其逻辑自洽检验。

法益视角下数字时代的“编辑权”体系新探——从“编辑权”与著作权的关系谈起

我国“编辑权”诉求始于经营权对“编辑权”的侵夺,在数字时代愈发迫切。当前,国内“编辑权”研究已深入“编辑权”的权利内容,但学界与业界仍无法就“编辑权”的若干基础范畴达成一致。文章从与著作权关系的角度指出,“编辑权”的本质即编辑权益,包括著作权和法益两部分:编辑著作权包括一般作品著作权和特殊作品著作权;编辑法益则由编辑创造性活动和职责性活动产生的利益构成。在数字出版时代,编辑法益处于快速变动与发展之中,因此,数字时代编辑法益的认定,须综合考量编辑的独立利益、编辑类型化的主体以及编辑界限化的客体三个核心要素。

建设工程承包人对优先受偿权的处分自由论

针对建设工程承包人可否处分优先受偿权,“禁止处分说”所持优先受偿权系法定权、建筑市场是买方市场的理由,因论据与论点脱节而无法证成禁止承包人放弃优先受偿权的合理性。“限制处分说”以保护建筑工人工资为由,限制承包人放弃优先受偿权,但其将优先受偿权筑基于保障工人工资支付,不仅会对交易安全、撤销权制度、消费性购房人保护制度形成冲击,还会导致已经放弃优先受偿权的承包人作出拖欠工资的逆向选择。从优先受偿权的制度功能来看,其与工人工资并无直接关联,仅对保障工人工资支付具有间接促进的或然性。从优先受偿权的理论基础来看,优先受偿权源于“增值理论”,是基于公平原则而设立的承包人利益保护制度。因此,优先受偿权作为为承包人利益而设的民事财产权,承包人有权自由处分。
