The investment of Samsung Electronics in China is divided into three types: production companies, sales companies and R&D institutions. Based on an analysis of the spatial structure of Samsung's three types of investment and parent company, it is put forward that regional bias exists during the operation of a multi-national corporation (MNC) in China, i.e., regional biases of technology, price, sales as well as decision-making. Front office and back ofrice, two terms related closely with the location of modern MNCs, are defined and locational principles of each are studied. It is pointed out that production companies and R&D institutions belong to back office, while sales company falls into the type of front office. Based on a summarization on the spatial distribution of production companies, sales companies and R&D institutions, the locational principles of front office and back office are then applied in explaining the location of Samsung's operating entities in China. By analyzing the spatial structure and locational principles of Samsung, a typical MNC in China, this paper aims to understand the internal operating mechanism of modern MNCs and then bring assistance to related policies to cope with those problems about MNCs that have attracted growing attention in recent years. 展开更多

A portfolio of new energy technologies has emerged in the first decade of the 21st Century, and many of them could be used for re-structuring the energy sector towards Sustainable Development. A key subject in this quest is the future of automobile, with possibilities on powering ranging from biofuels to Hydrogen Cars (HC), to Electric Vehicles (EV). In turn, the latter is closely connected with the need to deploy Renewable Energies (RE) for electricity generation. Within such new situation, countries and governments are aware that there are new tools for fighting Global Warming (GW), and new policies could be established for winning this battle against CO2. All these initiatives will affect the future of energy corporations, notably hydrocarbon companies;and it should be noted that it will be difficult for the companies to define long-term strategies if energy policies convey upheavals, sudden changes in promoting alternatives and interruptions on activities. Hence, it is very important to adopt energy policies allowing a smooth evolution of the companies’ activities to the new energy model. After analyzing the alternatives with a forecasting-backcasting methodology, an “eclectic approach” is proposed, with the Plug-in Hybrid car with Flexible Fuel (PiHFF) as the central paradigm in the coming promoting policies. 展开更多

In Malaysia, the Islamic commercial institutions were established under respective legislations which contain express term on their status as a body corporate. Examples of these institutions are Islamic banks, zakah institutions, Pilgrimage Board and Islamic insurance (takaful) companies. In 1998, Johor Corporation (JCorp) initiated a corporate waqf entity known as Waqaf An-Nur Corporation Berhad (WANCorp). In 2011, Majlis Agama Islam Wilayah Persekutuan (MAIWP) collaborated with Tabung Haji to develop a Class AWaqf building leased to Bank Islam Malaysia Berhad (BIMB). The developments in waqf involving corporate entities are worth to be analyzed in order to create a new framework of waqf practice. This paper deliberated the attributes of corporations under the Malaysian law and compares them with the principles of Islamic law (Shari'ah). For the purpose of discussion, this paper refers to WANCorp and Awqaf Holdings as examples ofwaqf corporations in Malaysia. 展开更多

Extraterritorial Application of International Human Rights Conventions——From the Perspective of States Regulating the Extraterritorial Human Rights Obligations of Transnational Corporations 被引量:1

The extraterritorial application of international human rights conventions is the legal basis for states to regulate the extraterritorial human rights obligations of transnational corporations. In recent years,it has been increasingly challenged by the new trend of the United Nations governing the human rights responsibilities of transnational corporations.A study of existing international rules and practices shows that the extraterritorial application of international human rights conventions depends on the extraterritorial jurisdiction of the States Parties, which mainly includes the actual control over extraterritorial territories and individuals as well as the execution of authority outside the territories. In view of the above,if human rights violations by individuals or transnational corporations occur in areas outside their home territories or are authorized and orchestrated by the home state, the home state shall bear the corresponding human rights responsibilities.Given the restrictive scope of the abovementioned extraterritorial application of international human rights conventions, the international cooperation obligation and the"do no harm"principle may become a new legal basis for states to fulfill their extraterritorial human rights obligations in the future, thereby expanding the basis for the extraterritorial application of international human rights conventions to deal with more serious issues of human rights violations by transnational corporations. However,on the whole, the current identification and codification of states regulating the extraterritorial human rights obligations of transnational corporations should respect the existing rules of international human rights law and should not add any new human rights obligations on states. 展开更多

A well-known fact about the Nigerian Niger Delta region is incessant conflicts between the oil transnational corporations (Oil TNCs) and the oil producing communities. This could be attributed to the fact that the activities of Oil TNCs have continued to unleash untold devastation on the environment of the oil producing communities and its consequences on the local economy and by extension the total obliteration of the livelihood of the inhabitants of the area. Therefore, the Oil TNCs are increasingly becoming conscious of their devastating impact on the ecology of the area and their blatant disregard for the socio-economic development of the host communities. Consequently, the Oil TNCs have come to embrace the idea of executing Corporate Social Responsibility (CSR) projects as a vehicle to intervene meaningfully in order to mitigate the adverse effect of their operations in host communities. This paper attempts a review and analysis of CSR practices of the two major Oil TNCs in Bayelsa State: Shell and Agip in six host communities: Olugboboro, Olugbobiri, Ikebiri 1, Oporoma, Angiama, and Peremabiri in Southern ljaw local government area. The key question explored in this study is: Has the practice of CSR in the Nigerian Niger Delta region by Oil TNCs brought about socio-economic development and drastic reduction in conflict between the host communities and the Oil TNCs? The paper argues that CSR projects of transnational oil corporations in Nigeria are driven by short-term expediency rather than the long term development needs of host communities through the provision of poor quality social amenities to these communities in order to secure social license to operate. For transnational oil corporations to make positive impact in the Nigerian Niger Delta Region, their CSR projects should be long tern in nature, taking into consideration the sustainable development needs of the local communities. The CSR projects should be in the form of high quality social amenities and environmental rehabilitation and protection, which could serve the needs of the present and future generations. 展开更多

This paper aims to explore past researches that examine the relationship between corporate social responsibility (CSR) and financial performance. The researcher intends to conduct researches that examine the relationship between CSR and financial performance in Iraq corporations. This paper highlights review of literatures from various countries that examine relationships between CSR with financial performance. This paper is based on secondary sources which are accumulated from many researches in Malaysia, Australia, UK, Indonesia, Sri Lanka, Nigerian, and Jordan. The study uses information generated from literature reviewed from different researchers relating to the topic. This method was applied by collecting information from journals and online sources relating to the issue under consideration. Regression analysis documents significant evidence to support a positive relationship between CSR and financial performance. Evidence suggests that CSR leads to good financial performance in Iraq corporations. Findings based on the review revealed that researchers also showed that there was a significant positive relationship between CSR practice and financial performance in Iraq corporations. This study focuses on disclosures made in the corporate annual reports. This is because the annual report is the common document produced by companies on a regular basis and is widely used in prior studies related to CSR. The study provides some important insights for our understanding of CSR in developing economies and its effects on financial performance in the context of Iraq companies. 展开更多

While conventional family-owned and family-operated farms remain the most common structure, the number of Japanese agricultural corporations has increased in recent years as a result of changing policies. Some of them are possibly starting to adopt modem corporate management practices to remain viable in a more competitive environment. However, changes in the business structure have not always been accompanied by changes in farm management practices. This study represents a theoretical and empirical investigation into farm modernization practices to provide perspective and recommendations to enhance farm business. Various aspects of farm modernization were considered, including temporal, economic and functional modernization. Critical elements of farm modernization were examined using a structural equation model of surveys, wherein questionnaires were delivered to 2,260 agricultural corporations across Japan in 2014 and 2016, generating 669 usable responses from rice farming corporations. Overall, these corporations demonstrated moderate degrees of modernization, indicating that they have not yet completely transitioned from conventional management styles to modem corporate management and that the farm-household complex system still exists for many of them. It was also found that farm modernization is significantly affected by both production and business management systems, although it was unclear whether a farmer's managerial capabilities were critical for farm modernization. The findings of this study indicate that current farming corporations may benefit from incorporating additional modernization practices. The analytical framework and results will help farmers to better understand their management practices and can be used to provide ideas for policy development to promote competitive farm businesses. 展开更多

As China’s overseas investment and business operations continue to expand, the issue of human rights risks faced by Chinese transnational corporations abroad has attracted sustained attention from society. In recent years,China has enacted a series of laws, regulations, and policies to better regulate the overseas business conduct of transnational corporations, urging them to respect the human rights of the people in host countries and fulfill their social responsibilities to achieve sustainable development.Meanwhile,China has actively participated in the formulation of the Legally Binding Instrument on Activities of Transnational Corporations and Other Business Enterprises in International Human Rights Law,providing a Chinese solution to promote global governance of transnational corporations. However,in practice, the lack of institutional mechanisms, systems, and industry rules to supervise and guide transnational enterprises in fulfilling their human rights responsibilities,as well as the limited awareness of human rights risks among these enterprises, have resulted in ongoing human rights risks in their overseas business operations, particularly regarding labor rights and environmental rights. In response,China should take its national conditions into consideration and focus on the development trends of human rights issues in the business sector at the international level.Drawing on the experiences of other countries,China should explore and establish institutional and practical measures to regulate the human rights responsibilities of transnational enterprises through legislation, administration, and judiciary actions,in order to address the risks and challenges faced by Chinese enterprises in foreign investments and contribute to the sustainable development of the world and global human rights governance. 展开更多

We analyze the risks associated with teenagers’ online activities and the potential migration of cyber threats originating from teenagers to their parents’ work-from-home (WFH) devices, even when defensive measures such as VPN are employed. Furthermore, we examine the serious implications these risks have on corporate security. Of particular concern, parents who work with confidential corporate information, such as financial projections or product roadmaps, might find that their kids are targeted by hackers who seek an easier entry-point to home networks and eventually WFH devices. This paper is timely since there is a rising trend of hybrid work in white-collar professions, mixing traditional in-office work with WFH. The latter is increasingly done in split shifts, including work performed before breakfast or after dinner. While this shift offers numerous workforce advantages and helps teen-parent bonding, it also introduces a plethora of cybersecurity risks, especially when these devices and networks are shared with teenagers on home networks. We did a structured survey of 62 teens which confirms that risky online activity abounds, so the threat of risk migration onto corporate networks should not be ignored. We perform a migration risk assessment and identify which teen-origin risks are most likely to contaminate parents’ WFH devices. We evaluate 20 attack vectors and generate 60 risk ratings. We classify 29 as high risk, 8 as medium risk, 13 as low risk, and 10 as not relevant. We offer recommendations to mitigate this new set of cyber risks. 展开更多

This research focuses on the cross-cultural conflict management of cross-border e-commerce corporations in companies on employee organizational performance under conflict management such as power distance conflict,individualism,long-term orientation, indulgence and avoidance of uncertainty as the independent variables and employee organizational performance such as quality, efficiency, and profitability of organizational tasks as the dependent variable. With the advancement of China’s reform and opening up and the implementation of the“One Belt,One Road”strategy, the globalized economy has penetrated into various countries and regions.China trade exchanges with other countries have become more frequent, and have also set up branch factories and branches abroad. However, there are certain differences between the branch company and the domestic culture in the actual operation process. If the cross-border e-commerce corporations cannot handle these contradictions and differences well, the company may face difficulties such as cultural conflicts. For this reason, this paper makes a deep analysis of this, taking the cross-border e-commerce corporations in Guangxi as an example, and points out the problems existing in cross-cultural management in this region and putting forward personal opinions and solutions to related problems, and putting forward feasible solutions, enhances the understanding of involving conceptualizations of cross-cultural communication conflict and its management in the frame of cross-cultural conflicts management theory and provides references for the formulation of cultural conflict management measures for cross-border e-commerce corporations. So that enterprises can gain a firm foothold in the international market competition, enrich and enhance their soft power, and enhance their international status in the development of multinational regions. The result of this research will not only answer existing research questions, but also introduce new ideas and new questions for future research. 展开更多
