On the Right Road

In 2013, an ambitious program by the Chinese Government known as the Belt and Road Initiative was launched, focus ing on promoting policy coordination,connectivity of infrastructure and facilities, unimpeded trade, financial integration, and strengthened people-to-people ties through a consultative process and joint efforts, with the goal of bringing benefits to all. The Belt and Road Initiative or yidai yilu complises the Silk Road Economic Belt and the 21st Century Maritime Silk Road.

China Embarks on a Road towards Human Rights Progress with Chinese Characteristics

The first Beijing Forum on Human Rights was held by the China Society for Human Rights Studies（CSHRS） from April 21-23, 2008. Following is the speech made by Luo Haocai, President of CSHRS, at the opening ceremony on April 21.

Keep Firmly to the Road of Human Rights Development Suitable to China's National Situation——An Address at the Opening Ceremony of the 7th Beijing Forum on Human Rights, Sept. 17, 2014

In November 2012, immediately after the close of the 18th National Congress of the Communist Party of China （CPC）, CPC Central Committee General Secretary Xi Jinping proposed to ＂realize the Chinese dream of the great revival of the Chinese nation.＂ He emphasized that the fulfillment of the Chinese dream regarding the great revival of the Chinese nation is simply the realization of the country＇s prosperity, the nation＇s revival and the people＇s happiness. All in all, the Chinese dream is the people＇s dream.

Belt and Road Initiative and Realization of the Right to Development

The Belt and Road Initiative not only represents a new blueprint for realizing the right to development, but also provides a realistic approach and a possible solution for it. With clear goals and paths, the Belt and Road Initiativ e serves as a model for SouthSouth cooperation to promote development. Under the background of China’s economic progress, given China has the strong political will, adequate financial resources, and advanced technology to advance the initiative it will prove to be reliable driver of development. With the joint efforts of China and relevant countries, the Belt and Road Initiative will greatly promote the right to development of countries along the routes.

The Contribution of the Belt and Road Initiative to the World's Right to Development

The Belt and Road Initiative makes an important contribution to the right to development in theory and practice in the current world. Since the reform and opening-up, the Chinese government puts the rights to subsistence and development before any other human rights, which effectively guarantees and accelerates a rapid economic development in China. Nowadays, countries along the Belt and Road have joined a "community of common destiny". Inside the "community of common destiny," countries have enjoyed not only the responsibility, rights and benefit of the right to development, but also a win-win cooperation that ensured the right to development. Therefore, the Belt and Road initiative enriches the UN Declaration on the Right to Development, and "community of common destiny" of countries becomes a higher form of the right to development.

Severe Trauma of Uterus and the Right Limb during a Road Accident at the Department of Obstetrics and Gynecology of the Teaching Hospital Souro Sanou of Bobo-Dioulasso: A Case Report and Review of Literature

The authors reported a case of trauma with uterus rupture at 35 weeks gestation with fetal death in uterus with a trauma of the right limb injuries during a serious road accident. Aim: the aim is to show the increasing of road accident with the motorized tricycle and their many risks for pregnant woman. Case Presentation: our patient was thrown from the back cargo of a motorized tricycle (three-wheeled vehicle) after a collision with a truck in a rural area from 150 km to Bobo-Dioulasso. She sustained a closed abdominal injury and a severe right lower limb open injury. At admission in our department in the Teaching Hospital, she was conscious, shocked with hemodynamic instability, including low blood pressure (75/52 mmHg), rapid heart rate (140 pulses per minute), rapid breath rate (40 per minute), and cold extremities. Abdominal examination was painful with uterine hypertonia, 28 cm height uterus, and no fetal heart heartbeat. A laparotomy in urgency revealed a rupture of the uterus fundus with a dead fetus. A conservative surgical treatment was performed. An open trauma to the right limb was managed by the orthopedists with a good outcome. Conclusion: Accident trauma during pregnancy is becoming more and more frequent with the increase in means of transport in urban and inter urban areas. The transport ways of the pregnant woman must take into account her safety and that of the fetus.

Opportunities and Challenges for the Human Rights Development of Southern Countries in the Belt and Road Initiative

Human rights are of great concern to the international community, as they focus on the survival of all people and people’s right to development. The right to life is a prerequisite for the right to development. For countries of the Global South, the right to life is fundamental to development. Thus the Belt and Road Initiative put forward by the Chinese government in 2013 presents opportunities for the human rights development of Global South countries. However, several factors such as the large poverty-stricken populations, economic backwardness, and the cultural difference present challenges to the promotion of human rights ideology and culture. South-South Countries should strive to address this challenge by eliminating poverty, and strengthening communication and cooperation with developed countries promoting inter-cultural exchanges, and finally promoting South-South human rights development cooperation.

Summary of the Seminar on “70 Years of the PRC’s Human Rights: Path, Practice and Theory”

The seminar"70 Years of the Prc’s Human rights:Path,Practice and Theory",sponsored by the china Society for Human rights Studies and the Publicity Department of the c Pc Jilin Provincial committee and organized by Human rights research center of Jilin university,was held at Jilin university on May 9,2019.More than 100 officials,experts and scholars from state organs,universities and research institutions attended the seminar.The seminar focused on the historical development experience of the cause of human rights in china over the past seven decades since the founding of the People’s republic of china(Prc),as well as china’s human rights practices and theories and the promotion of human rights diplomacy and china’s right to speak on international human rights.The seminar was conducive to further understanding the development progress of human rights in the People’s republic of china,building consensus on human rights,and promoting the integrity and innovation of theoretical research on human rights.

Summary of the Seminar on China's Theory and Practice of the Right to Peace

On September 11, 2017, the Seminar on China’s Theory and Practice of the Right to Peace was held at Nanjing University. It was jointly organized by the China Society for Human Rights Studies(CSHRS) and the Publicity Department of the Communist Party of China Jiangsu Provincial Committee, and co-hosted by the Institute for International Strategic Studies at the Central Party School and the School of History at Nanjing University. More than 70 experts and scholars from universities and human rights institutes in China, and representatives of relevant governmental agencies and social organizations discussed in depth topics including "Research on the Basic Theory of the Right to Peace," "Practice of the Right to Peace and Peace in China," "Traditional Chinese History and culture and the Right to Peace," "Peaceful Construction of a Community with a shared future for Mankind," "Right to Peace and Irenology," and "Promotion and Discipline Construction of Irenology." This seminar has not only expounded China’s peaceful development concept and its outstanding contributions to world peace from the perspective of human rights, but also facilitated the construction of a theoretical system of human rights with Chinese characteristics.

知识产权保护和“一带一路”出口扩展边际的波动——来自中国高技术产品的证据

知识产权是一种无形资产,它可以为国家的出口贸易提供竞争优势和市场准入门槛。本文利用2004—2019年中国与“一带一路”共建国家的贸易数据,以及我国知识产权保护水平的指标,探讨了知识产权对我国高技术产品出口扩展边际的影响机制。实证结果表明,知识产权保护水平的提高对我国高技术产品出口扩展边际具有显著的正向作用,这一效应在“一带一路”共建国家中更为显著,且该效用通过了稳健性检验。基于以上发现,本文提出以下政策建议:一是加强知识产权保护,促进高技术产品出口的质量和效益;二是深化与“一带一路”共建国家的知识产权合作,打造创新共同体;三是积极参与全球知识产权治理,推动知识产权规则的改革和完善。

独立保函视域下“欺诈”概念的本土化重述

最高人民法院于2016年颁布的《独立保函司法解释》以“列举+概括”的方式构建了欺诈例外的规范体系。学界广泛质疑概括式兜底条款突破了独立保函欺诈的界限,或成为司法机关任意止付保函的制度漏洞。这一质疑源于兜在条款用语不当引发的误读。不同于学界的质疑,司法实践中兜底条款在我国法院的适用方式趋于保守。解释论视角下,独立保函语境中“欺诈”的内涵特指欺诈故意,区别于民法体系下欺诈的概念。兜底条款中“权利滥用”的情形实则被纳入“欺诈”之范畴,这一逻辑关系在实证研究中得以验证。独立担保的制度价值在国内规范层面和司法实践层面均得以维护,与国际惯例的精神相契合。从立法技术角度考量,有必要加入定义性条款释明独立保函欺诈的内涵是欺诈故意,将兜底条款中“滥用”的措辞替换为“主张”,避免用词不当引发的误读。

基于Landsat 8影像的民权湿地时空动态变化研究

民权黄河故道国家湿地公园是河南省的重要湿地资源,且生态景观资源与动植物资源丰富。为了检验公园2014-2020年建设成果,本研究基于层次分类法,对研究区2013-2020年5期Landsat 8遥感影像进行分类处理,得到了不同时期的湿地资源分布情况;根据动态度模型与马尔可夫模型进行时空动态变化分析;结合其变化驱动因子,为湿地的治理与恢复提供一定依据。结果表明,研究区地类变化主要受人为因素影响,变化速度较慢,整体呈现出湿地内部相互转化及湿地与非湿地相互转化并存的特点。应该合理管理水产养殖产业,控制养殖池塘面积,合理处理废弃养殖场,降低对生态环境的影响;继续推进湿地修复工作,使各个分区协调发展。

江苏企业参与“一带一路”跨境电商高质量发展建设中知识产权风险防范及对策研究

跨境电商正在国际贸易中扮演越来越重要的角色,然而在全球范围内尚未形成统一的跨境电商国际规则。中国应借此发展机遇,发挥在该领域的核心优势,争取成为跨境电商行业标准和规则的制定者,这也是中国参与全球治理的重要领域之一。对中国企业来说,在参与“一带一路”跨境电商建设中涉及侵犯专利权、著作权、商标权等知识产权的产品和行为越来越多。只有尽早掌握知识产权规则,积极了解国内外跨境电商中知识产权保护现状以及知识产权存在的问题和表现形式,正视和重视知识产权的重要性,才能拿起武器保护自己,规避风险,在电商平台上占得一席之地。本研究课题旨在梳理跨境电商领域知识产权存在的典型问题,为江苏企业防控知识产权风险提供对策与建议,也可为相关部门在当前背景下进行知识产权保护研究提供参考和借鉴。

广州市既有道路非机动车道改造提升设计研究

近年来,随着城市交通拥堵问题的逐渐扩大和绿色交通出行理念的日益普及,慢行交通尤其是自行车交通开始回归。如何让自行车重新拿回通行路权,成为自行车复兴过程中不可回避的重要问题。文章介绍了广州市非机动车道发展建设历程,指出目前存在连续性差、精细化程度低、路权保障不足等问题,提出非机动车道改造提升应遵循的设计原则和空间、型式等要求。基于路权分配理论,以人本化、精细化为目标,分别对既有道路路段、交叉口和公交站提出具体的改造提升设计指引,通过道路空间再分配指导非机动车道改造实践。

存量路政管理路产路权桩号与坐标转换研究

针对路政管理中路产路权桩号系统与公路基础数据路网桩号不对应的问题,提出一种融合遥感影像和动态分段技术的桩号转坐标方法。该方法以公路基础数据桩号系统为依据,利用遥感影像并结合路政管理人员经验,首先将路政管辖路段匹配至公路路网,然后利用路政管辖路段与路产路权附属设施的关联关系,将路产路权匹配到公路路网上;最后利用ArcGIS平台提供的经纬度坐标计算方法,获取匹配后的路产路权位置坐标。该方法能实现存量路政路产路权转换到公路路网,研究结果可以应用于桩号系统不完全统一的路网,及其附属设施之间的相互转换、线性参照系统中线性事件测量值与线性要素测量值不一致等领域。

我国在“冰上丝绸之路”行使航行权的困境及出路

当前部分北极沿岸国依据《联合国海洋法公约》“冰封区域条款”,在“冰上丝绸之路”制定特殊航行管制措施,限制他国船舶行使航行权。这些特殊航行管制措施超越了《联合国海洋法公约》的适用范围,违反了适当顾及义务。《国际极地水域营运船舶规则》是“冰封区域条款”的重要补充,是我国在“冰上丝绸之路”行使航行权的法律依据之一。为保障在“冰上丝绸之路”的航行权,我国可以在三个层面加以应对:首先,在联合国体系下积极参与国际航行规则的制定;其次,通过北极理事会等区域平台参与“冰上丝绸之路”建设;最后,加强与北极沿岸国的合作与对话,共建“冰上丝绸之路”。

基于车路协同的无交通信号交叉路口协调技术研究

针对无交通信号交叉路口交通无序,通行效率低,事故频发等问题,提出应用车路协同系统,充分考虑网联车辆和传统车辆的区别,建立无信号交叉路口协调模型,对无交通信号交叉路口车辆通行进行协调。协调系统对无交通信号交叉路口混合车流车辆信息进行计算和协调,按照“先到先行”的原则进行优先级计算,有利于提升交叉口的通行效率;允许行驶路径无交叉碰撞风险的同相位车辆和在同车道行驶且前后跟车距离较小的车辆一起通过交叉路口;根据车辆到达停止线所需时间t1大小可分成多个不同的等级,优先级最高的车辆或车辆共同体获得路权,可以正常行驶通过交叉路口,同时其他优先级车辆无路权;当路权需转移时,提前2S转移路权给下一相位车辆,使驾驶员有足够的反应时间,减少了交叉路口的空闲时间。

市政道路旧路改造横断面设计研究

为了提升市政道路的通行能力,文章对市政路段横断面布置类型进行概述,从路权分配、道路用地界线优化、公交车站点设计、行车道宽度设计等方面出发,分析市政道路横断面的改造设计要素。同时,以某城市郊区主干路为研究对象,利用加权法计算横断面改造方案的实施效果,旨在为类似市政道路横断面改造提供参考。

儿童安全通学街道的优化路径研究——基于国外经验的分析

通学街道是儿童通学出行和社会性活动的重要承载空间,建设儿童安全通学街道成为推动儿童友好型社会的重要一环。本文通过分析国外关于儿童安全上学道路建设的优秀案例,认为交通的安全性、社区环境的友好性、政策措施以及多组织合作的开发模式是营造儿童安全通学街道的核心要素。进一步选择石油南路小学通学街道,采用实地调研和问卷调查方式,在厘清现状问题基础上,从道路交通设计、公共空间设计、政策治理和多主体合作四个维度提出了具体的优化策略。

基于多目标配时优化模型和交通设计的城市交叉口协同优化研究

文章基于多目标配时优化模型和交通设计,旨在缓解城市道路交通拥堵。通过分析城市道路交叉口交通流特性和问题,关注交叉口车流流向、车流交织点以及配时合理性。在交通设计方面,提出将左转车道右置的渠化设计方案。在配时优化方面,建立了多目标优化模型,以延误、通行能力和停车次数为优化目标,以各相位有效绿灯时间、交叉口饱和度及周期时长为约束条件。通过遗传算法对模型进行求解,并用SUMO仿真软件评价求解结果。研究结果表明,交叉口的时空资源得到更有效的利用,明显缓解了交通压力,为城市道路交叉口的运行、管理和规划提供了参考。
