A Preliminary Study on the Rural Land System Reform in the Context of Rural Revitalization

With the deepening of reform and opening up,the rural land system has experienced the evolution from contracting to transfer to the current rural revitalization strategy,and has always been closely linked to the well-being of farmers and the vigorous development of the rural economy.The reform of this system is not only a key driving force for rural economic development,but also an important cornerstone for realizing the rural revitalization strategy.Through in-depth analysis of the connotation of rural revitalization and rural land system reform,this study discusses in detail the internal dynamic mechanism of rural land system reform driving rural revitalization,and comprehensively analyzes the current implementation of rural land system reform.On this basis,this study puts forward the strategic concept of promoting the rural land system reform in the context of rural revitalization.Studies have shown that the rural land system reform has mainly played a positive role in the following four aspects in promoting rural revitalization:providing a solid material foundation for rural revitalization,optimizing the allocation of rural resources,promoting the transformation and upgrading of rural industrial structure,and promoting rural social harmony and stability.In the context of the current rural revitalization,the rural land system reform is undoubtedly one of the core issues of China s rural development.In order to further improve this system,we need to continue to optimize and innovate the rural land transfer system,the homestead reform system,and the rural collective construction land market entry system.

Reform Paths of Rural Land Property Rights System in the Context of Agricultural Modernization

The reform of rural land property rights system can promote large-scale and intensive agricultural production,improve the quality of laborers,improve agricultural production efficiency,increase farmers'income,and effectively promote the development of agricultural modernization.In the context of the reform of the"separation of three powers",the rural land property rights system still has problems in terms of ownership,use rights,disposal rights,and income rights,which affect the healthy development of agricultural modernization.In this situation,it is necessary to further clarify the subject of rural land ownership,thoroughly improve the right to use rural land,vigorously improve the right to dispose of rural land,effectively protect the right to benefit from rural land,and deeply promote the reform of the rural land property rights system in order to effectively promote the development of agricultural modernization.

Study on the Influencing Factors of Land Transfer Price in the Context of Rural Land Reform

Agricultural land is the key to large-scale agricultural management,and the transfer price is the key to the success or failure of land transfer. At present,there are many problems in the pricing of rural land transfer in China,such as low price,random pricing,and large price difference,which seriously hinder the development of rural land transfer. Drawing lessons from the research results of domestic and foreign scholars,combined with the actual situation of rural land transfer in China,this paper analyzes the influencing factors of land transfer price in the context of rural land reform. Finally,according to the influence of different factors on the behavior of agricultural land transfer,this paper proposes establishing and perfecting the evaluation system of contracted land,perfecting the evaluation institution of transferred land assets and establishing a unified dynamic monitoring system of land transfer price in the whole country,and then driving the broad masses of farmers to get rich together,which is of great significance to achieving the revitalization of China’s rural areas.

Reform of Rural Land System from the Perspective of New Urbanization

In view of artificially high urbanization rate of China and possible causes,survey and data analysis methods were used to discuss reform of household registration system,and path for promoting rural land system reform. Results show that it is required to eliminate bottlenecks of land system in the advance of new urbanization process. In line with land system bottlenecks of new urbanization,it is recommended to take following measures.( i) Promoting land right confirmation centered land system reform.( ii) Weakening rural land ownership and stressing land use right.( iii) Establishing urban and rural integrated land market and putting an end to low cost urbanization road.( iv) Realizing asset value of rural construction land and tackling the problem of insufficient construction land.( v) Reforming the land expropriation system and increasing the share of gain in land value to farmers.( vi) Implementing different land policies to promote coordinated development of regional social economy.( vii) Establishing land circulation access system to ensure unchanged land use purpose and high efficient use.

Rural Land System Reform Pilot Experiment in Pidu District: Background, Debate and Enlightenment

By combining top-level design with local pilot practices,rural land system reform,as an important priority on the agenda of deepening comprehensive reform,has accumulated a series of replicable and applicable experiences that are conducive to amendments to relevant laws.This paper takes stock of the basic experience of Pidu District in addressing typical problems arising in its rural land system reform and then investigates the inner link between the reform and the persistence of high housing prices in cities,the capital flowing to the countryside,and the rural revitalization program.Based on this analysis,the author puts forward three basic directions of the rural land system reform:remain committed to marketization,balance the interests of all parties and promote the development of rural industries.

Farmland Capitalization an Urgen issue in Institutional Reform

Developing modern agriculture is an important aspect of urban and rural integration. Chintz has adopted a new, highly compatible, multipronged approach. Judgingfrom current agricultural and rural policies, factors like capital, labor and land will continue to interact and revolve. The transformation of China＇s rural land tenure system is at a critical posifion in the overall strategy of developing tile rural economy. However, rural institutional reform will inevitably be constrained by the path and pattern China＇s industrialization, urbanization and agricultural modernization take. Creating a new pattern of urban and rural socioeconomic integration requires reform and improvement of rural grassroots governance structure. The interaction and reconsolidation of the factors have again become intertwined with the superstructure of rural society and will inevitably affect the direction and pace of rural grassroots governance structural reJbrm. Protecting the economic interests of farmers while respecting their democratic rights will always be at the heart of agricultural modernization.

中国式现代化视域下农村土地制度的优势、困境与改革方略

农村土地制度是国家的基础性制度,其变革关系到资源配置、百姓福祉和社会稳定,中国式现代化的发展离不开农村土地制度的支持与保障。回顾中国式现代化发展历程,农村土地制度这一根本性、基础性生产关系的变革与调适,对不同阶段主要发展任务的完成起到了至关重要的作用。在中国式现代化视域下农村土地制度具有五大独特优势,分别是能够在人口规模巨大条件下保障我国的粮食安全和社会稳定,能够以释放土地财产收益为抓手夯实全体农民共同富裕的物质基础,能够以赓续农耕文明、改善乡村公共文化服务为载体支持农村精神文明建设,能够以退耕还林还草还湖工程、发展生态农业、防治耕地污染、农村人居环境整治为路径促进人与自然和谐共生,能够以支撑内生型发展模式为手段保证我国走和平发展道路。面对当前农村土地制度的发展困境,需要进一步深化农村土地制度改革,着力加强农村土地的粮食安全保障、财产性收益提升、精神文明和生态文明建设、社会秩序稳定功能。

土地政策松绑与县域新型城镇化——来自农村宅基地改革的经验证据

以县域为重要载体的新型城镇化是实现中国式现代化的必由之路,但随着农村剩余劳动力的不断外流,土地粗放利用、宅基地闲置甚至抛荒问题日益凸显。宅基地改革是促进土地要素与新型城镇化协调发展的重要举措,基于宅基地改革试点政策,运用多期双重差分法构造准自然实验,检验农村宅基地改革能否促进县域新型城镇化。研究发现:农村宅基地改革可以显著提升县域新型城镇化水平。政策路径识别发现,农村宅基地改革从非农就业、产业结构升级和激发市场潜能三方面提升县域新型城镇化水平。异质性研究表明,行政区划上,农村宅基地制度改革对于县、县级市和市辖区的新型城镇化水平提升能力呈现递增趋势;地区差异上,农村宅基地制度改革的政策效应在东部、中部地区县域得到有效发挥,对西部地区县域新型城镇化水平提升效果有限。通过土地政策改革推进以县域为载体的新型城镇化提供了经验证据,同时也从经验上就如何稳慎推进农村宅基地改革试点提供政策启示。

宅基地有偿使用制度探索:问题、挑战与应对

始于1988年在山东德州等地开展的宅基地有偿使用制度试点,1993年被全面取消;2015年首轮农村宅基地制度改革试点再次被提上日程。2020年新一轮宅改试点方案启动后,各试点地区采取稳慎态度稳妥推进,取得初步成效的同时,也暴露出一些共性问题,包括有偿使用收费范围扩大化、收费对象瞄准错位化、收费标准存在一定的随意性、收费起征点“一刀切”等。究其原因,既有对宅基地有偿使用的性质和法理依据的认识不清,也有对宅基地政策变迁的历史节点把握不准,以及基础性工作不扎实、不到位。未来应顺应城镇化、非农化不可逆转的态势及建立健全城乡融合发展体制机制的内在要求,强化有利于增进最广大农民利益的指导思想,强化有利于构建城乡住房保障一体化体系的顶层设计,将有偿使用的重点瞄准非农经营性宅基地和一些发达地区新增宅基地的分配,有偿使用的标准应坚持于法有据,分区域、分人群稳步推进。

论农村土地制度改革的整体性

农村土地制度改革的整体性体现为两方面,即实现地权平等和地权体系具有适应实践发展需要的有效性、开放性与包容性。家庭承包地“三权分置”政策的法律化和承包期延长,土地征收规则的更新、集体经营性建设用地入市和建设用地指标化交易,以及农村宅基地“三权分置”政策的实施,是农村土地制度改革整体性推进的主要体现。土地利用规划及其实施,以及政府在地权交易中的法律地位,是分析地权交易规则科学性的两个基本因素。为进一步整体性地推进农村土地制度改革,实现其既定政策目标,需要建立科学的农村集体产权制度,深化土地收益分配机制,以市场需求为导向完善土地利用规划机制和土地指标交易机制。

农村集体经营性建设用地入市研究的热点、演进与展望——基于CiteSpace的知识图谱分析

使用文献计量法和内容分析法对来自知网、万方、维普3大数据库的农村集体经营性建设用地入市的404篇研究文献作者、机构及热点进行分析,基于研究现状展望重点方向及前沿趋势。研究发现:研究人员和机构合作意识较弱,受学缘、地缘等因素影响未能形成较为明显的研究群体;“三块地”改革试点期呈现出百花齐放的研究态势,相关研究文献数量急剧上升,2019年至今为巩固改革成果期;现有研究聚焦于集体经营性建设用地入市的制度设计、与土地征收及宅基地制度改革的关系、地方实践、收益分配等主题。利益均衡视角下集体经营性建设用地入市收益分配机制的探索与优化、城乡融合发展视域下同地同权同价的实现条件及路径、农村三项土地制度改革的法理平衡及制度设计、集体经营性建设用地入市助推乡村振兴的地方模式及发展经验等方面仍需继续深化研究,也是未来的主要研究方向。

新型城镇化背景下农村土地管理制度优化

农村发展应新型城镇化要求需在相关体制上进行追本溯源的、创新性的改革,尤其是农村的土地管理制度,存在诸多与新型城镇化发展相矛盾的问题。如今,新型城镇化的任务推进能够为农村不断完成新农村建设作出指导。为此,基于新型城镇化背景,探讨了其对农村土地管理制度改革的需求,分析了农村土地管理与新型城镇化的适配度问题,指出了农村土地管理制度中的问题,并针对相关问题提出建设性的优化策略。

土地发展权视角下全域土地综合整治工具探索——以佛山市南海区“三券”为例

全域土地综合整治是稳妥推进农村土地制度改革的关键抓手。在全域土地综合整治中,不同的整治模式会造成土地发展权的非均衡配置,使得被赋予土地发展权的项目容易实施、被削减或终止土地发展权的项目难以实施。本文从土地发展权视角出发,探究了南海区“三券”政策的三个典型案例,分析了“三券”政策的实施机制,指出“三券”政策实质上是通过土地发展权的补偿和转移来保护村集体利益、助力实施全域土地综合整治的有效工具和重要路径。建立和完善土地发展权转移和补偿机制,有利于推进实施全域土地综合整治、解决因土地性质变化而产生的土地收益“暴损”问题,有利于以全域土地综合整治为牵引深化农村土地制度改革,促进乡村振兴和城乡融合发展。

集体建设用地入市对县域市场活力的影响研究:基于企业进入视角

研究目的:基于企业进入视角,关注推进城乡统一建设用地市场建设的作用效果,系统考察集体建设用地入市改革对县域市场活力的影响。研究方法:将工商企业注册和土地出让微观数据集与县域经济数据结合,基于因果推断的反事实框架,使用多期双重差分方法进行政策效果检验并进行机制分析。研究结果:(1)集体建设用地入市显著提升了县域市场活力,该结论通过了一系列的稳健性检验;(2)改革通过作用于供地规模与供地价格,对政府规制产生了弱化效应,推动了土地要素市场化配置,对工业与商住用地价格偏移具有矫正效应;(3)政策在一定程度上提升了土地的产出效率,形成效能提升,增强市场活力。研究结论:深化土地要素的市场化配置,进一步扩大集体经营性建设用地入市改革范围,完善集体土地入市流程和市场化交易机制,增强土地要素市场提振县域市场活力的支撑作用。

农地产权制度改革与农地流转响应:预期偏离与逻辑阐释

农地所有权归属集体以来,产权拆分及农民产权份额的扩大和强化是产权制度改革的主要思路。然而,理论上有效的农地产权制度改革,却在农地流转的推动成效方面呈现时段上的异质性。随着时间的演进,改革对农地流转的正面作用渐衰,甚至表现出对农地流转的抑制。为解释理论与现实的偏差,聚焦改革路径的形成逻辑,重点阐述了改革历程及改革对农地配置的影响成效,提炼出改革成效不足的系统性成因。研究认为,产权理论的引入为确定改革方向提供了理论依据,过去的改革经验为决策层延续产权赋予式改革提升了信心,规模经营路线的确立加强了坚持并推进改革的必要性和紧迫性。改革开放以后,农地产权制度朝着扩大集体成员权能的方向不断推进,却在现阶段表现出抑制农地流转并冲击农地承包权稳定性的负面影响。对此,构建了涵盖政策有效性、农地多功能性以及中央决策层认知调整在内的解释框架。认为在追求现代农业发展的目标导向下,扩大集体成员的土地权能并不可取,增强农村基本经营制度中“统”的作用并以社会保障弥补农户对农地的非生产性寄托是关键。

乡村振兴战略背景下农村土地制度改革的探索与思考

乡村振兴战略的重点任务在于加强基础产业建设、改善乡村人居环境、建设乡村人才梯队、重构乡村文化个性和完善农村组织治理。其中,农村土地制度改革问题是影响和决定乡村振兴事业的关键。当前,在涉及农村土地使用方面仍存在一些突出问题,在农村承包地“三权分置”改革、宅基地制度试点改革和《土地管理法》修订等制度性改革方面仍有不足。建议:(一)完善巩固农村承包地“三权分置”改革;(二)激发农村集体建设用地入市改革的内生动力;(三)优化农村宅基地配置。

宅基地制度改革对城乡融合的政策效应研究——以江西省余江区为例

研究目的:以江西省余江区为例,评估宅基地制度改革对城乡融合的政策效应。研究方法:运用合成控制法评估宅基地制度改革对城乡融合的推动作用,并运用“三步法”检验人—地—业三要素互馈互补所发挥的中介作用。研究结果:宅基地制度改革显著提升了余江区城乡融合发展水平,但提升幅度呈现倒“U”型变化规律;余江区“宅改”通过促进城乡劳动力、土地、资本要素流动和重组推动城乡融合水平提升,但各要素组合的作用程度不尽相同。研究结论:宅基地制度改革是优化配置土地资源的有效手段,能够促进城乡人—地—业要素的协同联动;未来应通过优化生产要素组合,促使政策边际效应拐点后移;协同推进多项改革措施,发挥政策的“乘数效应”,实现城乡融合发展。

农村“三块地”改革对县域城乡融合发展的影响研究——基于准自然实验的证据

文章基于2007—2020年1256个县(市、区)的面板数据,结合理论分析法和双重差分法,从准自然实验角度出发,探究以农村土地征收、集体经营性建设用地入市和宅基地制度改革为内容的“三块地”改革试点政策对县域城乡融合发展的影响效应及影响机理,为深化新一轮土地制度改革、推动县域城乡融合发展提供参考。基准回归分析表明,“三块地”改革对县域城乡融合发展具有显著且稳健的促进作用;机制研究发现,“三块地”改革通过促进土地、劳动力、资金要素在城乡之间自由流动推动了县域城乡融合发展;异质性分析发现,“三块地”改革在低城乡融合度县域、较低发展水平县域、中部县域的影响效应更加明显。据此,应进一步深化“三块地”改革,不断总结试点县域的政策实施经验,在差异化城乡融合基础、经济发展水平、自然地理条件下,因地制宜、审慎推进农村土地制度改革,强化城乡地域系统的连接纽带,促进城乡要素自由流动和平等交换,推动县域城乡经济、社会、人口、空间和生态全面融合发展,实现政策的长期效应。

在“三权分置”的政策背景下,文章阐述了对农村宅基地使用权本质属性的基本理解。在此基础上,对城镇子女继承农民宅基地上的房屋不动产的操作程序提出优化建议和成效预期,对农村宅基地不动产房屋所有权继承问题的相关研究具有参考价值。

农村集体经济发展的制度演进、现实阻滞与路径选择

发展农村集体经济是加快推进农村农民共同富裕的重要抓手。农村集体经济发展有其深厚的制度、组织和产权基础,基于历史、现实和未来角度,分析研究我国农村集体经济发展的制度演进、现实阻滞与路径选择。研究发现:农村集体经济发展存在土地、组织以及产权等多重制度演进逻辑;小农经济和集体经济组织有待创新、土地制度亟待进一步改革、不同历史时期生产力与生产关系矛盾适应延迟等是当前我国农村集体经济发展的现实阻滞;面向未来,我国农村集体经济发展需从尊重历史制度和现实难点出发,进一步推动农村集体产权改革、推进农地制度重点领域改革创新和注重农村集体经济体制机制创新等。
