Inheritance,Innovation and Development of Wuling Mountain Area in Hubei Province Based on Intellectual Property Rights

Using the methods of field survey and literature collection,this paper firstly introduces the intellectual property resources of the Wuling Mountain Area in Hubei Province from folk literature and arts,traditional knowledge,biological genetic resources,new plant varieties,patents,geographical indications,and trademarks.Then,it analyzes the main problems in the protection and inheritance,innovation and development of intellectual property rights(IPRs).In addition,it discusses the strategy of inheritance,innovation and high-quality development of this ethnic area in the context of the strategy of strengthening the country with intellectual property rights and the strategy of rural revitalization.Finally,it comes up with recommendations including carrying forward and inheriting folk literature and art,protecting traditional knowledge of traditional craftsmanship,inheriting and innovating to develop traditional Chinese medicine and ethnic medicine,improving the protection and use of geographical indications,and strengthening the IPR protection.

The Establishment of Intellectual Property Rights

A common act taken by every innovation-oriented country is its protection for intellectual property. The main mission for establishing intellectual property rights is to normalize the rights and laws over its entire domain of jurisdiction. This article introduces the new concept of "intellectual-property-rights-ization", and discusses about the role and importance of this concept; a country that has normalized intellectual property rights are characterized by a people that realize the importance of intellectual property rights, a presence of a rule system that protects one 's intellectual property, an administration that regulates intellectual property rights, a specialization of labor in protecting IPR, and a strong education system.

Strengthening Protection Of Proprietary Intellectual Property Rights and Implementation of Technology Standard Strategies

This article focuses on the current situation in technical research and development （R＆D） and proprietary intellectual property rights （IPRs） in China. Based on the situation of Far East Cable Company, it analyzes the significance of strengthening the protection of proprietary IPRs and implementing a strategy for technology standards and then discusses the actual work and future arrangement of proprietary IPRs and technology standard strategies. Study on Agricultural Intellectual Property Protection and High-Quality Development of Traditional Chinese Medicine of Ginseng

Agricultural intellectual property has the functions of carrying forward agricultural cultural heritage,encouraging agricultural scientific and technological innovation,cultivating the brand of agricultural products and so on. The protection and application of agricultural intellectual property rights can enhance the vitality,innovation and competitiveness of agricultural economy,and promote the strategy of high-quality agricultural development and rural revitalization. Ginseng is a traditional medicinal variety with superior characteristics in Northeast China,and it is one of the most famous " three treasures" in Northeast China. This paper introduces ginseng( Panax ginseng C. A. Mey.) and its medicinal value,analyzes the traditional knowledge,biological genetic resources,new plant varieties,patents,geographical indications,trademarks and other agricultural intellectual property resources of ginseng,studies the traditional Chinese medicine GAP certification and certification of " Three Agricultural Products" and the construction of the dominant area of agricultural product( Fusong ginseng) with Chinese characteristics,and explores the rural revitalization strategy and traditional Chinese medicine development strategy,ginseng agricultural intellectual property protection and high quality development strategy.

A Novel Digital Rights Management Scheme in P2P Networks

P2P networking is a distributed application architecture that partitions tasks or workloads between peers. How to integrate P2P networks and DRM to offer a novel content distribution mode for digital media resources is a significant research project. In this paper, a novel DRM architecture in P2P Networks is proposed, three phases include content provide phase, content purchase phase and content access phase, are modeled, and key technologies are introduced. Finally analysis indicates that the proposed scheme has the characteristics of security, controllability and scalability.

数字经济时代知识产权保护问题探究——以河北省商标权侵权案件为视角

【目的】以商标权侵权案件为视角,探究解决知识产权问题的新方法、新思路。【方法】通过对裁判文书网中河北省近10年来知识产权案例的检索归纳总结发现,存在城镇小型商店、小型公司涉商标权案件较多,知识产权类案件上诉率高等问题。【结果】针对相应的问题,结合数字信息的发展给出了完善惩罚性赔偿的具体适用标准、探索基于手机等移动端的案件投诉处理系统等解决方法。【结论】通过对问题的分析,力求达到知识产权案件处理的实践效果与社会效果的统一。

Quantitative Characteristics of Patentable Applications in Japan： An Analysis Using Bibliographic Information of Application Documents

This study examined Japanese patents in terms of the quantitative characteristics of application documents that resulted in the acquisition of rights in order to clarify the relationship between the features and patentability of applications. The groups of approved applications and those that had not been approved were compared for 12 variables： publication time lag; numbers of inventors, classifications, pages, figures, tables, claims, priority claims, countries for priority claims, cited patents, and cited non-patent documents; and median of citation age. Furthermore, the authors carried out the experiments in which patent applications were automatically classified into two groups by the machine learning method, random forests. As a result, statistically significant differences between the two groups were observed for the following variables （p 〈 .001）： the numbers of inventors, pages, figures, claims, priority claims, and countries for priority claims were significantly larger in the group of approved applications, while the time lag until publication was smaller. In particular, the publication time lag and the numbers of inventors, pages, and figures were variables representing the features that largely contribute to discriminating approved applications in the classification using random forests, which implies that these have relatively strong relationships with patentability.

科技型中小企业知识产权保护现状与管理策略研究

国家知识产权局发布2023年全国知识产权行政保护工作方案,强调要提高知识产权保护水平,持续建设支撑国际一流营商和创新环境的知识产权保护体系。国家战略转型布局需要科技型中小企业强有力的支撑,但我国对知识产权保护意识淡薄,缺乏专业人才,法律法规不够完善等问题日益凸显,阻碍了我国“着力提升科技自立自强、推动产业转型升级和高质量发展”战略部署的实施。因此,本文提出了现阶段科技型中小企业知识产权保护路径及管理策略。

科技档案数字化工作中知识产权问题及完善路径

【目的】分析科技档案数字化工作中可能出现的知识产权侵权等问题,为我国科技档案数字化工作的法治化建设提供可行性建议。【方法】以知识产权保护为视角,从科技档案数字化流程、数据存储、提供利用等环节入手,分析科技档案数字化工作中可能出现的侵权现象。【结果】科技档案数字化是档案工作适应时代发展、服务社会大众,提升社会治理和效能的重要途径。但在科技档案数字化工作的各个环节,如数据保管、数字化管理、服务等环节都存在知识产权侵权的风险。【结论】应通过健全法律法规、赋能技术保护和提升知识产权意识等途径,推进科技档案数字化工作的法治化建设的不断完善。

企业知识产权合规管理与负责任创新协同推进

在负责任大国形象建构过程中,企业知识产权合规管理和负责任创新治理对企业在高质量发展道路上行稳致远的影响在实践中已逐步显现,但从理论上对其协同推进讨论仍然较少。从企业知识产权合规管理直接价值、间接价值和潜在价值及其实现影响因素分析出发,探讨了两者融合演进的内在逻辑,动力机制,提出推进两者协同演进的多主体治理实现路径:认为企业要尽快建立知识产权合规管理委员会和负责任创新治理委员会,推动两大治理体系相向融合;地方政府要完善和优化企业知识产权合规管理和负责任创新治理协同的激励监管机制和外部保障机制;产业联盟与行业协会要依托产业创新服务综合体做好服务;律师团体和公众媒体等社会公众要对两者协同演进过程与结果做好监督、评估与宣传。

知识产权强市:从“潜能”到“显能”

中国知识产权走过了从“制度”到“战略”的重要跨越,正经历从“大国”到“强国”的巨大飞跃。作为落实知识产权强国战略的重要抓手,中国进一步提出知识产权强市战略。历经改革开放的飞速发展,中国已形成巨大的知识产权潜能。但这一巨大“潜能”尚未较好地转化为强势“显能”,科技与产业“两张皮”是阻碍潜能转化的重要因素。本文从全创新链即“科学知识—技术知识—技术产品—产业化—社会化”的概念出发,系统剖析知识产权强市的路径与对策,包括加强全创新链建设;“因城施策”,将知识产权转化为科技生产力,尤其是科技部门与知识产权局之间的政策协调;将科技生产力转化为社会生产力,真正实现知识产权强市与知识产权强国的双向联动。
