In the research, reform of rural collective economy property right system in Beijing rural-urban continuum was explored in terms of background, cause, pro- cess and practice modes by surveying and interviewing, and the value of system reform on urbanization in rural areas was illustrated from the perspective of farmers who lose lands. The results showed that since reform and opening-up, disadvan- tages of collective economy property are always the fundamental cause of reform; rural-urban contradiction produced from rapid urbanization makes the reform much more urgent; shareholding co-operative system is the essence of reform of collective economy property right system. Rural collective economy property right system in Beijing includes stock-assets quantification shareholding co-operative system, share- capitalization of contractual land management right, farmers as shareholders by investment, and resource and capital mode, with advantages and disadvantages respectively. The common character should be noticed is that all modes have share on contractual right of land, indicating the core of the reform of property system lies in asset quantification and stock quota. In improving urban-rural integration and modern market system, as well as endowing more rights to farmers, reform of rural collective economy property right system is of great significance, which provides a transition space and buffer mechanism for urbanization in rural areas. 展开更多

Based on the background of national urban and rural comprehensive reform pilot area and the introduction of the profiles of research region and the data obtained by on-the-spot interview survey,the innovative models of farmland property rights system reform in Chongqing are introduced by applying participatory rural appraisal methods and examples. The innovative models cover buying shares of contract management rights,transforming from farmers to townspeople and mortgaging contract management rights. The plights exist in the reform are analyzed,among which the plights of buying shares of contract management rights are introduced from the following five aspects:the conflict with the present land contract laws,the possible new round of massive scale land loses,the confounded functions of government and enterprise caused by risk transference and the difficulties of handling assets when the contract management rights expired. Besides,the plights of the transforming from rural residents to urban residents are analyzed from four aspects,which include the particularity of reform,high financial pressure,emergence of interbedded people and difficulties of payoff of village-based companies. From the facets of limited mortgage area,risks of reimbursing the loan,legal risks of mortgage. The results show that the stock purchasing model of contractual management rights reveals the capital value of land and the model is of theoretical and practical significance in law and economics. However,the social security system is not perfect,so the stock purchasing model of contractual management rights can not be expanded. In addition,the participation of more famers and the expansion of enterprises are limited as well. The land comprehensive reform model of transforming from rural residents to urban residents is of positive significance to the comprehensive exploration of farmland property system reform,but this kind of model should be supported by strong economy. The stock purchasing model of contractual management rights is of significance to perfect the contractual management rights,but it conflicts with the existing laws and financial systems. 展开更多

In recent years,experiments on land trusts(xin tuo)have been made in the rural areas of China.To better understand such practice,this research identifies four case studies based on their operational structures and divides them into government-led models and market-led models.The government-led models include the Yiyang Model in Hunan Province,and the Longgang Model in Hubei Province.The market-led models include the Suzhou Model in Anhui Province,and the Golden Field Series Model in Jiangsu Province.This paper compares their profit-sharing mechanisms with specific attention given to the incentives for the villagers.Findings suggest that the villagers’profits are limited in both models.The government-led models concern less about profits but more on reusing the desolated agricultural land.The market-led models are profit-driven therefore tend to exclude the villagers from the profit-sharing process. 展开更多

The protection and application of agricultural intellectual property rights can enhance the vitality,innovation and competitiveness of agricultural economy,and promote the strategy of high-quality agricultural development and rural revitalization. Ginseng is a traditional medicinal variety with superior characteristics in Northeast China,and it is one of the most famous " three treasures" in Northeast China. This paper introduces ginseng( Panax ginseng C. A. Mey.) and its medicinal value,analyzes the traditional knowledge,biological genetic resources,new plant varieties,patents,geographical indications,trademarks and other agricultural intellectual property resources of ginseng,studies the traditional Chinese medicine GAP certification and certification of " Three Agricultural Products" and the construction of the dominant area of agricultural product( Fusong ginseng) with Chinese characteristics,and explores the rural revitalization strategy and traditional Chinese medicine development strategy,ginseng agricultural intellectual property protection and high quality development strategy. 展开更多

Establishing rural land collective property right system with clear ownership,complete powers and functions,smooth transfer,and strict protection is the basic guarantee to the equal exchange of land elements. In this study,the reform of relevant legal systems to China's rural land transfer was introduced firstly,and then the guiding ideology of China's rural land transfer was proposed. Finally,the ways of practicing rural land transfer in China were discussed. Based on the premise of insisting on and improving the strictest land preservation system,farmers should have the right to occupy,use,and transfer their contracted land,and they can transfer their land contracting and management right in ways of exchange,subcontracting,renting,stock cooperation,and trust. Exploring the ways of equal exchange of land elements according to local conditions is an important political and economic issue concerning the livelihood and development of farmers in China,so it should be conducted under the guidance of the correct ideas to integrate scattered land in China's rural areas,develop moderate-scale management,shorten the income gap between urban and rural areas,and realize balancing development of urban and rural areas in China. 展开更多

农村集体产权改革不仅是制度上的调整,更是激发县域经济增长的关键动力。以新一轮农村集体产权改革作为准自然实验,利用2010—2019年间涵盖1911个县域的面板数据,探讨农村集体产权改革对县域经济增长的实际影响,并进一步验证其内在的作... 农村集体产权改革不仅是制度上的调整,更是激发县域经济增长的关键动力。以新一轮农村集体产权改革作为准自然实验,利用2010—2019年间涵盖1911个县域的面板数据,探讨农村集体产权改革对县域经济增长的实际影响,并进一步验证其内在的作用机理和异质性特征,结果表明:农村集体产权改革显著提升了县域经济发展水平;在传导路径方面,农村集体产权改革主要通过提升生产效率、促进产业集聚以及吸引资本流入推动县域经济增长。分组研究结果表明:在东部地区以及市场化程度较高的县域中,农村集体产权改革展现出更加明显的经济拉动效应。为充分发挥农村集体经济的重要资源优势,应提升农村集体产权改革的包容性和灵活度,激发农村集体经济组织的活力,以促进县域经济的高质量增长。 展开更多

农村集体经济组织成员资格认定是农村集体产权制度改革的基础性工作,集体所有权主体的确定是该问题研究的逻辑起点。集体所有权不具有共有和总有等所有权构造类型的特征,同时投资关系说和类比国有资本授权经营体制论都不能对农村集体经... 农村集体经济组织成员资格认定是农村集体产权制度改革的基础性工作,集体所有权主体的确定是该问题研究的逻辑起点。集体所有权不具有共有和总有等所有权构造类型的特征,同时投资关系说和类比国有资本授权经营体制论都不能对农村集体经济组织的产生渊源进行合理解释。在民法规范语境下,应将农村集体经济组织确定为集体所有权主体。就成员资格和成员权利的关系而言,两者相伴而生,成员资格实质上是从权利主体角度对成员权的描述,为成员权在主体面向的表达。基于此,集体成员资格认定的法律实质是对农民所享有的集体经济组织成员权予以确权。我国农村传统经营方式决定了农户是基本经营单位,从逻辑上应当将家庭成员与以家庭为单位取得权益的关系确定为按份共有,集体经济组织成员权主体应为集体经济组织成员而非农户。城乡二元体制导致户籍这一本质上与成员权利取得不具因果关系的因素被纳入认定标准之中,其证明作用不应被忽视。在传统路径下,应构建以出生事实为核心、其他亲缘关系为辅助的主体判断路径,同时明确列举其他除外情形,形成正反双向的认定机制。在农村集体产权制度改革背景下,基于股权类型设置,集体固有成员与股份经济合作社股东在范围上并非完全一致,未来应以恢复农村集体经济组织和集体成员权的私法属性为目标,分阶段对农村集体经济组织成员权制度进行渐进性改革。 展开更多

基于改革政策目标,从产权能力完善、集体经济发展和农民权益保障三个方面,运用熵权TOPSIS法和障碍度模型,对中国30个省(区、市)2014—2021年的农村集体产权制度改革进行综合评价和障碍因子分析。研究发现:中国农村集体产权制度改革水平... 基于改革政策目标,从产权能力完善、集体经济发展和农民权益保障三个方面,运用熵权TOPSIS法和障碍度模型,对中国30个省(区、市)2014—2021年的农村集体产权制度改革进行综合评价和障碍因子分析。研究发现:中国农村集体产权制度改革水平总体呈平稳上升趋势,区域间呈现“东高西低”的特征,各地区改革水平的差距呈逐步缩小态势;各省(区、市)农村集体产权制度改革的主要障碍因子是农业机械化水平、家庭农场发展水平、农村市场化程度、集体经营收入水平、集体经济组织管理能力和农村居民财产性收入占比,基本属于集体经济发展维度,表明农村集体经济发展水平与改革规划目标仍有差距,还需进一步提升集体产权改革的经济效能。 展开更多

改革试点是一种重要的治国理政机制。中国的改革试点不仅是一种纵向的分级制政策实验,在横向上地方改革试点还表现出明显的地方性差异。改革试点对应的是宽泛的政策指导与政策的灵活性,政策执行的条件将直接影响地方改革效能。在地方改... 改革试点是一种重要的治国理政机制。中国的改革试点不仅是一种纵向的分级制政策实验,在横向上地方改革试点还表现出明显的地方性差异。改革试点对应的是宽泛的政策指导与政策的灵活性,政策执行的条件将直接影响地方改革效能。在地方改革试点中,激励结构与问责力度是影响政策执行的两个关键要素。基于全国农村产权制度改革的多案例研究结果表明,地方政府的激励结构、问责强度和资源禀赋构成了地方改革试点的使动条件,地方主政者的行动态度、行动空间和行动能力构成了地方改革试点的能动条件,两者协同促使地方政府采取争先创新、稳妥有序、应付避责与象征执行的行动策略。因此,在地方改革试点中,要营造更具包容性的政策环境,建立相对均衡的制度结构,激发地方改革创新的积极性和能动性,以提升地方治理效能。 展开更多

集体建设用地再开发是盘活存量,促进城市高质量发展的主要途径,伴随着集体土地产权制度路径依赖式的变迁:自上而下的土地确权正式化集体建设用地的存在,赋予村集体权利,但在土地初次开发中自下而上形成的制度制约着改造。文章探讨制度... 集体建设用地再开发是盘活存量,促进城市高质量发展的主要途径,伴随着集体土地产权制度路径依赖式的变迁:自上而下的土地确权正式化集体建设用地的存在,赋予村集体权利,但在土地初次开发中自下而上形成的制度制约着改造。文章探讨制度变迁下,地方政府如何与村集体互动,化解上述制度制约,促进集体建设用地市场化改造的。研究发现,集体建设用地正式化开启了改造市场,但仍受空间破碎、集体土地经营内卷化、开发权模糊的约束。地方政府发挥了企业化的非正式角色,与村集体形成合作与竞争并存的协商型合作关系。合作在于政府从供、需两侧化解前述制约,充当村集体与市场主体间的“交易中介”,降低交易成本,助力改造。竞争表现为村集体为攫取地租把持政府,损害社会公平。地方政府的“非正式”角色应予以制度化,以规避其在维护社会公益上的失灵。 展开更多

基于集体所有制对农村体育的历史审视及学术反思

新中国成立后,在中国共产党领导下迅速形成的具有社会主义性质的集体所有制,既是组织农业生产的一项基本经济制度,也是治理农村社会的一项基本政治制度,还是改善农民生活的一项基本民生制度。因此,新中国成立后70多年来农村集体所有制... 新中国成立后,在中国共产党领导下迅速形成的具有社会主义性质的集体所有制,既是组织农业生产的一项基本经济制度,也是治理农村社会的一项基本政治制度,还是改善农民生活的一项基本民生制度。因此,新中国成立后70多年来农村集体所有制的形成、改革与完善,必然左右着农村体育发展的方向和路径,决定着农村体育发展的组织与机制,制约着农村体育发展的规模与形式。该研究采用历史阐释和社会批判的方法,分析集体所有制在不同的历史时期对农村体育发展以何种原因和何种方式产生影响。结果显示:社会主义改造和“农业合作化运动”,使广大农民走上了集体化的合作道路,加速了农民对体育的社会主义认知;社会主义建设和人民公社体制,奠定了农村集体所有制的制度基础,为推动农村体育开展提供了基本的组织方式;改革开放和“家庭联产承包责任制”,重塑了农村的生产关系和社会结构,为农村体育提供了内在的需求与动力;新时代和农村土地制度改革的深化,推进了新型农业经营体系的形成,为农村体育提供了新的发展路径和走向。 展开更多
