Nowadays,with the development of the digital economy,commercial banks are actively conducting digital transformation.Studying the impact of the digital transformation of commercial banks on their operating performance can help commercial banks form a stronger core competitiveness and promote high-quality financial development.Based on the above background,this article first describes the status and development of digital transformation and development of commercial banks,and secondly analyzes whether Chinese commercial banks’digital transformation is conducive to improving their operating performance.Thirdly,by selecting the data of the listed commercial banks in the ten years of 2012–2022,this article obtains the empirical testing of the digital transformation on different property rights.Finally,the higher the level of digitalization,the higher the digital level,the more significantly promotes the performance of commercial banks.Finally,based on the above analysis,this article puts forward feasibility opinions on commercial banks and related regulators.

Political Connection, the Nature of Property Rights, and Enterprise M＆A Performance——Empirical Study based on the Panel Data of Listed Companies

Mergers and acquisitions （M＆A） are the important methods to quickly acquire external resources, achieve the economies of scale and the economies of scope, improve market share, and expand the scale of enterprise, while M＆A performance is an important index to measure if enterprise M＆A is successful. In this paper, the influence of entrepreneurs＇ political connection on the M＆A driving factors and M＆A efficiency of the enterprises with different property rights are analyzed using 357 mergers and acquisitions of China＇ s 189 listed companies in 2005-2011 as samples based on the distinction between political connection and the nature of enterprise property rights. The results show that the political connection plays a very significant positive influence on the M＆A performances of the central state-owned enterprises and private enterprises, but exerts a very significant negative influence on the local state-owned enterprises; the intensity of entrepreneurs＇ political connection also plays a certain influence on enterprise merger and acquisition, and the central political connection and the local political connection are significantly different in the influence on the enterprise M＆A performance.

Impacts of Changes in Structure of Rural Land Property Rights on Agricultural Performance

In the reform process of the rural land property rights system,the incentive mechanism of the rural land property rights system has a crucial impact on the production activities of rural economic entities.Due to the different rights structures of the property rights system in different social and economic development stages,the land rights and interests enjoyed by rural economic subjects are different,and the degree of incentives for farmers is also different.This difference in incentives affects farmers investment in agricultural production factors,which in turn affects agricultural performance.This paper analyzes the incentive impacts of the structure of rural land property rights on the changes of farmers land rights and agricultural performance since the founding of the People s Republic of China,in order to further deepen the reform of the land system,protect the rights and interests of farmers,promote the modernization of agriculture and rural areas,and explore the realization form and operation mechanism of the rural collective land system in the new era.

Simulation research on dynamic performance of the new type high-pressure solenoid valve

To improve energy density,the transportation,storage,and operations of hydrogen,methane,and compressed air vehicles currently require high-pressure compression.High-pressure solenoid valve becomes the vital element to above system.In order to reduce leakage and aerodynamic force influence,a new type high-pressure solenoid valve was proposed.The simulation model which included electromagnetic model,aerodynamic force model was established by means of the nonlinear mathematic models.Using the software MATLAB/Simulink for simulation,the dynamic response characteristics of high-pressure pneumatic solenoid valve were obtained under different pulse width modulation(PWM)input control signals.Results show that,first of all,the new type of high-pressure solenoid valve can meet the switch requirement.Secondly,the opening movement and closing movement of the spool lags the PWM rising signal,and the coil current fluctuates significantly during the movement of the spool.Lastly,on/off status of high-pressure valve cannot be represented by the duty cycle.This research can be referred in the design of the high-pressure solenoid valve..

Right Ventricular Outflow Tract Septal Pacing versus Apical Pacing: A Prospective, Randomized, Single-blind 5-Years Follow-up Study of Ventricular Lead Performance and Safety

Summary： Lead placement for ventricular pacing variably impacts the physiological benefit of the pa- tient. This study evaluated the ventricular lead performance and safety of right ventricular outflow tract septal pacing in patients with bradyarrhythmia in South China over 60-month follow-up. Totally, 192 patients （108 males, and 84 females, 63-4-21 years old） with bradyarrhythmia were randomly divided into two groups. The right ventricular outflow tract septum （RVOTs） group had lead placement near the sep- tum （n=97）, while the right ventricular apex （RVA） group had a traditional apical placement （n=95）. RV septal lead positioning was achieved with a specialized stylet and confirmed using fluoroscopic projec- tion. All patients were followed up for 60 months. Follow-up assessment included stimulation threshold, R-wave sensing, lead impedance and lead complications. The time of electrode implantation in both the ROVTs and RVA groups were significantly different （4.29±0.61 vs. 2.16±0.22 min; P=0.009）. No dif- ferences were identified in threshold, impedance or R-wave sensing between the two groups at 1 st, 12th, 36th and 60th month during the follow-up period. No occurrence of electrode displacement, increased pacing threshold or inadequate sensing was found. The long-term active fixation ventricular electrode performance in RVOTs group was similar to that in RVA group. RVOTs pacing near the septum using active fixation electrodes may provide stability during long-term follow-up period.

Usefulness of myocardial performance index for assessing right ventricular function after percutaneous closure of atrial septal defect

Objective Assessment of right ventricular function in patients with atrial septal defect(ASD)is difficult.The Doppler myocardial performance index(MPI)may provide a method of assessing function in these patients.The purposes of this study were to evaluate the right ventricular function and its changes in patients with ASD after transcatheter closure of ASD.Methods MPI,defined as the sum of isovolumic relaxation time and isovolumic contraction time derived by ejection time,was measured from tricuspid inflow and right ventricular outflow;Doppler velocity profiles recorded during routine echocardiography.Twenty nine patients(13 men,16 women;mean age 25.28±12.69,range 6 to 57 years)were diagnosed to secundum ASD[the stretched diameters of ASD were from 9 To 36(24.91±7.98)mm],and had a successfully placed Amplatzer septal occluder(ASO)(the sizes of ASO were from 11 to 40 mm);there were 81 sex-matched,age-matched healthy people(control group 41men,40 women;mean age 29.02±14.22,range 4 to 45 years).MPI was measured again on 3 days and 1 month after closure of ASD.Change in the study group was assessed and compared to the control subjects with structurally normal hearts.A complete 2-dimensional and Doppler echocardiographic examination was performed in all study groups.Results 1)The isovolumic relaxation and isovolumic contraction times[respectively(77.59±14.39)ms vs(60.93±12.94)ms,P<0.0001;(28.28±10.88)ms vs(23.64±9.01)ms,P=0.027]were prolonged,and ejection time[(260.65±21.86)ms vs(271.85±21.92)ms,P=0.033]was shortened in patients with ASD compared with that in control subjects,resulting in a marked increase in the MPI(0.40±0.07 vs 0.31±0.05,P<0.0001)from normal values;2)by Pearson's correlations,the MPI had no correlation with heart rate and blood pressure in control subjects and patients with ASD,but it correlated positively with age in patients with ASD;3)by Pearson's correlations,the MPI correlated positively with the diameter of ASD and pulmonary artery pressure;4)after transcatheter closure of ASD,the MPI decreased markedly.Conclusions 1)MPI is a conceptually new,simple,and reproducible Doppler index in patients with ASD;2)MPI is free from the effect of age,heart rate and blood pressure;(3)MPI appears to be relatively dependent on changes in the diameter of ASD and pulmonary artery pressure;4)the right ventricular function was improved after transcatheter closure of ASD.

Study on Farmers' Cognition and Willingness to Plant Trees during Collective Forest Right Reform Based on Data from Plain Areas of Henan Province

On the basis of the survey data from plain areas of Henan Province,farmers' cognition and willingness to plant trees in collective forest right reform are studied. According to statistical analysis and regression equation of binary logistic regress analysis,it is generally believed that different participants have various attitudes to the reform,with regard to if planting trees or more,reform variables have a distinct effect,as well as income variable and loaning or lending variable. At last,some advices are put forward,that is,the government should strengthen collective forest right reform,accelerate matching reform and increase policy and financial support to forestry farmers.

The debate concerning abortion abounds in miraculous narratives. Judith Jarvis Thomson has contrived the most celebrated set among related ones, to wit the ＂violinist analogy,＂ the ＂Good Samaritan＂ narrative, and the ＂Henry Fonda＂ allegory, by virtue of which, she intends, on the one hand, to argue that women＇s right to autonomy outweighs the alleged fetus＇s right to life, and on the other, to prove that no positive moral duties can be derived towards other persons alone from the fact that a moral agent is ascribed certain rights. What this short paper endeavors to prove is that Thomson＇s argumentation by analogy is a weak one, since neither the number nor the relevance of similarities invoked is adequate or satisfactory, while crucial parameters concerning the morality of abortion are being totally overlooked.

Top Executive Turnover and Finn Performance Evidence From China

By using the data of the listed companies in Shanghai and Shenzhen stock market---a share market as a sample from 2003 to 2007 to analyze the relationship between corporation performance and top executive alteration, different succession modes get different efficiency. The result shows that： The decline of company performance will cause the top executive turnover, and that the possibility of top executive turnover in non-state-owned listed companies is higher than that of the state-owned companies. In the routine turnover sample, the performance level of the internal succession is better than that of the external succession. In the non-routine turnover sample, the results are reversed. For further analysis, the main sources of the improvement for performance are items of below-the-line and non-recurring profit and loss, rather than the company＇s operating revenue.

Knowledge, Understanding and Attitude Toward Civic Rights and Duties in Administrative Affairs and People＇s Participation in Local Administration of Mahasarakham Municipality

This research aimed to study on the people and the local government. The samples were 395 respondents over 18 years old, selected locally of Mahasarakham Municipality, Thailand. The research found that the level of knowledge, understanding, and attitudes toward civic rights and duties of administrative affairs was at a high level but participation in the local administration was rated at a low level. The relationship between knowledge, understanding, and attitudes toward civic rights and duties of administrative affairs of the community was positive correlated. The relationship between knowledge and understanding toward civic rights and duties and participation in the community administration and the relationship between attitudes toward civic rights and duties in administrative affairs and participation in the local government administration were not correlated. Some recommendations were the local government organizations should promote and provide more information to build the right understandings and improve good attitudes toward civic rights and duties in administrative affairs. Local administrators and local leaders should play an important role to advocate and encourage public opinions toward a political ideology to ensure the public mind and make the vision ＂people-centered＂. Most importantly, the State shall pursue directive principles of State policies in relation to public participation.

能源法的法权构造及其体系展开

能源法的核心范畴界定较为模糊,亟待澄清。基于能源权利与能源权力的交互性、能源公益与能源私益的均衡性、能源监管与能源市场的协调性等需求考量,法权可作为能源法的核心范畴。能源法法权结构可从本体论、运行论和价值论三个层面予以构造,形成体系化安排。本体论上,应以公民能源权利与国家能源权力的交互为基础,强调公民能源权作为法权结构的逻辑起点、以落脚为能源普遍服务的能源权力作为法权结构的基本保障;运行论上,应以能源合同作为法权结构运行的具体承载;价值论上,应以能源正义作为法权结构价值的最终目的。由此,可仰仗能源法的法权结构构筑能源法学体系。

《公司法》修改中治理制度的创新、不足及完善

组织设置不合理、权责配置失当、股东行权保障不足、信义义务内容过于抽象是引发我国公司治理实践出现诸多问题的症结所在。在《公司法》修改中,三份草案和修订案都赋予章程设定除股东会及董事会之外的其他公司组织的自主权。新法通过降低股东临时提案权行使门槛、优化知情权行使规则、细化信义义务内容等方式力保股东权行使顺畅。但优化后的公司治理制度仍然存在不足:审计委员会的职能内容、人员构成及保障独立性的手段不合理或缺失,股东提案审查、持股期限要求及救济途径不够具体,针对董事和控股股东的责任规则亟待完善。立法应明确审计委员会的监督职能,区分其与监事会的责权界限;规定股东会召集人作为提案审查主体,增设事前救济机制作为股东行权保障;确认控股股东在公司治理中的实质地位,并实行职权代行制度;还应通过立法强化控股股东的行权规范。

国有企业负责人经营业绩考核:制度特征分析与指标维度优化

业绩考核制度是落实企业责任、激发企业活力,并由此推动经济社会运行的重要机制。在对比股东主导和市场主导两种业绩考核逻辑,分析、认知国有企业负责人经营业绩考核制度的基础上,探究了业绩考核制度的本质特征,即国有企业负责人经营业绩考核制度是一项以考核为抓手的产权管理体系,是以目标设定与过程管理为核心的“自驱式”机制设计。强调应唯经营(而非考核)出业绩,并且正向激励与风险容错是业绩考核赋能企业发展的重要属性。现行业绩考核指标体系还难以引导国有企业高质量发展,建议围绕“产业布局、经营生态、创新驱动、风险管理、财务收益”五个维度进一步优化国有企业负责人经营业绩考核指标,且以年度考核为核心,形成导向明确、相对稳定、可预期的考核指标体系,并赋予企业负责人一定的自由裁量权,以提高考核制度效果,助力中国经济高质量发展。

ESG表现与企业高质量发展:理论分析与实证检验

选取2010-2022年中国沪深A股上市公司数据,采用华证ESG得分衡量ESG表现,基于“双碳”目标对ESG表现与企业高质量发展之间的作用机制进行研究。研究结果显示,良好的ESG表现可以促进企业高质量发展,且主要通过获得更高的政府补贴助力企业的高质量发展。进一步研究发现,数字化转型可以正向调节ESG表现对企业高质量发展的促进作用;异质性结果表明,ESG表现对企业高质量发展的积极影响在国有企业中更为显著。

用能权交易制度对城市碳排放绩效改善的影响研究

用能权交易制度作为我国实现绿色发展的一项重要制度创新,对改善城市碳排放绩效具有重要意义。本文基于2006~2022年我国281个地级市的面板数据,采用双重差分模型检验用能权交易制度对城市碳排放绩效的作用机制及其溢出效应。研究发现:(1)用能权交易制度显著降低城市碳强度和提升碳全要素生产率;(2)用能权交易制度有利于非老工业基地和资源型城市碳强度的降低,同时也有利于非老工业基地和非资源型城市碳全要素生产率的提高;(3)用能权交易制度主要通过结构效应、创新效应和监管效应等途径改善城市碳排放绩效;(4)用能权交易制度的碳排放改善作用存在显著的正向空间溢出,能够实现环境红利和社会福利相容发展。因此,稳步扩大试点政策范围,积极探索实现路径和推进区域协同是实现绿色低碳的重要保障。

论妨碍探望的民事责任

探望被妨碍的救济问题应纳入债之关系进行处理。增加直接抚养方父母压力不能成为排斥适用债法规范的当然理由。根据双方是否存在探望权行使约定,可相应形成违约损害赔偿责任、法定义务不履行责任与侵权损害赔偿责任等形态。探望权约定作为纯粹身份关系协议具有一定的法律约束力,在不直接损害未成年子女利益的前提下,可根据《中华人民共和国民法典》第464条第2款,参照适用违约责任规范。即使欠缺双方具体约定,双方之间亦存在法定义务,直接抚养方父母不仅有协助间接抚养方父母行使探望权的义务,而且有保护间接抚养方父母相关财产利益的义务。在直接抚养方父母不履行义务时,可经由《中华人民共和国民法典》第468条链接债务不履行责任规范。探望权在对外层面具有绝对权性质,受侵权法保护。无论基于何种责任基础,均应采一般过错归责,无益费用均可纳入损害赔偿范围。

数字时代表演者权的扩张--基于虚拟数字人的分析

表演者权随着经济、社会、文化和技术的发展不断演进,而虚拟数字人的崛起给表演者权制度带来了新的挑战。虚拟表演是数字时代表演数字化的全新形式,也是作为“演员”的虚拟数字人通过自己的动作、姿势、表情、声音等呈现作品的方式,能够纳入表演者权制度框架中。虚拟数字人则是技术和身体融合后愈发具有人格化特征的新型主体,应当属于著作权法意义上的表演者。承认虚拟数字人作为表演者的独立地位,保留其精神权利,并通过职务表演确定经济权利的归属与行使,以推动法律对技术与现实进行回应。
