Exploration on Detailed Control Planning Under Urban-Rural Planning Law:A Case Study on Wuhan

Based on the planning practice in Wuhan after the Urban-Rural Planning Law was implemented in 2008,this paper reviews the evolution of detailed control planning in China,and addresses its main problems and conflicts.The innovation of the hierarchical planning and administration system is discussed,and the administrative measures for the transition period in which the detailed control plans have not yet been made for all the urban areas is proposed.

Overall Planning of Development of Urban-Rural Areas:A Policy Mechanism for Urban-Rural Coordinated Growth

While analyzing overall planning and coordinated development of urban-rural areas, this paper shows that overall planning for the development of urban-rural areas is a requirement for the best use of productive forces. It means the setting up of a policy mechanism for coordinated growth. Recognizing this, the government should set up a way to lead and manage a unified program to increase service and decrease controlling administration power, while safeguarding and fulfilling the farmers' ownership to the means of production.

Modeling of UAV path planning based on IMM under POMDP framework

In order to enhance the capability of tracking targets autonomously of unmanned aerial vehicle (UAV), the partially observable Markov decision process (POMDP) model for UAV path planning is established based on the POMDP framework. The elements of the POMDP model are analyzed and described. The state transfer law in the model can be described by the method of interactive multiple model (IMM) due to the diversity of the target motion law, which is used to switch the motion model to accommodate target maneuvers, and hence improving the tracking accuracy. The simulation results show that the model can achieve efficient planning for the UAV route, and effective tracking for the target. Furthermore, the path planned by this model is more reasonable and efficient than that by using the single state transition law.

Study on Overall Concept Planning of Terminal Correction Mortar Projectiles

The system composition, the operational principle of terminal correction mortar projectiles （TCMP） and the concept planning design of TCMP are researched in this paper. An overall design and aerodynamic configuration layout for TCMP are made in this paper, and its aerodynamic coefficients are calculated by using computational fluid dynamics （CFD） software. Test results of TCMP simulated ballistic projectiles indicate the designed TCMP can satisfy the interior ballistic demand and has a fine flight stability. The drag coefficients identified from the radar velocity-time data are in accord with the CFD computed results. According to the exposure frequency of the ground laser designator, a four-quadrant impulse correction scheme and a high exposure frequency impulse correction scheme are brought. The latter can calculate the target azimuth angle by counting the times of the facula passing through one quadrant. Simulation results also show that the guidance precision of the velocity pursuit is higher than that of the body pursuit, and the detector axis is less circuitous. Researches on the typical trajectory indicate that the terminal impulse correction can improve the hit precision of TCMP remarkably.

Study on Low-carbon City Planning Strategies Based on Urban Greenhouse Gas Inventory

From the perspective of urban greenhouse gas inventory, this paper analyzed the composition and tendency of urban greenhouse gas inventory of Guangzhou, and compared greenhouse gas inventory of representative international cities. Taking Guangzhou Haizhu Eco-city for example, this paper from the perspective of urban-rural planning put forward the low-carbon development paths and strategies such as increasing carbon sink, industrial transformation, spatial restructuring, traffic organization, green civil engineering and resource utilization, and green building for the main carbon-emitting fields such as industry, energy supply, transport, building and waste disposal.

Use of Augmented Reality Methods to Support Legal Conflicts in the Planning Process for Wind Turbines Using the Example of the Landscape Conservation Area “Eulenkopf and Surroundings”

The world’s growing energy demand poses a serious problem. At the same time fossil fuels are finite, which we must work against. Therefore, the Federal Government of Germany has set itself the goal to push forward the use of renewable energy in order to completely do without the generation of nuclear energy by 2023. There are, however, no specific guidelines from the European Directive on the promotion of electricity from renewable energy sources for the internal electricity market regarding how high each share of the different production method should be and, above all, which specific aim should be achieved by the share of wind energy. Nevertheless, it presents a crucial step toward a nuclear phaseout and a concomitant change of course of the Federal Government of Germany in the spring of 2011 regarding the expansion of renewable energy, taking the nuclear catastrophe in Fukushima into account. Using new legal planning approaches, also including the area of Rhineland-Palatinate, opportunities should be provided to make previously protected land available for setting up facilities for the generation of renewable energy. However, it is important to examine the legal situation regarding the installation of these kinds of constructions more detailed, as no general statements can be made. This will be illustrated using the example of the landscape conservation area “Eulenkopf and surrounding area” in the district of Kaiserslautern. The stated goal of the Social Democrat/Green coalition of the federal state government of Rhineland-Palatinate is to considerably expand the generation of electricity from renewable energy sources so that by 2030 at least the entire electricity demand can be covered by those. Due to the enormous potential of wind power, it is therefore necessary to quintuple its share of electricity generation by 2020, compared to 2011 numbers. In order to achieve the desired political objectives, by 2030 the number of turbines has to be increased to around 2650, representing a capacity of 7500 MW. This increase gives reason for boundary conditions to manage the generation of wind energy to be adjusted. This is intended to facilitate management and simultaneously minimise negative effects, such as the “sprawling” of wind turbines.

A Bicycle Tourism Based Study on Planning and Designing of Urbanrural Recreational Greenway--A Case Study of Harbin City

The types of urban-rural recreational greenways were summarized,based on bicycle tourism and their planning methodology was explored.Taking the urban and rural areas of Harbin City as the research objects,the current situation of urban-rural recreational greenway environment and tourism resources was investigated and the evaluation system of bicycle tourism resources was established and tourism resources were evaluated according to the AHP-fuzzy comprehensive evaluation method to select suitable resources for bicycle tourism.Through the ArcGIS software,the currently available resources(rivers,wetlands,transportations and urban-layout)and suitable bicycle tourism resources were superimposed,and the spatial pattern planning and classification planning of urban-rural recreational greenway based on bicycle tourism were carried out.To the end,insights for the development of urbanrural recreational greenway in the future were provided.

Land-Use Planning Guidelines for Optimal Coastal Environmental Management

The objective of this study is to weigh and recommend environmentally-optimal regional land-use planning guidelines for coastal regions. The present malaise is assessed, as regards inefficiencies, non-suitability, non-sustainability, enhancing factors of environmental degradation, and potentially destructive consequences of current land-use alteration. Desired situations and goals are considered, and means are proposed for bridging the gap between the present malaise and a desired situation, based on five key approaches developed by the authors. Specific examples of regional approaches are presented. Guidelines and operational measures for sound regional planning the authors have employed in similar circumstances are recommended.

Law School of Nankai University Holds International Seminar on National Human Rights Action Plan

The Information Office of the State council issued the first National Human Rights Action Plan of China （NHRAP） （2009-2010） on April 13, 2009. The Nankai University participated in the drafting of this significant national document on human rights, with three teachers invited one after another to work at the panel of experts under the drafting committee. In cooperation with the Raoul Wallenberg Institute of Human Rights and Humanitarian Law （RWlHRHL） of Sweden, the Research Center for Human Rights under Law School of the university held an international seminar titled ＂Formulation and Implementation of NHRAP- Swedish Experience.＂

新时期长江流域水资源保护规划及管理工作的思考

组织编制并实施水资源保护规划是国家赋予水行政主管部门的法定职责,也是水利部门履行水资源管理和生态环境保护责任的重要工作。长江流域水资源保护规划经历了从起步、探索、实践与发展到形成完善体系的过程,推进了流域水资源保护与管理科学有序发展。随着国家机构改革部门职能调整和《中华人民共和国长江保护法》出台,为更好地推进和落实新时期长江流域水资源保护规划和管理工作,系统梳理长江流域水资源保护规划发展历程与成效,分析当前流域水资源保护面临的形势与挑战,厘清流域水资源保护工作定位和思路,并据此提出新时期流域水资源保护规划及管理的工作建议,对凝聚流域水资源保护规划共识、建立流域水资源保护规划体系、推进水资源保护高质量发展、助力实现治江现代化具有重要的指导意义。

破产法修改中的重整制度

破产法规定的重整程序在司法实践中发挥挽救重要企业作用的同时,也逐步显现出其存在的制度不足与缺陷,需进行修订。法院受理债权人提出的清算申请后,应允许其他债权人申请转换重整程序。债务人申请破产清算后,仍有权申请转换重整程序。法院对重整申请应进行识别审查,对明显不具有挽救价值和可能者应不予受理。重整计划提交期限应适当延长,以应对投资人招聘难等困境。要强化管理人的信息披露义务,并建立争议解决、责任追究等制度。因无法列示穷尽法律上和实践中的不同权益组别,法律对重整计划表决分组的规定应为指导性。权益不因重整计划受到不利影响的债权人等利害关系人不参与表决。法院对重整计划的正常批准或强制批准,都必须审查并保障反对组别及同意组别中反对者个人享有的法定清偿权利。至少应有一个债权人组表决通过重整计划,法院方可强制批准。强制批准重整计划应设有听证及异议救济程序。立法应限制重整计划二次表决的间隔期间。二次表决前,可以协商调整原表决通过组别的清偿权利,但应保障受不利影响组别均享有表决权。破产法应对于未及时申报债权之债权人,在重整计划执行完毕后依同类债权清偿条件向债务人行使权利,予以严格限制。立法应在因法律政策调整、市场情况变化等导致重整计划无法执行时,设置计划变更制度。

涉村庄规划案件裁判规则的构建思路——以农村住房建设纠纷为切入点

较之于相对完备的城市建设规划制度,乡村建设规划制度起步晚、实施难度大。在农村住房建设纠纷中,实际用地情况与现时规划是否符合、规划调整有无引发权利减损是常见的法律争议点。这些问题的出现与乡村建设规划制度在概念阐释、程序建构、补偿制度等方面不够完善相关,并将对村民土地财产权利产生影响。在构建此类案件的裁判规则时,既要重视村庄规划的法定效力,又要结合地方历史政策、村庄规划的现时状态等情况进行综合评价。对于因规划变更造成财产损失的村民,需进一步明确补偿机制。

基于345-修正梯形运动规律的4-RR(SS)_(2)并联机器人运动轨迹规划

研究了一种新型四自由度高速并联机器人运动轨迹规划方法。该机器人采用单动平台结构以减轻末端平台质量,提升机器人加减速性能。建立机器人机构运动学逆解模型,通过融合345多项式和梯形运动规律的优点,构造一种可兼顾运动时长和运动平稳性的345-修正梯形运动规律。在此基础上,通过插补叠加轨迹过渡传统门形轨迹的直角部分,并统筹考虑总运动时长最短以及角加速度峰值最小为目标完成插补叠加时机的优选,最后在样机上开展运动频次试验。试验结果显示,采用优化后的运动规律和轨迹样机运动频次可提升至218次/min,工作效率较传统Adept门形轨迹提高55.7%。

基于分形理论与幂律分布的微观天际线量化分析

城市天际线又称城市轮廓或全景,是城市景观的重要组成部分,利用分形理论与幂律分布方法可以为城市规划师或建筑师提供重要的理论支持。以郑州市为例,运用分形理论和幂律分布方法,对郑州市微观天际线的分形特征和相关建筑高度幂律分布进行研究。研究结果为深入理解微观天际线的形态特征和分布规律提供了有力的理论支持,在深化对城市天际线复杂性认识的同时,也为城市规划设计提供一定的参考。

基于贪心策略的改进动态搜索方法在武器目标分配中的应用

数学中最优化理论是解决分配管理问题的一种常用手段。在战略中对武器目标的分配为了得到最好的效益,通常会将其建立分配优化模型。当构建诸多模型时,往往代价成本都比较大,因此经常划分若干过程进行求解。传统算法设计上,较为突出的就是动态规划,它是一个多阶段决策问题。论文分析武器目标分配的数学背景以及最优化理论的应用策略,分析了动态规划等策略的实际求解过程在武器装备分配问题上的应用。并提出了一种基于贪心策略的改进动态搜索方法,这种方法在处理规模已定的情况下,查找精确值的效率相比动态规划方法具有明显的提升。在作战软件的算法设计上有良好的借鉴价值。

涉外法治工作战略布局探析

加快涉外法治工作战略布局,事关涉外法治工作的顶层设计,是统筹推进国内法治和涉外法治的关键环节。现有的涉外法治研究主要是从职能角度出发,关注涉外立法、执法、司法和法律服务等领域的内容,对涉外法治工作战略布局缺乏必要的关注。现阶段,涉外法治工作战略布局可重点关注以下三个维度:一是政策层面的战略规划。涉外法治具有内在的特殊性,需要研究制定专门的战略规划,包括专门战略规划体系和统筹协调机制。二是规范层面的法治措施。为丰富涉外法治措施储备,应从整体上优化涉外法治规范体系。除了健全涉外法律法规体系,加强我国法域外适用法律体系建设,还有必要建设国际条约和判例数据库。三是实施层面的应对机制。涉外法治工作应对机制的建立,应当致力于应对国家利益面临的风险挑战,主要涵盖法律风险预警机制、法律争端解决机制、涉外法务工作机制和国际交流合作机制等领域。涉外法治工作战略布局需要与国内法治紧密衔接,共同服务国内国际两个大局。

从RCEP到CPTPP:浅析两大协定对中国知识产权保护的启示

以《区域全面经济伙伴关系协定》(RCEP)和《全面与进步跨太平洋伙伴关系协定》(CPTPP)为代表的区域性自由贸易协定对知识产权保护提出更高要求,特别在全球数字变革的风口下要注重数字变革与知识产权协同保护。通过对比RCEP、CPTPP两个协定中有关知识产权保护的规定,找到两个协定在著作权和相关权利、商标和地理标志、专利和关于知识产权权利实施的执法程序等方面有相同点,但在版权和相关权、技术保护措施和权利管理信息等方面不相同;基于此分析两个协定对中国知识产权保护规则的影响与挑战,预测国际知识产权的变化趋势,提出对标国际知识产权新规则的中国方案,包括全面加强数字环境的知识产权保护、构建良好的数字产权发展环境、提升知识产权转化效益、推动国内产业创新发展、推进数字知识产权保护国际合作与交流等。强调中国应积极参与知识产权国际事务,提高发展中国家的代表性和发言权,为日后参与制定知识产权国际规则打下基础。

就业导向下优化“双轨制”法学研究生课程的改革路径

培养法学类研究生的就业能力是研究生课程所要实现的重要目标。以就业为导向优化法学研究生课程改革不仅有助于实现学校层面学科建设、人才培养的重要目标,更是落实“全面推进依法治国”战略的重大举措。当前,“双轨制”法学研究生课程改革面临课程体系设置雷同,课程实践教学环节效果不明显,课程教学互动与培养目标未有效匹配,课程教学考核设计不合理等问题。为优化法学类研究生的课程改革,建议设置科学合理的研究生课程体系、优化“双轨制”法学研究生课程的教学内容、创新“双轨制”法学研究生课程的教学方法、规范研究生课程的教学考核评价机制。

刑事合规概念证伪

在合规本土化进程中,理论界与实务界均出现合规的刑事化倾向,乃至将合规直接替换为刑事合规,且常以意大利、德国的刑事合规理论用以说明刑事合规概念的合理性所在,但经过对意大利、德国的合规理论探源可以发现,刑事合规概念实为名不副实。我国本土法治资源也难以为刑事合规概念提供合理性说明,无论是法律规范资源,还是法律实践现状,刑事合规概念都难以契合。合规作为系统治理手段,应当着重综合协调治理,不应突出刑事法主体地位。

陆海统筹背景下海警机构行使海洋生态环境保护执法权路径选择

陆海统筹背景下海警机构作为海洋生态环境保护工作的主要驱动力愈显重要。然而,实践中海警机构行使海洋生态环境保护执法权存在着较大阻碍,具体表现在海警机构司法主体地位不明,海警机构与其他部门执法联动机制遭遇瓶颈以及执法人员能力参差不齐等问题。为此,需要严格把握《中华人民共和国海警法》(以下简称《海警法》)、新《中华人民共和国海洋环境保护法》的相关法律规定,平衡两部法律矛盾点,夯实海警机构与陆上执法部门协作机制,进一步提升海警机构海洋生态环境保护工作的执法能力,筑牢海洋生态屏障,助力海洋强国建设。
