Studies on forest sustainable development and issues under the condition of WTO's principles in China

The World Trade Organization (WTO), an international organization to deal with the world free trade mechanism, allows for the optimal use of the world's resources in accordance with the objective of sustainable de... The World Trade Organization (WTO), an international organization to deal with the world free trade mechanism, allows for the optimal use of the world's resources in accordance with the objective of sustainable development and the protection of environment and trade. China, as a state member of WTO, is challenged by the WTO's agreements and the principles to guideline China sustainable forest development in the future. Forest resources in China will be protected as the basic sections of natural resources. The administrative function of Chinese government will be reformed by the condition of WTO's principles. So, the aim of China forest sustainable development is prior to deal with the relationship between the environment protection and development of economy. Under the condition of the WTO's principles and as a base on the international customary laws, the issues of China forest sustainable development focus on the China forest system reformation that applies for the China nature forest stratagem by the laws and protects the China environment for the sustainable development under the condition of science development, especially in the China forest protection and in dealing with the relationship among the environment and the economy development and others. Establishing the zoological forest industry is basic requirement by both the WTO's agreements and the WTO's principles, especially under the GATT 1947 Art XX, and other principles to protect the China forest sustainable development and to create the international environment for China forest. Abstract:For departmental legal norms concerning citizens’basic rights,when multiple interpretations are possible based on indi-vidual case circumstances,interpreters representing public authority need to apply the method of constitutional interpretation to screen out the interpretation conclusions that do not violate the Constitution.This means selecting interpretations at the constitutional level that do not overly restrict citizens’basic rights and understanding the specific connotations of legal norms with the principle of“not infringing on citizens’basic rights.”The Constitution,as a framework order,does not require interpreters to choose the most constitutionally aligned interpretation among various constitutional interpretations.If a legal norm does not have a constitutional interpretation conclusion in an individual case circumstance,it indicates that the application of that norm in the case is unconstitutional,and the interpreter should avoid applying the legal norm in that case.Regarding judgment standards,interpreters should apply the principle of proportionality to deter-mine whether each legal interpretation conclusion concerning basic rights-related legal norms complies with the Constitution.Out of respect for the legislature,the application of the sub-principles of pro-portionality should consider the boundaries of interpretative actions. 展开更多

The rapid advance of autonomous vehicles(AVs)has motivated new perspectives and potential challenges for existing modes of transportation.Currently,driving assistance systems of Level 3 and below have been widely produced,and several applications of Level 4 systems to specific situations have also been gradually developed.By improving the automation level and vehicle intelligence,these systems can be further advanced towards fully autonomous driving.However,general development concepts for Level 5 AVs remain unclear,and the existing methods employed in the development processes of Levels 0-4 have been mainly based on task-driven function development related to specific scenarios.Therefore,it is difficult to identify the problems encountered by high-level AVs.The essential logical and physical mechanisms of vehicles have hindered further progression towards Level 5 systems.By exploring the physical mechanisms behind high-level autonomous driving systems and analyzing the essence of driving,we put forward a coordinated and balanced framework based on the brain-cerebellum-organ concept through reasoning and deduction.Based on a mixed mode relying on the crow inference and parrot imitation approach,we explore the research paradigm of autonomous learning and prior knowledge to realize the characteristics of self-learning,self-adaptation,and self-transcendence for AVs.From a systematic,unified,and balanced point of view and based on least action principles and unified safety field concepts,we aim to provide a novel research concept and develop an effective approach for the research and development of high-level AVs,specifically at Level 5. 展开更多

《中华人民共和国刑事诉讼法》修改已被列入全国人大常委会立法规划,在本次修改中应当回应数字时代的需求,关注在刑事诉讼中运用新型数字技术所带来的新问题。在基础理念层面,应当协调数字时代刑事诉讼中技术运用和人权保障的关系,兼顾... 《中华人民共和国刑事诉讼法》修改已被列入全国人大常委会立法规划,在本次修改中应当回应数字时代的需求,关注在刑事诉讼中运用新型数字技术所带来的新问题。在基础理念层面,应当协调数字时代刑事诉讼中技术运用和人权保障的关系,兼顾法律修改的前瞻性与稳妥性,平衡数据安全与个人信息保护之间的冲突。在基本原则层面,应当确立合法原则,要求目的、程序与手段的合法性;通过确认比例原则,协调目的、手段与后果之间的关系;依据区分处理原则对对象、场景、行为方式与监管方式加以区分处理。在制度规范层面,应强化对数字侦查取证的控制,推动数字检察法律监督工作,规范智慧审判,确保公安机关、检察机关、审判机关的数字化改革符合刑事诉讼的基本原理。从这三个层面出发修改《中华人民共和国刑事诉讼法》,能使刑事诉讼的数字化转型在法治轨道内得以实现。 展开更多
