Second Group of National Human Rights Education and Training Bases Established

The Ministry of Education and the State Council Information Office on July 22 announced the second group of national human rights education and training bases, in- cluding the Human Rights Research Center at Renmin University of China, the Human Rights Research Center at Fudan University, the Human Rights Research Academy at Wuhan University, the Human Rights Research Center at Shandong University and the Human Rights Education and Research Center at the Southwest University of Politica~ Science arid Law.

Second National Convention on University Human Rights Education Held in Beijing

The Second China Convention on Human Rights Education in Universities was held on November 6-8 in Beijing. It was jointly sponsored by the Human Rights and Humanitarian Law Institute of the China University of Political Science and Law, the Norwegian Center for Human Rights at the University of Oslo, Norway, the Danish Institute for Human Rights and the Raoul Wallenberg Institute of Human Rights and Humanitarian Law at Lund University, Sweden. More than 90 researchers, scholars and human rights teachers of universities from China and other countries attended.

Probabilistic density function estimation of geotechnical shear strength parameters using the second Chebyshev orthogonal polynomial

A method to estimate the probabilistic density function （PDF） of shear strength parameters was proposed. The second Chebyshev orthogonal polynomial（SCOP） combined with sample moments （the origin moments） was used to approximate the PDF of parameters. X^2 test was adopted to verify the availability of the method. It is distribution-free because no classical theoretical distributions were assumed in advance and the inference result provides a universal form of probability density curves. Six most commonly-used theoretical distributions named normal, lognormal, extreme value Ⅰ , gama, beta and Weibull distributions were used to verify SCOP method. An example from the observed data of cohesion c of a kind of silt clay was presented for illustrative purpose. The results show that the acceptance levels in SCOP are all smaller than those in the classical finite comparative method and the SCOP function is more accurate and effective in the reliability analysis of geotechnical engineering.

The New Contribution to the Important Discourse on Human Rights by General Secretary xi Jinping

Under the background of the fact that human rights protection has become an important part of the socialist construction with Chinese characteristics in the new era, and with the international background of the strengthened trend of mainstreaming of human rights, Xi Jinping’s series of speeches and the 19 th CPC national Congress reports comprehensively explained the construction of human rights in China and the development of the international human rights. The important discourse on human rights by General Secretary Xi Jinping is people-centered: people’s yearning for a better life is our goal and reveals the source of human rights. Chinese dream is a dream of the country, of the nation, and of everyone in China. The close integration of individual and collective human rights points out that the state and people are important parts of collective human rights and it is an effective response to the "human rights over sovereignty" of Western countries. That there are not the best human rights, but the better ones; fighting for human rights is not always done, but always doing scientifically reveals the operational form of human rights. The right of survival and development is the primary human right; to attach importance to the right of peace conforms to the reality of our country and it has the support of the vast number of developing countries. Building a community with a shared future for human beings is a new vision for the development of the international human rights. only when the perfection and implementation of Constitution and law are paid attention to, and the democratization and legalization of the international human rights cause are promoted, can the guarantee be provided for the realization of human rights. The important discourse on human rights by General Secretary Xi Jinping is guided by Marxism, carries the communist party member’s original intention of serving people and is deeply rooted in the masses of the people. It inherits the theory of "benevolence" and "harmony" in Chinese culture,stands at the height of history and times, and points out the direction for the all-round development of Chinese people and the overall progress of society, and for the liberation of all mankind. This scientific theory is successfully guiding China’s human rights construction constantly towards new achievements and has had a profound and extensive impact on the international human rights cause.

Two parametric approaches for eigenstructure assignment in second-order linear systems

This paper considers eigenstructure assignment in second-order linear systems via proportional plus derivative feedback. It is shown that the problem is closely related to a type of so-called second-order Sylvester matrix equations. Through establishing two general parametric solutions to this type of matrix equations, two complete parametric methods for the proposed eigenstructure assignment problem are presented. Both methods give simple complete parametric expressions for the feedback gains and the closed-loop eigenvector matrices. The first one mainly depends on a series of singular value decompositions, and is thus numerically simple and reliable; the second one utilizes the right factorization of the system, and allows the closed-loop eigenvalues to be set undetermined and sought via certain optimization procedures. An example shows the effectiveness of the proposed approaches. Consideration of the Necessity of Prophylactic Bypass Grafting for Anomalous Origin of the Right Coronary Artery—Based on a Case with Concomitant Left Main Trunk Disease Resuscitated from Cardiopulmonary Arrest

Anomalous origin of the right coronary artery is a rare congenital anomaly, but is associated with sudden death. Originating from the opposite sinus of Valsalva, an interarterial?course and an intramural course are especially considered as the risk factor for fatal cardiac events. Surgical indication remains controversial because many patients are asymptomatic. A 52-year-old man with anomalous origin of the right coronary artery with an interarterial?course concomitant with the left main trunk disease was resuscitated from cardiopulmonary arrest. It was likely to be attributed to the left main trunk disease, but anatomical structure of the right coronary artery suggests its possible involvement. Prophylactic bypass grafting for the right coronary artery was performed using saphenous vein graft without ligating native vessel to prevent future cardiac events, as well as revascularization of the left main trunk disease. All grafts were patent in one-year follow-up coronary angiography. Any cardiac event has not occurred.

Urgent Off-Pump Revascularisation in ACS and Cardiogenic Shock with Anomalous Origin of Right Coronary Artery from Left Anterior Descending Artery: A Case Report

A 55-year-old female known case of essential hypertension and diabetes was brought to the Emergency Department in a drowsy state with cardiogenic shock. At presentation systolic BP was 70 mm Hg, pulse rate was 44/min and random blood sugar was 239 mg/dl. Troponin I was 8.07. Electrocardiography showed junctional rhythm and bradycardia. Ejection Fraction (LVEF) was 15% - 20%. Coronary angiography was done which revealed single vessel disease in LAD with anomalous origin of RCA from midsegment of LAD. Patient was immediately taken up for Off-pump Coronary Artery Bypass Grafting (OPCAB). Right saphenous vein graft was harvested and anastomosed proximally to aorta and distally to LAD on beating heart using Medtronic Octopus heart stabilizer and coronary shunts. Wound closed in layers after achieving complete hemostasis. Patient was taken off ventilatory support on first post-operative day and discharged in a stable condition on fourth post-operative day. Post-operative Echocardiography showed LVEF increased from 15% - 20% at time of admission to 38% and 52% after 3 months and 12 months of surgery respectively.

The draft of the Basic Healthcare and Health Promotion Law directly incorporates the concept of the right to health,which will have a positive significance in realizing the constitutional norms of the right to health protection.China’s Constitution stipulates the general policy,concrete duties and specific obligations of the state to protect citizens’ right to health,which is the most fundamental logical starting point of legislative design.The implementation of state obligations requires the legislation to follow the principles as follows:people-centered public welfare,respecting and protecting the principle of citizens’ right to health,equitable access to basic medical and health services and the government responsibility for the purpose of the people’s health.

Mutual Promotion between the Chinese Dream and the Human Rights Protection in China

The Chinese Dream is not only the dream of rejuvenation of the Chinese nation,but also the dream of human rights of the Chinese people.To accurately understand the shared root and origin of the Chinese Dream and the protection of human rights in China,we must understand that the Chinese Dream provides new strategic guidance for the protection of human rights in China,and the protection of human rights in China is an important measure to promote the realization of the Chinese Dream.To realize the Chinese Dream in the new era,Chinass human rights protection must always be people-centered,and adhere to the resolution of the main social contradictions in the new era.On the basis of raising the awareness of the whole Party and society to respect and protect human rights,we should remove obstacles and barriers to human rights protection and promote the building of a community with a shared future for human beings.At the same time,the protection of human rights in China in the new era must be guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era.We must adhere to the path of human rights development with Chinese characteristics,and study and solve various practical problems of human rights protection in China in the course of upholding integrity and innovation,so as to promote the realization of the Chinese Dream.Upholding the leadership of the Communist Party of China is the fundamental guarantee for realizing the Chinese Dream and protecting human rights in China.We must unswervingly follow the CPC’s lead and open up a new stage in the development of Chinas’human rights cause in the new era on the great journey to the Chinese Dream.

Unified parametric approaches for high-order integral observer design for matrix second-order linear systems

A type of high-order integral observers for matrix second-order linear systems is proposed on the basis of generalized eigenstructure assignment via unified parametric approaches. Through establishing two general parametric solutions to this type of generalized matrix second-order Sylvester matrix equations, two unified complete parametric methods for the proposed observer design problem are presented. Both methods give simple complete parametric expressions for the observer gain matrices. The first one mainly depends on a series of singular value decompositions, and is thus numerically simple and reliable; the second one utilizes the fight factorization of the system, and allows eigenvalues of the error system to be set undetermined and sought via certain optimization procedures. A spring-mass-dashpot system is utilized to illustrate the design procedure and show the effect of the proposed approach.

定牌加工出口为我国十分重要的产业发展方向,海关系统也对知识产权提供边境执法保护。然而,假使境外委托方并未在我国境内进行商标注册,并且在我国境内却由第三人拥有该商标专用权,则我国境内受托方定牌加工的行为将可能产生侵权疑虑。在平衡境内商标权利人的权利保护及促进定牌加工制造业发展间,应找出一个平衡点,但长期以来,司法裁判观点历经数次变动与海关执法存在一定的逻辑矛盾,使得相关争议一直存在,因此,明确请求权基础才能把问题从根本上解决,也才能平衡我国加工出口产业的发展及商标权保护。

行政诉讼的二审裁判及其具体适用——《行政诉讼法》第八十九条评注

现行《行政诉讼法》第八十九条是有关二审裁判的规定,其相较1989年《行政诉讼法》第六十一条做了较大修改与完善。二审裁判根据其针对的是一审判决还是裁定区分为两类,前者的裁判类型包括驳回上诉维持原判、撤销原判依法改判、发回重审以及作为例外的裁定驳回起诉;而后者的裁判类型则包括维持和撤销变更原裁定两类。二审裁判的适用标准关联二审的审查方式和审查范围,同样参考了提高二审监督能力的现实考虑。禁止不利变更原则虽未明确写入《行政诉讼法》中,但其不仅适用于变更判决,同样适用于二审裁判。二审裁判具有终局效果,但其既判力的拘束程度又取决于再审事由的判断,取决于实质正义与法安定性的价值权衡。

再论“数字人权”的解构与追问

“数字人权”论争至今,正题与反题的交锋依次聚焦第四代人权、人权的道德基础、人权性质三个争议点。从逻辑顺序来说,判断一项权利是否属于人权,首先要看基于人的本原属性能否推导得出,否则无所谓第几代人权或人权新特征的问题。在人权本原看来,“数字人性”不是人之本性,倘若把“数字人性”视为人权的人性根基,则会导致主体虚化、形态变异、义务扩张的伦理危机。就人权结构而言,“数字人权”的价值证立欠缺最低限度的基础性,政治决断与学术论证的脱离会导致科学性存疑,对“三元结构”的突破不利于规范体系的稳定性。“数字人权”话语表达的逻辑、理论和知识生产存在着不自洽、不自信、不自主的缺陷,即因果倒置、路径依赖和重复生产。因此,对于数字科技与人权的复杂性关系,仍需从人权本原、人权结构、人权话语等多元视角继续追问。

论知识产权的二阶性与知识产权请求权——基于“Idea—IP—IPRs”框架的分析
