On May 28, 2019 Chinese Cosmetics Development Conference was held in Beijing. At the conference, Li Nan, chief of the General Division, Supervision Department of the State Food and Drug Administration introduced China’s development concerning the cosmetics supervisory rules and regulations from the perspectives of legislation plan and thinking. He mentioned that the regulations on supervision and administration of cosmetics are expected to be released this year, and the regulations on cosmetic registration and label management.

The third-party regulation on food safety in China:A review

Stakeholders in the field of food safety management in China can be classified into three categories, government, food producers （farmers and enterprises）, and the third-party regulatory bodies. The third-party regulation has experienced rapid development in past twenty years, and recently received considerable attention from consumers and the central government. This paper provides a review about the development, problems and future trend of the third-party regulation on food safety in China. To be specific, five forms of the third-party regulation are assessed, including media exposure, the third-party certification, regulation by consumer associations, social movements promoted by non-governmental organiza- tions （NGOs）, and regulation by industry associations. The study concludes that media and consumer associations are the major players in the third-party regulation and are highly repudiated among customers. The food certification industry has developed rapidly, but is now facing crises of confidence among consumers because of its lack of self-regulation. NGOs and industry associations still remain in the early development stages of food safety management, and therefore, are of little importance in current regulatory bodies.

China’s New Cosmetic Regulations and Their Impact on Cosmetic Registration Person and Notification Person

Regulations on the supervision and administration of cosmetics(hereinafter referred to as“CSAR”)will be formally implemented on January 1,2021,and there are more than 10 related regulations and normative documents draft has been issued,these new rules will be built to form a new cosmetics regulatory system,the CSAR for the first time put forward the"cosmetic notification person and registration person system",improve the barriers to entry for cosmetic notification person and registration person.This paper summarizes and analyzes the new regulations on cosmetics issued in 2020,and briefly discusses the new requirements and suggestions on setting up quality management system,quality safety responsible person,adverse reaction monitoring and evaluation system,cosmetic efficacy evaluation and other new requirements for cosmetics notification person and registration person after the implementation of the new regulations.

Cosmetic Safety and Risk Assessment Under the “New” Regulations

Regulations for the Supervision and Administration of Cosmetics was promulgated by the State Council on June 29,2020 and will take effect on January 1,2021.Compared with the previous Regulations on Health Supervision of Cosmetics,there are more items proposed for the safety of cosmetics.In this paper,the main changes of the safety supervision of cosmetics by comparing the“new”and“old”regulations were summarized with the potential influences on different groups(government,cosmetic enterprises and consumers)discussed.The important laws and regulations on cosmetic safety and risk assessment in China with recently added in vitro testing methods were summarized and the principal theory of cosmetic quantitative risk assessment was introduced.

我国高校院系治理的演进、困境与进路探赜

院系治理是大学治理能否实现现代化的关键。在协调党政关系主基调下,我国高校院系治理大致历经了“探索初创期”、“调适定型期”和“提质增效期”等三个演进阶段。当前,我国院系治理面临领导体制不健全、制度体系不完备、运行机制不通畅、治理主体权责失衡、党组织功能“悬浮化”等瓶颈和困境。推动院系治理现代化,应在遮蔽与澄清、守正与创新的动态调适中科学规避“制度移植陷阱”,创造性地推进党委领导下的校长负责制向院系层面的制度移植。在实践中,明晰院系党政共同领导下的分工负责制、完善党政联席会议制度、构建党政学协商共治模式、充分发挥党组织功能作用,是加快推进院系治理现代化的应然路径。

党的组织法规法典的规范体系:应然定位、法规构成与立规限度

规范体系的边界划分是编纂党的组织法规法典首先要明确的问题。党的组织法规法典的规范体系可以从党的选举类、组织类、象征标志类和组织工作类法规进行定位,宜选择“中法典”的编纂思路,对党的选举类、组织类和组织工作类法规进行法典化。党的组织法规与其他领域党内法规的调整范围划分是法典规范体系的外在限定,决定着法典规范体系的内容取舍,为此需要厘清党的组织法规与其他领域法规的界限。党的组织法规法典规范体系的立规限度应以法规是否频繁变动、调整领域是否具有局限性、是否具有试行期限、是否属于细密配套性法规、是否在适用主体上具有特定性及适用空间领域具有特定性等为标准进行考量,在此基础上合理界定法典规范体系的立规限度,最终形成边界清晰、规范内容完整和内外协调的党的组织法规法典。

论行政许可事项的合理设定

行政许可事项的合理设定是我国《行政许可法》和《优化营商环境条例》的要求,也有助于推进规制改革和政府职能转变。行政许可事项的合理设定以应对市场失灵,配合国家政策执行等正当现实需求为基础。设定者应以许可事项与许可规制能力范围的匹配为考量,将行政许可用于适合由其规制的事项上。行政许可事项的合理设定还应恪守必要性限度,遵循自生秩序优先、柔性工具优先等设定原则,审慎利用许可规制,以求实现更好的规制。

高校机关作风建设的价值旨趣、实践意蕴与当代启示

党的作风是党的形象,作风建设是党的建设的永恒主题。机关作风建设是高校党的建设的重要组成部分,直接关系到党的教育方针能否贯彻落实到位,关系到学校党委的决策部署能否落地见效。文章在阐述高校机关作风建设高质量发展重要意义的基础上,从发挥高校机关党组织政治功能组织功能、打造过硬机关党员干部队伍、深化改进机关作风建设机制三个维度出发,系统梳理了我国高校近年来在机关作风建设方面的历史经验,以思想作风、工作作风、领导作风、纪律作风建设为切口,进一步阐释了推动高校机关作风建设高质量发展的实践进路。

党内法规实施后评估制度的地方实践探索与思考

党内法规实施后评估是党内法规制度建设的一项重要内容,就目前而言,如何科学有效地开展评估工作仍处于研究探索阶段。党的十八大以来,在党中央的推动下,部分省市以立法后评估理论和制度为参考,进行了党内法规实施后评估的实践活动,开展了党内法规实施后评估制度的实践探索,涉及评估主体、评估标准、评估成果应用等方面的具体要素,相关评估实践取得了有益成果。高质量发展是新时代党内法规制度建设的鲜明主题,党内法规实施后评估需要紧紧围绕服务于高质量发展这一核心要旨,在准确把握党内法规实施后评估自身特性的基础上,从充实完善评估主体结构、优化调整评估标准体系、健全完善评估结果应用机制等方面改进与完善评估制度,提高党内法规实施后评估效能。

行政诉讼中公序良俗原则之适用

公序良俗原则在行政诉讼中的适用边界具有模糊性。通过NVivo质性分析可得出,近年来在行政诉讼中适用公序良俗原则的案件数量增加,案件类型的范围显著扩张。对法院、原告与被告就该原则的判断标准或描述性方式及其裁判文书中位置梳理可得出,不同法官对公序良俗原则的判断标准不同,当事人对该原则也有不同的理解。公序良俗原则判断标准的不确定性成因,一是法院对该原则的论述理由不具有说服力,应适当考虑行政诉讼当事人的描述性方式,并对此予以适当回应;二是法官缺乏将原则具体化的思维工具,宜通过“比附”和“还原”方式厘清公序良俗原则的适用边界,进而搭建起适用公序良俗原则及其新规则的路径。

法治规范体系视域下党内法规保留的功能定位与规范建构

党内法规保留是将法律保留相关原理引入党内法规制度建设中形成的有关党内事务制定权配置的制度。在中国特色社会主义法治体系的法治背景下,党内法规保留应以法治规范体系作为制度建构的基本视角。基于与法律保留的功能比较,党内法规保留具有统制、区分、整合、保障等功能。在法治规范体系视域下,当前党内法规保留制度存在明显结构缺陷。可以从重塑党内法规保留的结构理念、重新阐释《中国共产党党内法规制定条例》第四条第一款的保留对象、建立相对保留制度、单列党章保留事项、对中央党内法规绝对保留事项进行内涵解读等方面进行结构重塑与完善。此外,在党内法规保留的保留标准上,应确立面向从严治党的重要事项保留标准。

行政备案适用范围的法律规制

备案管理法治化对备案管理措施适用范围规制提出了现实追问。目前,备案管理措施运行实践存在类型设定庞杂化、设定依据宽泛化与规制功能异质化等泛化困境。备案管理措施适用范围规制失范可能会引发三个方面的风险:一是因准入门槛不当降低所诱发的市场规制失灵风险;二是因被动监管所引发的监管懈怠缺位风险;三是因柔性监管所引发的监管权威侵蚀风险。基于备案管理措施的内在属性并根据必要适当性原则要求,应当在充分平衡备案管理措施类型因素与外部效应的前提下,从主体要素、公共资源要素配置、风险要素控制和信息要素四个层面对行政备案管理措施适用范围作出限制性规制。
