The Governmental Responsibility of Relief Measure in the Process of Implementing Anti-Domestic Violence

The first Anti-Domestic Violence Law of the People's Republic of China came into effect on March 1, 2016, which filled the vacancy of anti-domestic violence law in the legal system of China. The anti-domestic violence law is aimed at preventing and avoiding domestic violence, protecting lawful rights and interests of family members, maintaining a peaceful, harmonious and civilized family relation and promoting family harmony and social stability. The process of implementing the anti-domestic violence law is not accomplished at one stroke;instead, it is a systematic engineering needing to be done with efforts from all directions. The government, as the strongest supporter of citizens, shall take corresponding responsibilities in the process of implementing the anti- domestic violence law, especially the governmental responsibility of relief measure in the process of implementing anti-domestic violence.

Making an Anti-Domestic Violence Law a Must for China

Domestic violence, as a so- cial problem, has existed for a long time in countries across the world. In China,domestic violence has gained the increasingly intense attention of the entire society since the Fourth World Conference on Women, which was held in Beijing in 1995. Prohibition of domestic violence is now stipulated in relevant laws. But in the absence of a law specifically designed to prevent and curb domestic violence, this social problem is far from being resolved. Instead, facts prove that it has gone from bad to worse.

反家暴庇护所是从事家庭暴力防治工作的专业机构,经法律明确后在我国各省市被大量建设,但绝大多数都陷入了入住率极低的困境。文章概述庇护所发展历程及现状,分析现存问题,通过研究国外文献,借鉴国外反家暴庇护所建筑案例,结合庇护所工作流程,重点从庇护所功能设置及要求、色彩设计、材质设计和情感化设计方面具体论述反家暴庇护所建筑设计方法,旨在为建设专业化、人性化的反家暴庇护所提供理论参考。

论我国《反家庭暴力法》对家暴受虐儿童的保护

《中华人民共和国反家庭暴力法》(以下简称《反家庭暴力法》)从家庭暴力的预防、发现、事后处置等方面对儿童利益的保护做出了积极的规定,但本次立法缺少儿童视角,未设立家暴受虐儿童保护专章,未充分体现对儿童利益特殊保护的原则。为更好地保护儿童权益,从实体视角对《反家庭暴力法》提出增加儿童遭受家庭暴力侵害的类型、建立完善的强制报告制度、建立专门的儿童庇护所、建立国家监护制度、明确对受虐儿童隐私权的保护等建议;从程序视角提出完善家事法庭的建设、检察机关提起公益诉讼、建立专门的民事诉讼证据规则等建议。

反家暴庇护所的现实再定位和发展路径选择——以实证调研为基础的分析

尽管改革已成为反家暴庇护所走向的共识,但究竟如何改革却众说纷纭。社会群体中家庭话语权的畸形分配和司法窗口下家庭暴力救济乏力,为反家暴庇护所的职能发挥创设崭新空间。当前,应以国家和社会二元区分视角来对反家暴庇护所进行分类再定位,同时兼顾中国本土社会样态和家事纠纷处理内在逻辑进行价值再定位。立足于本土行政、司法、社会资源基础上妥当的分配国家权力和社会权力植入反家暴庇护所的力度,辅之借鉴英美日等域外法治理经验,促进国家权力下司法、政府主导的反家暴庇护所成功转型和社会权力下庇护所复制再生。最终建构以社会权力为基础、以国家权力为后盾,双重权力交织地反家暴庇护所协作联动的发展路径,改良社会风尚并形成良性的路径依赖,根除家庭暴力。
