Practice and Outlook of China's Regulation on the Extraterritorial Human Rights Responsibilities of Transnational Corporations

As China’s overseas investment and business operations continue to expand,the issue of human rights risks faced by Chinese transnational corporations abroad has attracted sustained attention from society.In recent years,China has enacted a series of laws,regulations,and policies to better regulate the overseas business conduct of transnational corporations,urging them to respect the human rights of the people in host countries and fulfill their social responsibilities to achieve sustainable development.Meanwhile,China has actively participated in the formulation of the Legally Binding Instrument on Activities of Transnational Corporations and Other Business Enterprises in International Human Rights Law,providing a Chinese solution to promote global governance of transnational corporations.However,in practice,the lack of institutional mechanisms,systems,and industry rules to supervise and guide transnational enterprises in fulfilling their human rights responsibilities,as well as the limited awareness of human rights risks among these enterprises,have resulted in ongoing human rights risks in their overseas business operations,particularly regarding labor rights and environmental rights.In response,China should take its national conditions into consideration and focus on the development trends of human rights issues in the business sector at the international level.Drawing on the experiences of other countries,China should explore and establish institutional and practical measures to regulate the human rights responsibilities of transnational enterprises through legislation,administration,and judiciary actions,in order to address the risks and challenges faced by Chinese enterprises in foreign investments and contribute to the sustainable development of the world and global human rights governance.

The Protection of Human Rights in the Construction of Barrier-free Environment--Viewed from the perspective of the Marxist Human Rights Concept

The construction of a barrier-free environment contains a rich connotation of human rights protection,and is closely related to the study of human rights protection in China.With the evolution of the concept of barrier-free design and the expansion of its beneficiary groups,constructing a barrier-free environment has become a basic task that benefits all members of society and meets the public needs of all the people,with its core goal expanding from the protection of the rights of the disabled to the protection of the basic rights and interests of all members of society.Building a barrier-free environment from the perspective of the Marxist human rights concept is conducive to safeguarding the people’s right to subsistence and development,and at the same time,it satisfies their demand for the right to pursue a high-quality and better life and reflects the common vision of everyone in society fully enjoying human rights.promoting the construction of a barrier-free environment in terms of legal protection based on China’s institutional advantages can improve and innovate the country’s legislation on the construction of a barrier-free environment,so as to play an exemplary and guiding role in enhancing the international barrier-free level and enable all people to enjoy the good life created through the drive to build a barrier-free environment.

Unenumerated Rights Clauses and the System of Restriction on Fundamental Rights——Another Construction Plan for Article 51 of the Constitution of PRC

According to constitutional jurisprudence in China,Article 51 of the Constitution is an unenumerated restrictive clause.Such theoretical construction fails to justify the differentiated restrictions established in the Constitution and makes it difficult to explain the constitutional status of human dignity. Article 51 implies the possibility of other theoretical constructions. It is not an unenumerated restriction clause but an unenumerated rights clause. It aims to provide guarantees for general freedom of action not enumerated in the Constitution rather than restricting fundamental rights. The actual benefit of this kind of theoretical construction lies in that it can establish the basis of the constitutional text for general freedom of action and promote the people’s correct understanding of the model of restriction on fundamental rights established by the Constitution of PRC.

Forty Years' Construction of Rule of Law and the Legalization of Human Rights Protection in China

A market economy requires the individual rights of citizens be protected, and that the exercising of those rights be regulated, whose realization depends on the legalization of human rights protection On the one hand, individual rights must be protected by law On the other hand, a law-based society needs to be built so the boundaries of individual rights are clear, the exercising of those rights are regulated, conflicts between rights can be resolved through the courts, and the personal infringement of others’ rights and the overall interests of the society is prohibited by law During the 40 years of China’s ref orm and opening-up in China, the promotion of the legal protection of human rights mainly lies in three aspects: first, the important role of the rule of law plays in protecting human rights has been clarified; second, the four steps of the rule of law(scientific legislation, strict law enforcement, judicial justice and observance of the law by all Chinese citizens) have been strengthened to safeguard human rights fully and effectively; third, the Chinese human rights system under the rule of law has gradually been aligned with international norms.

As China has embarked on a new journey to comprehensively build a modern socialist country and marches toward the Second Centenary Goal,improving the protection of human rights in environmental protection has become a key task to meet people's growing demand for a better life.The international community has reached a consensus on the human rights attribute of environmental rights,and China has also recognized it in its National Human Rights Action Plan of China(2021-2025).Early claims for environmental human rights gave birth to modern environmental law at the international level,while the global consensus on sustainable development promoted the new development of environmental human rights.In China,the construction of a"beautiful China"has become the national goal confirmed by the Constitution.The confirmation of environmental rights in the planned environmental code can further clarify the connotation of the value system of the code and help clarify the institutional structure and attribution logic of the code.Based on the subjective right and objective value of environmental rights,the specific scheme for the"codification"of environment rights is to construct the system from three levels of ontological provision,guarantee provision and reliefprovision.

The Three-dimensional Model of “ConstructionTranslation-Communication” for the Construction of a Human Rights Discourse System with Chinese Characteristics in the Post-pandemic Era

Human rights have always been the focus of disputes between China and the West. To make a better China story about human rights and enhance China’s international discourse power in the field of human rights, we propose the text construction, translation and communication path of the construction of the human rights discourse system with Chinese characteristics from the cross-disciplinary perspective. Based on the examples of prevention and control of the CoVID-19 pandemic under the concept of putting people first, mainstream diplomatic linguistic data relevant to the fight against the novel coronavirus was collected through the internet. The human rights discourse with Chinese characteristics is constructed through a variety of texts focusing on putting the people first, the right to life, the right to health, the right to information, the right to privacy, the right to work and a sense of a community with a shared future for human beings. The core concepts of human rights have experienced the deepening process of decontextualization, abstraction and theorization to gradually conform to the expression habits of international audiences. The international communication effect is mainly positive in civil society. It shows that the construction of China’s human rights discourse system and the governance of international human rights discourse have achieved preliminary results. To enhance China’s discourse power on human rights, we need to add an interdisciplinary approach.

Confirmation of homestead right is helpful for planning of rural construction land and comprehensive development of new socialist countryside construction. At present,China is carrying out confirmation of rural homestead right on a large scale. Taking Changyuan City of Henan Province,a pilot city of collective commercial construction land reform,as the research object,this paper analyzes the scientific connotation of"same land,same right,same price"of collective commercial construction land and state-owned land in the unified urban-rural construction land market system,and how to realize"same land,same right,same price".The results show that in order to realize the fair entry of collective construction land into the market,it must base on scientific use control,unify the urban and rural construction land market and adhere to the guidance of market mechanism,and finally realize the sustainable development of the land market.

This paper had started its words from the hot current Umbrella Movement in Hongkong, with putting forward the questions that ＂ What is the democracy？ ＂ and ＂ How should the democracy develop？ ＂ . And then, it had reviewed the historical development of the concept of democracy, on that basis, it had explored the socialist democratic system in China and analyzed the dilemmas in the construction of socialist democracy. And it gave the responses to questions in the beginning of the article and explained the reasons in details. Overall Planning of Public Power and Expression of Private Rights in Cross-regional Trading of Construction Land Quotas

In China, the trading of construction land quotas has undergone an institutional evolution process characterized by gradual deregulation.In 2021, the Central Committee of the Communist Party of China(CPC) resolved to develop a national cross-regional trading mechanism for construction land quotas.Construction land quotas, which have attributes of both public power and private rights, share certain common grounds with the rights of land development, dumping and carbon emission.To build a national trading market for construction land quotas, it is necessary to make clarifications and innovations in macro-level ideas, meso-level mechanisms, and micro-level designs.

In order to implement the National Human Rights Action Plan （2012-2015）, the Ministry of Education and the State Council Information Office named the Renmin University of China Human Rights Research Center, the Fudan University Human Rights Research Center, the Wuhan University Human Rights Research Academy, the Shandong University Human Rights Research Center and the Southwest University of Political Science and Law Human Rights Education and Research Center as national human rights education and training bases. Law Absence and System Construction of Equal Material Assistance Rights of Farmers in China

Firstly,conception of farmers' equal material assistance rights is introduced from the aspects of equal rights,material assistance rights,and farmers' equal material assistance rights.Value function of farmers' equal material assistance rights is pointed out,which can eliminate the partial policies with urban priority orientation.It is a necessary condition for maintaining the legal and institutional authority,as well as an inevitable choice to realize the social justice and harmony.Current status of the law absence of farmers' equal material assistance rights in China is introduced,which is reflected in the lack of theoretical research on farmers' equal material assistance rights in the law circle,the lack of procedural legal system of farmers' equal material assistance rights at present,and the lack of actual law effectiveness of farmers' equal material assistance rights at present.System construction is a turning point to change the law absence of farmers' material assistance rights.Government should promote the economic development,provide material bases for the system construction of farmers' material assistance rights,enhance the legal consciousness of farmers,cultivate the ability of farmers to participate in equal material assistance rights,strengthen the procedural legislation and judicial justice,and ensure the farmers' material assistance rights.

Oil and Gas Pipeline Construction-Induced Forest Fragmentation and Biodiversity Loss in the Niger Delta, Nigeria

The impacts of oil and gas pipeline construction on the forest and biodiversity in parts of the Niger Delta was investigated. This was achieved by studying the construction activities and operational phases of two pipelines with cumulative length of 165 km vis-à-vis the biodiversity of the affected area. The study involved field sampling along the RoWs to inventorize the fauna and flora, visual assessments and interview with locals. It was observed that the pipelines traversed moist lowland/freshwater swamp and mangrove forests, and barrier islands with approximately 4,950,000 m2 (equivalent of 495 hectares) of forest cleared and 9,642,000 trees killed to realize the pipelines. A total of 219 plant species in 66 families and 125 different fauna species from 64 families were recorded in these areas. Three out of the 4 recorded species of Meliaceae were threatened based on IUCN Conservation Status. Also based on IUCN Conservation Status, 20 mammals, including Pan troglodytes, Cercopithecus erythrogaster and Trichechus senegalensis, 7 birds, 2 reptiles and 1 amphibian were within threatened group. The results showed that the study area had witnessed colossal loss of biodiversity due to habitat displacement, forest fragmentation and deforestation, and escalated exploitation of species. The study identified the most affected biodiversity, and proffered measures to mitigate such occurrences.
