Family Planning Policy Safeguards & Promotes Human Rights in China

For People's Right to Safety Of Lives and Health——On development of health-related human rights in China

Medical and health work constitutes the prerequisite to protection of the people's right to safety of lives and health. Over the past decades, the Chinese Government has spared no effort in this regard and, as a result, the Chinese people's health has significantly improved. In the nationwide fight against the SARS (severe acute respiratory syndrome) epidemic in the first half of 2003, the Government placed the health of the Chinese people and the safety of their lives above everything else. With a huge input of human, financial and material resources, the country won a decisive victory over the epidemic. On All-round Development of Human Rights in China

In October 2003, the Third Plenary Session of the Sixteenth Central Committee of the Communist Party of China （CPC） called for adherence to ＂the outlook toward development based on the fundamental interests of the people, toward an all-round, balanced and sustainable development.＂ The session also proposed to the National People＇s Congress （NPC） that respect for and protection of human rights be written into the country＇s Constitution. And accordingly, the NPC adopted a decision to revise the Constitution the following year. The call and the proposal were inter-related. The call sets the guideline, the theoretical basis and the orientation for the development of human rights in China. The pro- posal subsequently resulted in a revision of-the Constitution, the fundamental state law, which came as a legal guarantee for respect for and protection of human rights. Then, the ＂task of promoting an all-round development of the human rights cause＂ was written down into the country＇s Eleventh Five-Year Program for National Economic and Social Development （2006-2010）, which was approved by the NPC in March 2006. This was the first time that the development of human rights was written into a national program for social development. This means that an even closer link has been forged between China＇s human rights cause on one hand and the country＇s political, economic, cultural and social welfare undertakings on the other, thus preparing China＇s human rights cause for faster and sustainable development. We are now safe to predict that in the future, there will be even more and better rights the Chinese people are able to enjoy.

The Tension Balance Structure of China's Human Rights Development Path

The human rights white paper has in it the basic concepts of human rights,the form of the human rights system,and the mode of human rights practice in modern China.It is based on the tension balance structure between the historical feature and rationality,the cultural feature and similarity,the realistic feature and the common feature of human rights.Adhering to the historical nature of human rights rather than abstract rationality,and the cultural diversity and equality of human rights rather than one dominant model,and the particularity of human rights rather than universality is the pillar of China’s human rights philosophy,system,and practice.The human rights development path that combines the top-down leadership of China’s ruling party,the capability of the Chinese government in taking a holistic approach and the bottom-up driving force of the people is very different from the natural evolution path of the West.
